Members of the Legislature’s Veterans and Legal Affairs Committee voted to direct the Secretary of State to conduct a thorough study of Maine’s election system, a move that ends a controversial carryover bill that sought to require voter identification. Two weeks ago, Secretary Charlie Summers sent an annual report to the Veterans and Legal Affairs Committee on the state’s Central Voter Registration system in which he called his yearlong review of voter registration data “troubling.” Summers said although most of the problems were related to human errors by municipal officials rather than intentional fraud, those errors contributed to inaccurate and unreliable state voter data.

But Republicans on Wednesday endorsed a possible end run around that — one that Democrats, the ACLU and some good-government groups protested as illegal and likely to lower voter turnout. The House Political Subdivisions Committee endorsed HB253 on a 6-4 vote, mostly along party lines, and sent it to the full House. It would allow removing voters from rolls if they miss four consecutive general elections and fail to respond to a notice mailed to them after the second missed election.

The Texas Secretary of State is fighting to uphold Texas’s new voter photo identification law against federal scrutiny. The press has reported extensively on the battle brewing between the states and the United States Department of Justice over the impact that voter ID laws will have on voter turnout. Many groups believe that voter ID laws—which require persons to show photo ID before casting their votes—unfairly target minority voters, making it more difficult for them to participate in the democratic process. While the photo ID requirement is the most widely reported change to the Texas election process, it is not the only new roadblock likely to affect voter turnout in the Lone Star State’s upcoming elections.

With a large chunk of Mexico’s democracy at stake, Congress asked the Federal Electoral Institute (IFE) on Wednesday to make a one-off exception allowing seven million voters whose credentials have expired to cast their ballots in the July 1 elections. The IFE responded on Thursday saying it does not have the authority to make such a decision, and must comply with the Federal Code for Electoral Procedures and Institutions (COFIPE) that was approved by Congress.

Voter registration for Mexican nationals abroad ends Sunday, Jan. 15. There are 11.7 million foreign-born Mexicans living in the United States, according to the Census Bureau’s American Community Survey, 92.3 percent of whom are of voting age.

In these difficult economic times, unemployment in the United States continues to hover around 9%. There is one place that has seemingly avoided the recession completely. In fact, this state is booming with jobs. The state is North Dakota. With new technology being developed in the oil and gas industry, oil reserves in the Bakken Formation once too difficult or expensive to tap are now being drilled at a furious rate.

The unemployment rate in North Dakota is now around 3.5% as the state tries to keep pace with growth. Although North Dakota’s population grew only a modest 4.7% from 2000-2010 (compared with a nationwide average of 9.7%), the oil boom is a recent phenomenon, and the true population effects are still unknown.  In Williston, North Dakota, a town at the heart of the oil boom, the population grew 17.6% (to 14,716) during the same time period. Since the census, the population of Williston is now estimated to be around 20,000, a 60% increase since 2000. This population growth could have a major impact in the upcoming election in 2012.

Michigan Secretary of State Ruth Johnson said she hopes to complete her proposed streamlining of the state’s election system this spring, in time for this year’s primary and general elections. Johnson said the 12 bills in her “Secure and Fair Elections,” or SAFE Initiative will clean up obsolete voter lists, allow more voters to use absentee ballots, tighten up registration procedures and close loopholes in the state’s photo ID requirement for voters.

As the state’s chief elections official, Johnson also is hoping to win passage of new campaign finance laws that require advance registration to prevent political “stealth efforts” such as the fake “Tea Party” created in 2010.
She also is calling for improved training procedures for voter registration groups and tighter post-election audit procedures. Six of the bills have already been reported out of state Senate committees while another six will be heard in state House committees in coming weeks, Johnson said during a visit to Grand Rapids Thursday.

Virginia: McDonnell, Bolling say no to GOP loyalty oath | Fredricksburg.com

Both Gov. Bob McDonnell and Lt. Gov. Bill Bolling are urging the Republican Party of Virginia to rethink its plans to require voters in the party’s March presidential primary to sign a loyalty oath.

The party wanted the loyalty oath — in which primary voters would promise to support the Republican nominee for president in the November election — to help weed out Democratic voters. Virginia has open primaries, which means voters of any party can vote in any primary. But the idea of a loyalty oath has been getting resistance from Republicans, and now McDonnell and Bolling both say they think it’s a bad idea.

“While I fully understand the reasoning that led to the establishment of this requirement, such an oath is unenforceable and I do not believe it is in the best interests of our Party, or the Commonwealth,” McDonnell said in a written statement this morning. “The effect of the oath could be one of diminishing participation in the primary, at a time when our Party must be expanding its base and membership as we head into the pivotal 2012 general elections this fall.”

On the Sunday before the 2008 presidential election, church goers in Florida streamed from the pews to early voting places to cast their ballots. The so-called Souls to the Polls campaigns were a windfall for then-presidential candidate Barack Obama and the Democrats. According to the National Association for the Advancement of Colored People, more than 32 percent of those who voted early on that last Sunday before Election Day were African American, and nearly 24 percent were Latino. Moreover, according to a report released by the Florida State Senate, 52 percent of people who voted early in the 2008 election were registered Democrats.

“Preachers would preach a great sermon and then march to the polls with their congregations,” said Hilary Shelton, senior vice president for advocacy and policy at the NAACP.

But voting laws passed in Florida last year have limited early voting, including on the Sunday before Election Day. Opponents say the early voting limitations are part of a broader effort by Republican-led legislatures across the country to suppress the black, minority and elderly voting blocs, groups expected to be key to President Obama’s bid for reelection in 2012. The efforts include new voting laws passed in more than a dozen states, some requiring government-issued identification to vote and others limiting third-party voter registration drives.

South Carolina: Counties Tally Up Cost of Republican Primary | WSPA

Upstate counties are getting a clearer idea of how much South Carolina’s Republican Presidential Primary will cost their taxpayers. Spartanburg County Voter Registration Director Henry Laye says his estimate now is that the Republican Presidential Primary will cost the county about $55,000 (significantly lower than his original projection of $106,000).

He still believes the state should reimburse the county for overtime for poll workers (since the election will be held on a Saturday), cost of fuel involved in dropping off and picking up voting machines at the precincts (about $1200), and maintenance and testing of voting machines. Laye says he had budgeted for these expenses. Oconee County’s Voter Registration Office did not, according to the chairman of that county’s Board of Elections. Hence the office’s request to Oconee County Council for $10,000.

“We thought either the state or the Republican Party would cover the whole cost of this election,” said Robert Brock, chair of Oconee County’s Board of Elections. County council will vote on the expense at a meeting later this month. The statewide cost of ballots, poll workers, data processing and other expenses related to the Jan. 21 primary is expected to total about $1.5 million, according to state election commission spokesman Chris Whitmire.

The clock is ticking as the registration deadline fast approaches for Mexican expatriates to vote in their country of origin’s presidential election this year. Although Mexican election officials are confident a late rush of applications will mean greater absentee participation than in the 2006 election, preliminary reports of the number of applications received indicate few expatriates will vote in the 2012 race.

According to Mexico’s Federal Electoral Institute (IFE), 14, 776 voter registration applications had been received as of December 20. That’s out of a potential voter pool of an estimated four million migrants. Opened in October, the registration window for Mexicans living abroad closes on January 15-more than four months before the July election.

College campuses across the nation are teeming with students ready to exercise their right to vote, one of the few perks that comes with turning 18. Yet, instead of encouraging students to take part in this rite of passage, some states are imposing voter ID requirements that make it much harder for them to vote. The fact that some Republicans see these new voter restrictions as a good thing shows their complete disregard for the democratic process. Moreover, it is demonstrative of their reasonable fear of losing the upcoming presidential election.

At first glance, the laws do no seem that restrictive. The new laws are requiring voters to present government-issued IDs, such as a passport or drivers license. However, when considering that a significant portion of students only carry a form of student ID, it becomes an issue. Additionally, other laws being endorsed by Republican lawmakers regarding voter ID can be interpreted as prohibiting out-of-state drivers’ licenses; thus, excluding more students from being able to vote.

When the U.S. Justice Department last week blocked South Carolina’s new voter ID law because of possible discrimination against minorities, attention quickly focused on Texas, which passed similar legislation this year.

Tentatively set to go into effect Sunday, the Texas law requires that a valid photo ID be presented at the polls along with a voter registration card. The accepted forms of identification are: Texas driver’s license, Texas election ID (issued by the Department of Public Safety), a personal identification card from the DPS, a Texas concealed handgun license, U.S. military ID card, U.S. citizenship certificate or U.S. passport.

In rejecting South Carolina’s law, the Justice Department used the state’s own data to show that tens of thousands of residents did not possess the required photo IDs, and that nonwhite voters would be most burdened under the statute.

The Election Commission of Pakistan was given the task to remove the 37 million bogus voters from the list (Dec 16) and replace them with new ones eligible to vote. The Supreme Court observed that the preparing of voter list can be delegated to National Database and Registration Authority (NADRA) if the Election Commission is not able to complete the task.

Nadra has the record of all eligible voters and is also responsible for issuing the National Identity Card. It is better equipped to prepare the voter list. The Election Commission’s prime responsibility should be to ensure transparent, free and fair election, it should consider making voting compulsory and improving the system of vote casting at polling stations.

Pennsylvania: Pennsylvania Voter ID Bill: The Embodiment of Discrimination or Weapon Against Voter Fraud? | State of Elections

Imagine that after months of living off of your meager savings, you can longer pay your rent and are subsequently evicted from your home. You, like an estimated 15,096 Pennsylvanians, have no permanent home. Regrettably, your homelessness could hinder your ability to vote.

Rep. Daryl Metcalfe (R – Butler County) introduced House Bill 934 on March 4, 2011. It passed the Pennsylvania House of Representatives by a 108-88 vote and is currently before the Senate.  As it stands, the current election laws require voters to show identification the first time they vote at a new polling location. If approved, the bill will require voters to show valid photo identification every time they vote, even though they may have voted at that particular polling location in the past.

The primary justification for this “common-sense safeguard” is to prevent voter fraud. In an interview with Comcast Newsmakers, Rep. Metcalfe stated that voter fraud is still a relevant concern as demonstrated by the 2009 investigation of ACORN employees in Pittsburgh for fraud. He also discussed how thousands of fraudulent voter registrations were filed in Philadelphia in 2005 and how 1500 of those registrations were turned over to the District Attorney for further investigation.

California: Debra Bowen and The Lessons of Technology | NBC Bay Area

Quietly, a political storm is growing over technology, access and the state of California. California Secretary of State Debra Bowen is in the middle of it. She is facing serious criticism over how she manages technology. The state’s Cal-ACCESS system — which provides the public with vital data on campaign contributions and lobbyist activist — went down three weeks ago. A database that verifies voter registrations also went down.

These problems come on top of earlier criticism that Bowen’s office was not moving fast enough to enable on-line voter registration. (And then there are a few people like your blogger who have argued that she should be more open to electronic signature gathering for ballot initiatives and referenda). Some criticism is warranted, but much of it is unfair — and misses the crucial context.

One of Bowen’s greatest public services has been her smart skepticism about technology in voting. The secretary of state may well have saved the state from serious election problems by challenging the technology and security of electronic voting machines.

The venerable Florida League of Women Voters has decided to make a federal case out of a restrictive, punitive and politically motivated voting law approved this year by the state Legislature. Good for the league, and its co-plaintiffs.

The league is one of three groups that filed a lawsuit last week in a Tallahassee federal court, challenging the law. The suit asserts that the state law violates the plaintiffs’ rights to free speech and conflicts with the National Voter Registration Act.

Joining the league were Rock the Vote — a national organization that engages young Americans in voting — and the Florida Public Interest Group Education Fund. This lawsuit is one of two federal cases involving the Florida voting law.

Malaysia: Malaysian Political Parties Asked To Scrutinise Electoral Roll To Clear Doubts | Bernama

The Election Commission (EC) has called on political parties to assist in scrutinising the electoral roll to clear doubts on the voters’ list for the coming 13th general election. EC deputy chairman Datuk Wan Ahmad Wan Omar said it was regrettable that certain groups, especially the opposition parties, have often alleged that the electoral roll contains phantom voters.

“Allegations linking the electoral roll with phantom voters are stale issues, as we have taken many measures to ensure the electoral roll is clean,” he told Bernama here. Wan Ahmad said the opposition, who frequently raise the issue of phantom voters, should come out with proof and not make wild allegations. “Who are the phantom voters? Why not expose them, as EC would like to catch them and bring them to court as well,” he said.

Florida’s new election law attracted more legal attention Thursday with a lawsuit from a trio of civic groups that contend the new rules are too burdensome on their voter registration efforts. The groups — League of Women Voters of Florida, Rock the Vote and Florida Public Interest Research Group Education Fund — are plaintiffs in a lawsuit that asks a federal court in Tallahassee to block the registration restrictions in the elections overhaul, which is in effect in 62 of 67 counties.

Attorneys argue the law is unconstitutional and violates the “motor voter” law by imposing burdensome regulations on volunteers and steep penalties for mistakes, such as not turning in voter registration applications within 48 hours. The window used to be 10 days.

Jacquelyn F. Callanen was neither a plaintiff nor a defendant in the redistricting case that the Supreme Court decided to hear last week. But her life — and her office — went from calm to chaos because of it. Ms. Callanen is the elections administrator for Bexar County in south-central Texas, home to San Antonio and 1.7 million residents. The Supreme Court’s decision temporarily blocked a set of district maps that Ms. Callanen and other officials around the state were going to use in next year’s elections.

Less than 90 days before the scheduled March 6 primary, Ms. Callanen has no electoral map in place for Congressional and State House and Senate districts in Bexar County, and none are in effect in any other county either. Much of the political geography of the country’s second-biggest state, in other words, has essentially vanished.

National: New GOP Data Shows No Need For Voter ID | OpEdNews

The Republican National Lawyers Association (RNLA) in an attempt to discredit a NAACP report this week on the lack of voter fraud evidence has bolstered the view that there is no need for voter ID laws, imposed by many states. The RNLA produced data showing 46 states and various convictions for voter fraud. Presumably by their absence, 4 states and the District of Columbia had no convictions.

Viewing the data for the period 2000-2010, the report by its own account shows there is no link between voter fraud in states and the need for stricter voter ID laws.   The data shows that during the entire 10 year period, 21 states had only 1 or 2 convictions for some form of voter irregularity.   And some of these 21 states have the strictest form of voter ID laws based on a finding of 2 or less convictions in ten years.   Five states had a total of three convictions over a ten year period. Rhode Island had 4 convictions for the same 10 years. Taking a close look at the RNLA data shows 30 states, including the District of Columbia had 3 or less voter fraud convictions for a 10 year period.

The Electoral Commission (EC) is to acquire biometric voter equipment by February next year to start biometric voter registration in the first quarter of the year, says Christian Owusu Parry, the EC’s Head of Public Affairs.

He said here on Wednesday that a committee was currently working on the technical aspects of the acquisition process, and added that the EC had agreed to introduce biometric registration since it would help check against double registration and eliminate names of fake voters in the Voters’ Register.

Michigan: Legislation Could Restrict Voter Registration, Absentee Voters | HuffingtonPost

Prospective Michigan voters might have trouble getting their ballots after the state Senate votes on two bills that would change the procedures for voter registration, absentee ballots and required identification. One of the changes proposed by S.B. 754 is a requirement that anyone holding a voter registration drive would have to register with the Michigan Secretary of State and complete a training. It would also require that registration forms be turned in further in advance.

Several groups, including the League of Women Voters, have spoken out in opposition to the bills and what they say are the exclusionary restrictions they would put on voting and registration.

“Requiring state certification and training of third party agencies will make it more difficult for League members to register people to vote,” the League of Women Voters of Michigan wrote, according to the Kalamazoo Gazette. “The requirements placed on groups that register people to vote are excessive and will reduce registration opportunities for citizens, as some groups will not be able to meet the requirements.” S.B. 751 would require photo identification for in-person and absentee voting.

Chief Judge of the Federal High Court, Justice Ibrahim Auta, yesterday cautioned counsel to the Independent National Electoral Commission (INEC) AB Mahmud (SAN) against delay tactics in the trial of a suit filed against the commission by Beddings Holdings Limited. Beddings Holdings accused INEC of infringing its patent right by contracting three companies to produce voters register for the 2011 general elections without first seeking and obtaining a written licence, consent and authority from it.

It claimed that it was the only company with the patent right to produce Electronic Collapsible Transparent Ballot Boxes, ECTBB, as well as the patentee in respect of Proof of Address System/Scheme, PASS, used for collation and collection of data.

Florida: Early Voting Period is Reduced from 96 to 48 Hours under HB1355 | electionsmith

According to a story in USA Today, Chris Cate, the director of communications for the Florida Department of State, continues to misinform the public about the total hours of early in-person (EIP) voting hours that are required under HB1355.  He claims that although the number of days has been shortened, the number of EIP voting hours  remains the same, and says that there is no systematic attempt to suppress any group of voters.

Yet, as Politifact has documented, that claim regarding the total number of EIP voting hours under HB1355 is “Mostly False.” In fact, the total number of early in-person voting hours that county Supervisors of Elections must remain open under HB1355 has been cut in half.

In addition to putting restrictions on voter registration drives, the casting of provisional ballots, and several other voting and elections issues, HB1355 shortened the window of EIP voting from 15 to eight days. Under the new law, county Supervisors of Elections have the discretion to offer between six and 12 hours of early voting each day—amounting to a minimum of 48 hours and a maximum of 96 hours.
