A federal judge on Thursday struck down a Texas law requiring voters to show identification at polls, saying it placed an unconstitutional burden on voters and discriminated against minorities. In a ruling that follows a two-week trial in Corpus Christi of a lawsuit challenging the law, U.S. District Judge Nelva Gonzales Ramos also found that it amounted to an unconstitutional poll tax. “The court holds that SB 14 creates an unconstitutional burden on the right to vote, has an impermissible discriminatory effect against Hispanics and African-Americans and was imposed with an unconstitutional discriminatory purpose,” Ramos wrote in a 147-page ruling.

A federal court has ruled Virginia’s congressional map violated the 14th Amendment and instructed the legislature to redraw the state’s congressional boundaries by April 1, 2015. On Tuesday, three federal judges sided with the plaintiffs, who argued the Republican-led legislature drew Virginia’s 3rd District to pack blacks into the district, thus diminishing their influence in neighboring districts and violating the Equal Protection Clause of the 14th Amendment. The current map will still be in effect for the 2014 elections. The court instructed the legislature to redraw the entire congressional map by April, and there will likely be more legal action before then. “This is going to get appealed to the Supreme Court,” a redistricting expert involved with the case told CQ Roll Call in a phone interview. The expert pointed out the issues in the Virginia case are similar to a redistricting case in Alabama, which the Supreme Court agreed to consider.

North Carolina: U.S. Supreme Court Upholds North Carolina’s Limits on Voting | Governing

The U.S. Supreme Court issued a ruling on Wednesday that means voters in North Carolina will not be able to vote out of their precincts on Nov. 4 nor register to vote and cast ballots on the same day. The ruling blocked a 4th U.S. Circuit Court of Appeals decision Oct. 1 that reinstated same-day voter registration and out-of-precinct voting for the coming election. The justices offered no insight into their 7-2 ruling to uphold a district court ruling to let the November election proceed under the 2013 rewrite of the state’s elections laws. Supreme Court Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented and issued an opinion outlining their reasons. They said they had no reason to disagree with the 4th Circuit’s reasoning that elimination of same-day registration and out-of-precinct voting would limit opportunities for black voters to cast ballots. Ginsburg said the Voting Rights Act of 1965 had “worked to safeguard long-obstructed access to the ballot by African-Americans” by blocking such election-law changes in the South. But the court voided that “pre-clearance rule” last year in a 5-4 decision. North Carolina voting laws were changed weeks after the Supreme Court ruling on the Voting Rights Act.

The Supreme Court Wednesday night allowed North Carolina to implement for the coming election changes in the state’s voting law that an appeals court had blocked. The action means that the state can eliminate same-day registration and not count ballots cast by voters who show up at the wrong precinct. A panel of the U.S. Court of Appeals for the 4th Circuit had blocked both changes because it said they would disproportionately affect African-American voters. The Supreme Court’s order did not detail the majority’s reasoning. But Justices Ruth Bader Ginsburg and Sonia Sotomayor said they would have kept the lower court’s order in place.  “The Court of Appeals determined that at least two of the measures — elimination of same-day registration and termination of out-of-precinct voting — risked significantly reducing opportunities for black voters to exercise the franchise in violation of Section 2 of the Voting Rights Act,” Ginsburg wrote. “I would not displace that record-based reasoned judgment.”

Just weeks before elections that will decide control of the Senate and crucial governors’ races, a cascade of court rulings about voting rules, issued by judges with an increasingly partisan edge, are sowing confusion and changing voting procedures with the potential to affect outcomes in some states. Last week, a day before voting was scheduled to begin in Ohio, the United States Supreme Court split 5 to 4 to uphold a cut in early voting in the state by one week; the five Republican appointees voted in favor and the four Democratic appointees against. Cases from North Carolina and Wisconsin are also before the court, with decisions expected shortly, while others are proceeding in Texas and Arkansas. The legal fights are over laws that Republican-led state governments passed in recent years to more tightly regulate voting, in the name of preventing fraud. Critics argue that the restrictions are really efforts to discourage African-Americans, students and low-income voters, who tend to favor Democrats.

A federal-court panel on Tuesday struck down Virginia’s congressional map, ruling the state’s last redistricting effort relied too heavily on race in drawing boundaries. The 2-1 ruling, from a Virginia federal court, sided with challengers who said the Virginia election map packed black voters too heavily into one district, reducing their influence in other state districts. The federal judges, sitting as a special election review panel, didn’t require the state to change its map for the midterm elections, which are just weeks away. Instead, the judges said Virginia lawmakers should act “within the next legislative session” to draw new electoral districts. At issue was Virginia’s Third Congressional District, which includes parts of Richmond. The black voting-age population after the redistricting makes up about 56% of the district, according to the court’s opinion. The court described the district as an oddly shaped composition of a “disparate chain” of predominantly black communities.

Whether to allow Wisconsin’s strict voter ID law for this fall’s election is up to the Supreme Court – a decision that could come any day. But on Monday, an appeals court gave the law’s backers a big lift. A three-judge panel of the 7th Circuit issued a ruling upholding the law. It was the same panel of all-Republican appointees that last month removed a district court judge’s injunction on the law, leading voting rights groups to ask the Supreme Court to intervene. The 23-page ruling, written by Judge Frank Easterbrook, finds that the law is constitutional and does not violate the Voting Rights Act’s (VRA) ban on racial discrimination. The opinion is striking for its blithe tone in upholding a law that could disenfranchise many thousands. One prominent election law scholar called it “horrendous.” Still, the ruling could give the Supreme Court an additional reason to keep the ID measure in place. Courts tend to be less willing to overturn a full ruling on the merits than a more quickly issued order, which is all that the appeals panel had previously offered. And since Wisconsin has until 5 p.m. Tuesday to make its case to the Supreme Court, the ruling could also give state lawyers some helpful tips for making its case.

The Supreme Court said Monday that South Carolina can keep its redrawn state house and congressional maps despite a challenge from black voters in the state. The justices offered no comment when they rejected the appeal from voters, who wanted the court to re-examine the newly drawn borders of state house and congressional districts. In 2012, six black voters from counties in the southern and eastern parts of the state sued Republican Gov. Nikki Haley and the Republican-controlled state legislature. They sought to throw out the redrawn district maps and prevent the state from holding any elections based on those maps. They argued the maps pushed black voters into one congressional district and created “voting apartheid.”

A panel of three federal judges upheld Wisconsin’s voter ID law Monday, finding it is in keeping with the U.S. Constitution and federal Voting Rights Act. The panel of the 7th Circuit U.S. Court of Appeals last month ruled the voter ID law could be put in place for the Nov. 4 election between Republican Gov. Scott Walker and Democrat Mary Burke. Monday’s ruling is the panel’s final decision on the issue and puts the voter ID law in place for other future elections. Attention now turns to what U.S. Supreme Court Justice Elena Kagan or the full Supreme Court might do. Even before Monday’s ruling, the groups that challenged the voter ID law had asked Kagan to block the voter ID law for the Nov. 4 election. Kagan is the justice responsible for handling emergency petitions in cases before the 7th Circuit, which covers Wisconsin, Illinois and Indiana. Writing for the unanimous appeals panel, Judge Frank Easterbrook determined Wisconsin’s law was essentially identical to an Indiana voter ID law that the U.S. Supreme Court upheld in 2008.

One federal judge has allowed a voter ID law to take effect in Wisconsin. Another is now contemplating whether to do the same in Texas. Defenders of these laws, which exist in some form in 34 states, insist that requiring people to show government-issued identification at the polls will reduce fraud—and that it will do so without imposing unfair burdens or discouraging people from voting. In North Carolina, for example, Republican Governor Pat McCrory wrote an op-ed boasting that the measures fight fraud “at no cost” to voters. It’s not surprising that McCrory and like-minded conservatives make such arguments. The Supreme Court under Chief Justice John Roberts has steadily weakened the Voting Rights Act and related legislation, which for generations federal official used to make sure minority voters had equal voice in the political process. But in 2008, when the Court approved Voter ID laws, the Court left open the possibility of new challenges if plaintiffs can demonstrate the laws impose a burden on would-be voters. There are now good reasons to think the laws do exactly that.

Attorneys for North Carolina and voting rights groups battling it out over the state’s 2013 voting law will have yet another hurdle to clear before it becomes clear if that law will or will not be in effect come early November’s elections. Just days after the civil rights organizations challenging the law celebrated an appellate court decision to lessen its impact by allowing same-day registration and out-of-precinct voting during upcoming midterm elections, they now have until 5 p.m. ET Sunday to respond to the state’s request that the U.S. Supreme Court enjoin the Fourth Circuit Court of Appeals’ decision to block parts of the law. In a petition filed late Thursday, North Carolina attorneys say the lower court’s decision, set to be in effect during a statewide general election for the first time this November, “represents a massive and unprecedented last-minute change” before the state’s early voting period starts Oct. 23. “North Carolina is not prepared for the changes and will not have enough time to implement them in an orderly manner,” the petition reads.

While a federal judge in Corpus Christi mulls whether the state’s requirement to show photo ID to cast a ballot violates the federal Voting Rights Act, a judge on the highest criminal appeals court in Texas is taking another approach: He’s suing the state over its relatively new voter ID law. Judge Lawrence “Larry” Meyers’ lawsuit, filed in Dallas County, claims the voting law enacted last year violates the Texas Constitution because it attempts to “prevent” voter fraud, something he says the state’s governing charter never intended.  Meyers’ lawsuit states that “the Texas Constitution gives the Texas Legislature power solely to ‘detect and punish’ election fraud when it has already occurred.” In an interview on Wednesday, Meyers said the Constitution says nothing about preventing election fraud.  “It’s legally unconstitutional and it’s an affront to every voter in the state of Texas,” Meyers said.

With four major voting rights cases currently before the courts, access to the ballot for the upcoming midterms hangs in the balance. But the stakes could be much higher still. If one of the cases winds up before the Supreme Court, as looks likely, it could give Chief Justice John Roberts and his conservative colleagues a chance to decisively weaken safeguards against race bias in voting. And with the Republican-controlled Congress unlikely to pass new voting protections, that could usher in a bleak new era for voting in America — half a century after the issue looked to have been put to rest. “I’m very worried that the Supreme Court will take a case on the merits, and write an opinion that drastically constricts the right to vote,” said Daniel Tokaji, an election law scholar at Ohio State University. “I think that is a very real danger, given the conservative composition of this court, which has shown itself to be no friend to voting rights.” Justice Ruth Bader Ginsburg this week named the Shelby County v. Holder ruling, which neutered the Voting Rights Act’s strongest provision, as one of the current court’s three worst. But Shelby  left open a key question: What kinds of voting restrictions is the post- version of the VRA strong enough to stop? Any of the four pending cases could give the court a chance to provide an answer.

Last year, North Carolina passed the most sweeping voting restrictions since the passage of the Voting Rights Act in 1965. Civil rights groups like the North Carolina NAACP and ACLU asked the courts for an injunction against three major parts of the law before the midterms—a reduction in early voting by a week, the elimination of same-day registration during the early voting period and a prohibition on counting ballots accidentally cast in the wrong precinct. In early August, District Court Judge Thomas Schroeder denied the injunction, saying the plaintiffs had not proven “irreparable harm.” Two of three judges on the Fourth Circuit Court of Appeals overruled parts of Schroeder’s ruling today, reinstating same-day registration and the counting of out-of-precinct ballots for 2014. In not-so-good news for voting rights, the appeals court also upheld: “(i) the reduction of early-voting days; (ii) the expansion of allowable voter challengers; (iii) the elimination of the discretion of county boards of elections to keep the polls open an additional hour on Election Day in ‘extraordinary circumstances’; (iv) the elimination of pre-registration of sixteen- and seventeen-year-olds who will not be eighteen years old by the next general election; and (v) the soft roll-out of voter identification requirements to go into effect in 2016.”

he fights in our states over how hard or easy it is to vote have been filling the courts and are headed toward the Supreme Court. The cases range from voter ID laws to early voting rules and beyond. Already there is a case from Ohio, with ones from Wisconsin, North Carolina, and Texas potentially on the way in a matter of days or weeks. The stakes are high, not only for the lazy 2014 midterm elections but also for the 2016 presidential election and for the protection of voting rights in the next decade. The fact that the cases are making it to the Supreme Court at about the same time is no surprise. Over the past decade, in the period I have called “the voting wars,” we have seen both an increase in restrictive voting rights legislation passed by Republican legislatures, such as voter ID laws, and litigation from both Democrats and Republicans to manipulate the election system to their advantage. In 2008, the Supreme Court rejected a constitutional challenge to Indiana’s voter identification law, and in 2013, the Supreme Court in the Shelby County case struck down a key portion of the Voting Rights Act providing that states with a history of racial discrimination in voting get approval before making changes to their voting rules and procedures.

On Monday afternoon the Supreme Court justices decided 5-4, on party (of-the-president-who nominated-them) lines, to block extended voting hours and days in Ohio, 16 hours before voting was to begin there. The decision affects everyone in the state but will disproportionately harm poorer and minority voters, who rely on weekend and evening hours to avoid forbiddingly long lines on Election Day. The court’s order is technically temporary, but in practice it means that the longer voting hours won’t be in effect in 2014. There are reasonable arguments to be made about why these particular restrictions are not the most burdensome in the country, since Ohio already has four weeks of early voting. Still, the plaintiffs made the argument — accepted by a federal trial court and a three-judge appeals panel — that the cuts violated both the Equal Protection Clause and the battered-but-still-standing Voting Rights Act.

When Eric Holder took over the Department of Justice, the Civil Rights Division, known as the crown jewel of the agency, was in shambles. Conservative political appointees in the Bush administration had forced out well-respected section chiefs. Longtime career lawyers left in droves, replaced by partisan hacks. Civil rights enforcement was virtually non-existent. Holder made restoring the credibility of the Civil Rights Division a leading cause. “In the last eight years, vital federal laws designed to protect rights in the workplace, the housing market, and the voting booth have languished,” he said at his confirmation hearing. “Improper political hiring has undermined this important mission. That must change. And I intend to make this a priority as attorney general.” Enforcing the Voting Rights Act became a key priority for Holder’s Justice Department. In 2012, it successfully challenged Texas’s voter ID law, South Carolina’s voter ID law, and Florida’s cutbacks to early voting under the VRA.

The Sixth Circuit Court of Appeals yesterday upheld the district court’s ruling in in NAACP v. Hustedwhich stopped new restrictions on early voting from taking effect. This decision is good news for Ohio voters. It faithfully applies existing law to the evidence admitted in the district court, maintaining the established period for same day registration and early voting. The federal courts have done their job by safeguarding voters against partisan manipulation of election rules. This comment explains why the ruling is correct and why Ohio’s call to stay the existing court order should be rejected, especially now that same day registration and early voting are just about to begin. NAACP v. Husted concerns a state law passed earlier this year eliminating Ohio’s limited window for same day registration and early voting, commonly referred to as “Golden Week.”* During this week (September 30-October 6 this year), voters can simultaneously register and cast their ballots in person. Tens of thousands of voters voted in this period the past two presidential elections, with thousands using the opportunity for same day registration and early voting. The evidence presented in the lower court showed that African American, low-income, and homeless voters were more likely to use this voting opportunity. The Sixth Circuit affirmed the district court’s preliminary injunction, based on its conclusion that the NAACP and other plaintiffs had shown likely violations of both the Constitution and the Voting Rights Act.

As a number of bloggers have reported,  (including, separately, Professors Rick Hasen and Derek Muller) a generous pro-voter convenience decision has just come out of the 6th Circuit Court of Appeals. The court found that by eliminating a five-day period where voters could do same-day-registration and early voting all in one go, the State of Ohio had unjustifiably curtailed the opportunity for poor and minority voters to cast ballots. The reason why some analysts of the decision (including legal scholars from the Left) aren’t enthusiastic about the decision is that they find their credulity strained by the argument that voting rights are badly injured when a 35-day early voting period is reduced to a 28-day early voting period. The decision in Ohio State Conference of the NAACP v. Husted, et al. (pdf helpfully provided by Rick Hasen’s election law blog) is receiving criticism because of a perception that the court is going crazy and ruling that even the most inconsequential, incidental or de minimus injuries to voters rights are unacceptable.

Some of the longest lines on Election Day occur at polling places in black and Hispanic neighborhoods. A new report says that’s not a coincidence. In the three states with the longest lines in 2012, precincts in minority neighborhoods were systematically deprived of the resources they needed to make voting operate smoothly — specifically, voting machines and poll workers, according to the report by the Brennan Center for Justice. The report’s data show the growing need for federal supervision of voting rights, though ensuring supervision is harder than ever since the Supreme Court removed the teeth from the Voting Rights Act of 1965 last year. The report looked at Maryland, South Carolina and Florida, where many voters waited for hours to cast a vote in the 2012 presidential election. In all three, minority precincts were more likely to have had long lines. In South Carolina, the 10 precincts with the longest waits had more than twice the percentage of black registered voters, on average, than the rest of the state.

State officials went to the Supreme Court tonight in an attempt to halt expanded early voting now scheduled to begin Tuesday. “This is another step in protecting state’s rights,” said Matt McCllelan, spokesman for Secretary of State Jon Husted. The filing by the office of Ohio Attorney General Mike DeWine comes on the heels of a request to the full 6th U.S. Circuit Court of Appeals earlier today to overturn yesterday’s unanimous ruling by a three-judge panel of the 6th circuit upholding increased early voting. State officials contend that the panel’s ruling is “irreconcilable” with U.S. Supreme Court rulings and thus should be reversed. The request for an emergency delay of the ruling went to Supreme Court Justice Elana Kagan, who has jurisdiction over cases from the 6th circuit. The state is making two appeals at once to give the high court more time to consider the case, today’s filing said. The Supreme Court should step in “because similar suits are percolating throughout the country with conflicting outcomes.”

Democrats and civil rights groups hope the fight to restore a key provision of the Voting Rights Act will boost turnout among minority voters this year, particularly in the South. “We’re going to do some things to raise the profile of the Voting Rights Act and the fact that the Supreme Court gutted it,” said Rep. Cedric Richmond, a Democrat from Louisiana. “You will see us be more active. We tried to do it in a very bipartisan manner … But it just doesn’t seem like that’s going to go far enough soon enough, so it’s going to be a fight.” Richmond is among those working to pass legislation that would revive a section of the 1965 Voting Rights Act that the Supreme Court threw out last year. The bill’s supporters are making their case at press conferences, town halls and in newspapers — online and in print — to mobilize voters. The issue will be the focus of several panels at the Congressional Black Caucus’ annual legislative convention in Washington this week.

Lawyers for the U.S Department of Justice and minority groups once again made the case that Texas’ controversial Voter ID law improperly discriminates against Latino and African American voters during closing arguments in federal court Monday. Attorneys for the Texas attorney general will present closing arguments later Monday. The closing arguments are scheduled to last three hours and are expected to end later Monday. The state has argued the law is constitutional, popular and essential to combat voter fraud. However, cases of in-person voter fraud, which a law like this would help prevent, are rare. Plaintiffs’ attorneys have argued that the voter fraud concerns are simply a rouse to impose new requirements that make it harder for minority voters to cast their ballots. The Voter ID law is a “serious problem in search of a solution,” said Richard Dellheim, an attorney with the Justice Department. “That problem is that it violates the Voting Rights Act.”

Groups challenging Wisconsin’s voter ID law in filings asked a full appeals court to reverse a decision by three federal judges that allows the law to go into effect this fall. The submissions Tuesday and Wednesday by lawyers for the Advancement Project and the American Civil Liberties Union said Friday’s decision by a panel of judges from the U.S. 7th Circuit Court of Appeals was a “radical, last-minute change to procedures for conducting an election that is already underway.” “Supreme Court precedent and other circuits uniformly caution against such eleventh-hour changes to the election laws, even where those courts have approved such changes for future elections,” the attorneys wrote. In a terse order Wednesday, the court told Attorney General J.B. Van Hollen’s office to respond by Tuesday. Van Hollen declined to comment on the filings through his spokeswoman, Dana Brueck. The legal fight is coming to a head just seven weeks before the Nov. 4 election between Republican Gov. Scott Walker and Democrat Mary Burke. Walker signed the voter ID law in 2011; Burke opposes it.

It is difficult to understand the reasoning of the federal appeals court panel that permitted Wisconsin officials to enforce a controversial voter ID lawless than two months before Election Day. That’s partly because the panel’sfive-paragraph order, issued late Friday only hours after oral arguments, offered the barest rationale for lifting the stay that Judge Lynn Adelman of the federal district court had placed on the law in April. Judge Adelman issued a remarkably thorough 70-page opinion finding that the law violated both the Voting Rights Act and the Constitution by making voting harder for a substantial number of Wisconsinites — disproportionately those who are minority and poorer, and who tend to vote Democratic. (The law, passed in 2011 by a Republican-controlled Legislature but since tied up in lawsuits, requires prospective voters to present a government-issued photo ID, like a driver’s license or passport.)

Attorneys have responded to the State of Alaska’s proposed plan to address a state Supreme Court order to improve translation of voting materials in Native languages before November 4th Elections. In a 30-page document, Attorneys with the Native American Rights Fund, representing Yup’ik and Gwich’in Alaska Native voters, asked for five main changes before election day.
