The Virginia Department of Elections has erroneously mailed notifications to about 125,000 registered Virginia voters raising uncertainty regarding their voting status. The letter, dated June 23 and signed by Secretary of the State Board of Elections Don Palmer, informs the recipients that records show they may also be registered to vote in another state and that state law requires them to update or cancel their voter registration when they change residences. “If you no longer consider the Virginia voter registration address printed below to be your address of residence, please help us keep the commonwealth's voter registration rolls accurate by completing and returning the ‘request to cancel voter registration’ from at the bottom of this letter,” it says. In an email sent to Virginia registrars Tuesday, Matthew J. Davis, chief information officer with the Department of Elections, said that the letters mistakenly went to individuals who have not moved out of state. The Secretary of State’s Office said Friday the decision by Strafford County Superior Court Judge Brian Tucker means there will be no change in the current voter registration forms. Deputy Secretary of State David Scanlan said the disputed language change for voter registration forms — passed by the Legislature in 2012 and challenged in court by four University of New Hampshire students and the League of Women Voters as unconstitutional — was never implemented. A preliminary injunction was granted by a different Strafford County judge, and the state Supreme Court let the ruling stand in October 2012. …  Then-House Speaker Bill O’Brien had supported changing the registration law primarily to prevent students from outside New Hampshire but attend college in the state from being allowed to vote in New Hampshire college towns.

Mississippi: State Supreme Court denies Chris McDaniel request to revisit ruling on poll books access | Associated Press

The Mississippi Supreme Court said Thursday that it won't reconsider its ruling that voters' birthdates must be redacted before poll books are opened for public inspection. State Sen. Chris McDaniel had asked the nine justices to hold a hearing and reconsider the ruling they issued last week. On Thursday, the court said no. Two justices did not participate in the ruling and three said they would have granted a hearing. McDaniel wants to see full information in poll books, including birthdates, as he prepares to challenge his 7,667-vote loss to U.S. Sen. Thad Cochran in the June 24 Republican primary runoff. McDaniel campaign spokesman Noel Fritsch said Wednesday that the campaign was still gathering evidence of potential wrongdoing to prepare to file an election challenge. During a July 16 news conference, McDaniel attorneys said a challenge could be filed within the following 10 days.

New Hampshire: Judge rules voter registration conditions illegal | Concord Monitor

A judge has struck down a 2012 law as unconstitutional that effectively blocked out-of-state students and others from voting in New Hampshire unless they established residency in the state that extended to other activities beyond voting, such as getting a driver’s license. The New Hampshire Civil Liberties Union filed a petition on behalf of four out-of-state college students and the New Hampshire League of Women Voters two years ago, arguing the law would freeze out eligible voters. The law required people registering to vote to sign a statement saying they declare New Hampshire their domicile and are subject to laws that apply to all residents, including requirements they register their cars in the state and get a New Hampshire driver’s license. Then-Gov. John Lynch vetoed the legislation, but lawmakers overrode his veto. In making a preliminary order permanent, Strafford County Superior Court Judge Brian Tucker said the law added language to voter registration forms that was a “confusing and unreasonable description of (existing) law” and was “unduly restrictive.”

U.S. Attorney General Eric Holder has signaled that the Justice Department will back pending Ohio litigation aimed at providing more early voting days for Ohioans and restoring Ohio's voting "golden week." Holder and his department are more than justified in doing so. At stake is one of the most precious of constitutional rights, the right to vote. That is a fundamental right Americans have died for, as, for example, three patriots – two white, one black – did 50 years ago in Neshoba County, Mississippi. In February, Ohio General Assembly Republicans passed, and Gov. John Kasich signed, Senate Bill 238. The bill, passed along party lines (Republicans for, Democrats against), abolished Ohio's so-called golden week. This was the week right before Ohio's voter registration deadline when an Ohioan simultaneously could register to vote, apply for and then cast an in-person, early-voting ballot at his or her county board of elections.

The General Assembly’s decision to do away with voter pre-registration in 2013 has created confusion in state driver’s license offices, where 50,000 teenagers a year had been signed up in a program that automatically added their names to voter rolls when they turned 18. Since September, when part of the sweeping elections overhaul bill took effect, state Division of Motor Vehicles officials have had difficulty figuring out at what age newly licensed drivers should be allowed to register to vote. This issue is one of many expected to be raised next week in federal court by lawyers representing the U.S. Justice Department, the NAACP and others challenging the 2013 elections overhaul bill. The parties are scheduled to appear before U.S. District Judge Thomas D. Schroeder on Monday in a Winston-Salem federal courtroom.

The state NAACP and other civil rights groups want a federal judge to block what they call the worst voter suppression bill since the days of Jim Crow. “The reality is that this monster voter suppression law was passed a few weeks after Shelby,” said the Rev. William Barber, the president of the state NAACP, in a conference call Tuesday. Barber was referring to a U.S. Supreme Court ruling that struck down Section 5 of the Voting Rights Act that required states and other communities to seek federal approval for changes in voting laws. Forty counties in North Carolina had been under the Section 5 requirement. The law, officially known as the Voter Information Verification Act, includes a number of provisions. The most well-known is a requirement that voters present a photo ID, beginning in 2016, but it also reduces the number of days for early voting from 17 to 10, eliminates same-day voter registration during early voting and prohibits county elections officials from counting ballots cast by voters in the right county but wrong precinct.

Oops. It turns out that the newfangled voter registration and identification system so lauded and pursued by Kansas Secretary of State Kris Kobach might not work as smoothly as we’ve all been told. It also turns out that one of those Kansans whose voter registration landed on the state’s “suspended” list is none other than the daughter of Kobach primary challenger Scott Morgan. Morgan’s 18-year-old daughter registered to vote online, submitting a digital copy of her U.S. passport as validation of her citizenship status. Nevertheless, the younger Morgan received a letter from the Douglas County Clerk’s Office explaining that her voter registration lacked the needed identification. Although the issue was quickly resolved, candidate Morgan raised a valid point about the potential for the voter registration requirements to interfere with the right to vote. “How it happened to my daughter and then was miraculously resolved ... it just makes me wonder how many people out there whose father isn’t running for secretary of state against the incumbent are left in never-never land,” he said this week.

Mourakiboun is also concerned about the low turnout for voter registration so far. The report from June 24 complained of a “lack of signage and instructions at some registration centers,” as well as “weak turnout” and “frequent problems with connectivity in many centers.” “There is an absence of facilities at registration centers for the needs of the elderly,” reads the June 25 report, which, like reports from both the previous days, also stated that many centers were still opening late.

With the Aug. 5 primary approaching, the voting rights of more than 18,000 Kansans are snagged on the law requiring proof of citizenship to register as of 2013. Yet Secretary of State Kris Kobach acts as if all is well. As for the governor, attorney general and legislative leaders – cue the crickets. Kobach even described the voters in limbo – 18.5 percent of the total attempted registrations since Jan. 1, 2013 – as “actually a pretty small percentage of the people who have registered since Jan. 1 (2013).” Recall that Kobach persuaded the Legislature of the need to pass a law in 2011 requiring photo ID to vote and proof of citizenship to register though there had been just seven convictions for voter fraud between 1997 and 2009. And although he claimed as a candidate in 2010 that “in Kansas the illegal registration of alien voters has become pervasive,” he recently referred to 20 cases of illegal immigrants registering to vote between 2006 and 2009 in Kansas having been presented in federal court.

What is the impact of major court rulings on voter ID laws? How are states ensuring voter registration lists are accurate? Which new voting system designs are being developed for the marketplace? Finding these answers and other information about elections policy can quickly eat up the kind of time that a lawmaker, legislative staffer or elections administrator can hardly afford to spend. But that was life before the Elections Administration Research Database, a new tool launched today by the National Conference of State Legislatures. The database brings together more than 1,900 reports that, altogether, address a wide range of elections topics. It is supported by generous funding from The Pew Charitable Trusts.

Kansas would end strict enforcement of a proof-of-citizenship requirement for new voters under proposals outlined Tuesday by the presumed Democratic nominee for secretary of state. Democrat and former state Sen. Jean Schodorf outlined a plan for fixing what she called problems with the state's voter registration system. But conservative Republican incumbent Kris Kobach said Schodorf is promising to ignore the proof-of-citizenship requirement if elected secretary of state, making the office "lawless." Schodorf would allow prospective voters to cast ballots even if their registrations are on hold because they've not yet documented their citizenship for election officials. She also proposed that Kansas stop requiring proof of citizenship from new residents who've had valid voter registrations in other states and allow anyone using a national voter registration form to vote in all state and local elections — though the form doesn't instruct voters to provide citizenship documents.

The youngest daughter of Kansas Secretary of State Kris Kobach's challenger in the Republican primary had her voter registration put on hold temporarily because of a proof-of-citizenship requirement criticized by her father. GOP challenger Scott Morgan said Monday the Douglas County clerk's office told his 18-year-old daughter, Grace, that her registration was incomplete last week because she hadn't documented her U.S. citizenship. Morgan is a Lawrence attorney and businessman, and Grace Morgan is a University of Kansas student. Scott Morgan said his daughter registered online last week and submitted an electronic image of her passport, only to receive the letter days later asking for documentation of her citizenship. His campaign's Facebook page Sunday posted a picture of his daughter holding the letter, and he tweeted about it.

The elections would consolidate the gains of an accord in January to end months of political crisis, which had blocked the democratic transition in the birthplace of the Arab Spring. Prime Minister Mehdi Jomaa and Chafik Sarsar, who heads the electoral organising commission, gave the order to begin the registration process at Tunis city hall, the government said. After months of negotiations, the electoral commission this month proposed that legislative polls take place on October 26 and the first round of the presidential poll on November 23, with the run-off on December 28. The provisional election dates are to be submitted to parliament on Wednesday for approval.

With Aug. 5 primary elections less than two months away, more than 18,000 potential voters find themselves with an incomplete registration status because their applications have not met the state’s proof of citizenship law. The issue is at the center of the race for secretary of state – the state’s top election officer. Scott Morgan, a Republican challenger, and Jean Schodorf, the Democratic candidate, both accuse incumbent Kris Kobach of disenfranchising voters. Kobach argues that the controversy has been overblown and says voters can fix their incomplete status. He also argues that the law helps prevent election fraud. The secretary of state’s office tracks the totals at the start of every month. As of June 1 there were 18,071 incomplete voter registrations, according to spokeswoman V. Kay Curtis.

Texas: State Republicans call for repealing the Voting Rights Act | MSNBC

When the Supreme Court weakened the Voting Rights Act last year, it allowed Texas to implement what is perhaps the nation’s strictest photo ID law. But according to the state’s Republicans, the federal government still has too much influence on how it runs elections. The Texas GOP platform, released Thursday, calls for the repeal of the Voting Rights Act (VRA) of 1965, the most successful civil-rights law in the nation’s history. It also supports scrapping the National Voter Registration Act of 1993, which has helped millions register to vote. And it advocates making voters re-register every four years, among other restrictive policies. In sum, the party wants to get the federal government out of the business of overseeing state elections—returning voting law to where it was before the civil rights movement. “We urge that the Voter [sic] Rights Act of 1965, codified and updated in 1973, be repealed and not reauthorized,” the platform says.

To him, there was no evidence that the register was bloated or not credible. Looking cursorily at Ghana’s 2012 voters’ list, having 56.2% of the population certified as eligible voters, may appear pretty normal. But, the picture becomes evidently disturbing upon closer scrutiny of the statistics and when compared to figures across the globe. What comes out is that Ghana has one of the most abnormal, if not the worst, electoral roll in the entire world. It is certainly the worst in democratic Africa.

House Democratic Leader Nancy Pelosi and other top lawmakers have urged a federal appeals court to overturn a decision by a judge in Kansas that they say would limit the authority of Congress to regulate federal elections and derail its ability to pass legislation protecting the right to vote. Their friend-of-the-court filing last week at the 10th U.S. Circuit Court of Appeals comes in the lawsuit filed by Kansas and Arizona to force federal elections officials to help those states impose their proof-of-citizenship requirements on federal voter registration forms used by residents of the states. Both states argue the requirements prevent voter fraud by thwarting voting by noncitizens. Critics of such laws view them as suppressing voter turnout. But both sides agree the potential impacts of the case could extend to other states.

The TotalVote comprehensive voter database got its first statewide test in the primary election June 3. Whether it succeeded depends on whom you talk to. While reported problems seem roughly proportional to the size of the counties using it, Minnehaha County Commissioners heard enough tales of voters being directed to the wrong precincts in the low-turnout primary to spark concern about how TotalVote will perform in the November general election, when turnout is expected to be much higher. Getting the election right is a sobering responsibility for public officials. The effect, for them, of heading toward the general election with potentially unresolved TotalVote issues might be summer dreams haunted by apocalyptic visions along the lines of Supreme Court justices peering owlishly at hanging chads and banana republic dictators winning elections by margins greater than 100 percent.

Colorado: Lone prosecutor in Gessler anti-vote-fraud campaign drops first case | The Colorado Independent

The charge has been dropped in what’s believed to be the first voter fraud case set for trial since Secretary of State Scott Gessler urged district attorneys statewide to prosecute people who purportedly are cheating Colorado’s election system. Mike Michaelis was scheduled to be tried today for allegedly procuring false information on a voter registration form. Michaelis, 41 and now in construction, registered voters in 2012 on behalf of Work for Progress, a nonprofit that, as its website states, campaigns “for social justice, a fair economy, consumer protection, clean energy, and the environment.” On a voter registration form submitted to Michaelis by Aurora resident Lydie Kouadio, a box was marked saying she is a U.S. citizen. Gessler’s office determined she isn’t. Her name was among 155 voters the Secretary of State deemed to be suspicious. Last June, Gessler sent prosecutors lists of residents in their districts for possible prosecution. In Arapahoe County, District Attorney George Brauchler’s office investigated Kouadio along with the 40 other people in his district Gessler was targeting. Instead of prosecuting Kouadio, Brauchler’s office charged Michaelis based on Kouadio’s claims that Michaelis filled out the registration form for her.

Lucas County elections officials are blaming a technical glitch for switching the party registrations of as many as 167 voters, including Democratic Lucas County Prosecutor Julia Bates and Republican Toledo Municipal Judge Tim Kuhlman, to the Green Party. Sean Nestor, a sharp-eyed local political analyst and candidate of the Green Party, checked out a filing on the Ohio Secretary of State‘s Web site and spotted that a disproportionate number of people pulled ballots in the May 6 for the Green Party, which espouses progressive, pro-environmental policies. Mr. Nestor, who ran unsuccessfully as a Green candidate for Toledo City Council in 2013, noticed that most of the new converts were in South Toledo precincts 16G and 16H. Both of those precincts voted at Our Lady of Perpetual Help School. Of the 167 supposed Green voters, 125 voted Republican and 10 voted Democratic in the 2012 primary.

State and federal legislation and rules about voter registration and absentee balloting treat the U.S. Postal Service as an institution of undiminished vitality and efficiency; capable of delivering election-related mail swiftly and unerringly. Meanwhile, the actual (as opposed to utopian) Postal Service is a wounded, diminished entity. Hemorrhaging money, hounded by critics, and damaged by privatization, competition, and fundamental shifts in the ways that people communicate with each other, the Postal Service is fighting for survival. Niceties and services in support of elections have suffered as a consequence. For example, the Postal Service no longer accommodates the State’s use of a generic postage-paid statewide voter registration application. The reason? Because mail sorting is automated, and because the Postal Service has shrunk in size, the post office will no longer allow the State to benefit from a postage-paid card that has to be re-routed to one of 254 destination counties.

John Conyers said Thursday he doesn’t believe he fell victim to a conspiracy to bounce him from the ballot and end his storied political career. The Detroit Democrat was removed from the Aug. 5 primary ballot for not having enough valid petition signatures before a federal judge Friday restored him to the ballot over concerns Michigan’s election law may be unconstitutional. Conyers, 85, hired family friend and political consultant Steve Hood to handle the petition gathering. Hood has since publicly apologized for not checking the voter registration status of the circulators he hired — a mistake that initially disqualified hundreds of signatures and may have cost Conyers his congressional career. “I know the whole Hood family,” Conyers told The News Thursday. “I know his father, his brother. I know the church. It was very painful.”

We’re still more than five months from midterm elections, but already Republican voting restrictions are causing chaos in states across the South, and in some cases, blocking access to the ballot. The slew of problems, even in a recent series of low-profile elections, is raising fears that large numbers of voters could be disenfranchised this fall if the laws aren’t blocked before then. Because two of the states involved, Arkansas and North Carolina, are hosting tight Senate races this fall, it’s possible that the laws could even be decisive in helping Republicans gain total control of Congress. “The problems we’re seeing in places like Arkansas and North Carolina are only going to worsen in higher-turnout elections in November, when hundreds of thousands more voters will arrive at the polls,” said Dale Ho, director of the ACLU’s Voting Rights Project. “They demonstrate exactly why we’ve filed motions to put these laws on hold until they’ve been thoroughly vetted by the courts.”

After nearly five years of partisan feuds over state elections laws, there are growing signs that lawmakers are finding common ground on both sides of the aisle, in blue and red states alike. During legislative sessions this year, several states enacted changes designed to ease the voting process, such as online voter registration and same-day registration.  When Illinois finishes the rollout of its online system this summer as expected, more than 100 million eligible voters will live in states offering online registration — about half of the nation’s eligible voters, according to the United States Elections Project. The raft of new measures comes on the heels of a bipartisan presidential elections commission report released in January that encouraged states to “transcend partisan divisions and view election administration as public administration that must heed the expressed interests and expectations of voters.”

South Carolina: Elections oversight begins in fall, as reform passes | The State

Starting this fall, state elections officials will check vote totals in all 46 counties as part of the biggest election reform measure passed in a decade. Disagreements are brewing, meanwhile, among Richland County legislators about whether to retain two long-time election board members when the offices join once again as a result of the new measure. The bill – awaiting the governor’s signature after unanimous approval this week by the House and Senate – requires counties to merge election and voter registration functions. The measure averted possible chaos during upcoming elections in June and November: A lawsuit in Richland County foreshadowed problems with the patchwork of local laws that set up election boards statewide. The General Assembly had to agree on a uniform method to run county election offices.

New Mexico: Reports: Motor Vehicle Department has voting registration problems | New Mexico Telegram

Reports say the state is having problems with voter registration at Motor Vehicle Department offices around the state. The state is required, by federal law “to provide individuals with the opportunity to register to vote at the same time that they apply for a driver’s license or seek to renew a driver’s license, and requires the State to forward the completed application to the appropriate state of local election official.” Oriana Sandoval, the policy director of the Center for Civic Policy*, told KOAT that she was unable to register to vote at an MVD office recently when she went to renew her driver’s license. Sandoval told Action 7 News last week she tried to renew her voter registration at a downtown MVD. Rather than having it done simultaneously with the license renewal, she was handed a piece of paper with directions on how to sign up to vote online, on a home or work computer. “I would’ve used a kiosk at the MVD, but there wasn’t one available at the downtown office,” Sandoval said.

A federal judge threw U.S. Rep. John Conyers a political lifeline Friday, ordering the Detroit Democrat onto the Aug. 5 primary ballot because his lawsuit to overturn a Michigan election law is likely to succeed. Judge Matthew Leitman’s ruling allowing Conyers to join challenger Horace Sheffield on the primary ballot capped a whirlwind day for the longest-serving African-American in Congress, as he seeks a 26th term in office. A report released earlier Friday by Secretary of State Ruth Johnson agreed with Wayne County Clerk Cathy Garrett that Conyers was ineligible to run and found he fell more than 540 signatures short of the 1,000 needed to qualify for the ballot. But Leitman, in a 22-page ruling, said Conyers and two petition circulators whose signatures were disqualified have a “substantial likelihood of success” in showing Michigan’s requirement for circulators to be registered voters law is unconstitutional and ordered Conyers on the ballot “because time is of the essence.”

According to information from the Indiana Election Division that was published in The Star, less than 11 percent of the registered voters in the Indianapolis metro area voted in the primary this year. There was 13 percent turnout in Lake County, 12 percent in Allen County and 6 percent in Vanderburgh County. When we hear people bemoaning turnout like this, it is interesting to note that we are entering the season when political parties, campaigns and other groups begin voter registration drives in earnest, hoping they can increase turnout by their supporters. It is interesting because voter turnout is calculated by a simple mathematical equation. The number of voters is divided by the number of registered voters. If the number of registered voters is increased, then the number of people voting also has to increase or the turnout percent will decline. People who have been involved in campaigns long enough can remember the days before the National Voter Registration Act of 1993 when registering voters was not as easy as it is today. They also remember the days before the Help America Vote Act of 2002 when purging voter files was done more aggressively, sometimes to the disadvantage of certain groups.
