Super PACs are the perceived demons of the 2012 campaign, with the law allowing them to raise and spend unlimited amounts of dough. But a shadowy sideshow that’s gone largely unnoticed is the set of nonprofits affiliated with them, which often provide money to the cash cows—and they don’t have to publicly disclose their donors (as super PACs must). “The undisclosed money is far more troubling for the system,” says campaign finance lawyer Kenneth Gross. FreedomWorks for America is a case in point. The group, which has attacked GOP pols it finds insufficiently conservative, is located three blocks north of the Capitol. At the same address, sharing the same suite and even some staff, is the headquarters of the similarly named FreedomWorks Inc., a nonprofit (or 501[c][4] group). In 2011 the super PAC received almost half of its $2.7 million from the nonprofit, a legal transfer that skirts disclosure requirements. Whose cash is it? We aren’t allowed to know. Matt Kibbe, who oversees the activities of both groups, tells Newsweek that “to adhere to what the law stipulates” there is a “firewall” between the two. But even by the loose standards of money in politics these days, the arrangement seems rather cozy.

National: Americans Elect Is Raising Money To Repay Its Millionaire Founders | Buzzfield

A deep-pocketed group hoping to field a third candidate in November has quietly shifted its fundraising focus earlier this month to serve a curious goal, a spokeswoman has acknowledged to BuzzFeed: All money raised by Americans Elect will, for the for-seeable future, be given to the millionaires who created it.

The group made the shift public in a cryptic statement on its website on March 2:

The Board of Directors voted unanimously on 20 February 2012 to ensure that no supporter would cover more than 20% of the Americans Elect budget. In the event that any one supporter exceeds that percentage, there are provisions created to expedite repayments to that supporter.

Americans Elect, whose leaders have said they expect to spend $40 million this year getting on the ballot in 50 states and building a sophisticated platform for a secure online primary, casts the move as one in service of its populist goal of having no donor give more than $10,000. But its immediate effect may make it extremely difficult for the group, which is heavily bankrolled by its chairman, financier and philanthropist Peter Ackerman, to raise any more money at all, and particularly the kind of small, grassroots donations it seeks on its website.

Last week brought two rare pieces of good news for voting rights advocates. In Wisconsin, Dane County Circuit Judge David Flanagan granted a temporary injunction, requested by the League of Women Voters, preventing implementation of the state’s photo identification requirement for voting. Meanwhile, the Third Circuit of the U.S. Court of Appeals reaffirmed a 1982 consent decree preventing the Republican National Committee from intimidating minority voters.  Unfortunately, voter intimidation and disenfranchisement will still occur, in Wisconsin and throughout the country.

As many as 25 percent of Americans are expected to use paperless electronic voting machines in the upcoming November elections, according to the Verified Voting Foundation, but confidence has been eroded by incidents showing vulnerabilities. The foundation, which seeks more reliable election systems, contends that voting machines in 11 states are all-electronic, with no paper systems for recounts, and that many other jurisdictions have some of these systems in place. … Pamela Smith of the Verified Voting Foundation said these incidents highlight the fact “that you can have insider challenges as well as outsider hacks. It points out that you have to be able to check the system.”
Election security and technology has been an issue in the United States since the 2000 president election marred by “hanging chads” in Florida that muddled the result.

When GOP presidential hopeful Rick Santorum gave his victory speech in Missouri after the primary there on Feb. 7, he shared the stage with a white-haired gentleman who stood practically at his elbow the entire time.
Investment fund manager Foster Friess probably did not strike audience members as someone special as he smiled merrily behind the former Pennsylvania Senator. But Friess is at the center of a growing controversy over unregulated money and alleged campaign finance violations in the 2012 campaign. At issue is whether unrestricted super PACs are illegally working hand-in-hand with the candidates they support. Campaign finance watchdogs say the collusion is flagrant. Super PAC organizers argue just as loudly that they are meticulously following the rules.

National: Republicans lose appeal on poll-watching tactics | Thomson Reuters

The Republican National Committee on Thursday lost a bid to dissolve a decades-old legal agreement with the Democratic National Committee over the GOP’s use of improper election tactics. The agreement dates to 1982, when the Republican National Committee settled a lawsuit brought by the Democratic National Committee accusing the GOP of trying to intimidate minority voters. Under the agreement, the Republican National Committee must obtain court approval before implementing certain poll-monitoring activities in minority precincts. The Republican Party filed suit in November 2008 to void the agreement. But the Philadelphia-based U.S. Court of Appeals for the 3rd Circuit rejected the GOP’s request on Thursday, affirming a New Jersey district court’s ruling. “If the RNC does not hope to engage in conduct that would violate the Decree, it is puzzling that the RNC is pursuing vacatur so vigorously,” Judge Joseph Greenaway wrote on behalf of the three-judge panel. He noted that the party sought to escape the decree at a critical moment, in time for the upcoming election cycle.

A series of problems with electronic voting machines has raised fresh questions about election technology as newer computerized systems gain ground for the 2012 US election. As many as 25 percent of Americans are expected to use paperless electronic voting machines in the upcoming November elections, according to the Verified Voting Foundation, but confidence has been eroded by incidents showing vulnerabilities. The foundation, which seeks more reliable election systems, contends that voting machines in 11 states are all-electronic, with no paper systems for recounts, and that many other jurisdictions have some of these systems in place. Last year, Microsoft Research published a paper describing vulnerabilities to what had been described as “fully verifiable” direct recording electronic (DRE) systems in which a hacker can “undetectably alter large numbers of votes.” Separately, scientists at Argonne National Laboratory described a way to tamper with certain electronic voting machines by inserting a $10 component along with a $15 radio frequency device to alter vote results. Pamela Smith of the Verified Voting Foundation said these incidents highlight the fact “that you can have insider challenges as well as outsider hacks. It points out that you have to be able to check the system.”

Unlike four years ago when states jockeyed to be among the first to cast ballots in the hotly contested 2008 presidential primary season and 24 states and America Soma held their contests on February 5, this year only 10 states held contests on “Super Tuesday.” And with no contest on the Democrat side and less interest on the Republican side than there seemed to be four years, that made for a slow Super Tuesday for many elections officials with light turnout reported from Alaska to Vermont. That being said, just because the day was relatively quiet, some would say slow, doesn’t mean it was uneventful. The following is a brief recap of some of the events of Super Tuesday. In Franklin County, Ohio, some voters left their polling places without voting after confusion about ballots lead to delays. The confusion arose in polling places that handle multiple precincts. Due to the confusion about which ballots voters were supposed to receive, some voters could not wait because they had to get to work. Poll workers took down the contact information of the voters who had to leave and reached out to them after the ballot confusion was cleared up to encourage them to return to vote.

Despite the hype about super PACs this election, most aren’t very super at all: Nearly three in four report having less than $5,000 cash to their name or have yet to report assets, a review of their most recent disclosures indicates. And of the nearly 330 federal super PACs in existence today, about one-fourth have never raised or spent a dime, records show. More than two-dozen of these underwhelming organizations are the creations of one man — Josue Larose, an eccentric Floridian who’s confounded state and federal regulators while displaying no interest, or ability, to operate them for their intended purpose and frequently changes their names. Federal Election Commission officials wrote to Larose Wednesday informing him that they plan to administratively terminate 61 of the committees he’s created — both traditional political action committees and super PACs — because of inactivity.

National: Postal Service to suspend closures during election season | The Washington Post

The U.S. Postal Service plans to suspend its planned closure of processing facilities and post offices during the November election season in response to concerns from state officials that the delivery of absentee or mail-in ballots might be lost or delayed in the shuffle. Postal officials announced plans last month to proceed with closing or consolidating at least 223 processing centers in the coming years in hopes of saving billions of dollars. USPS also plans to close thousands of post offices in the coming years in mostly rural communities. But state officials in Arizona, California, Ohio and Oregon, among others, complained that the changes could confuse voters accustomed to mailing ballots close to mail-in deadlines or Election Day.

National: Super Tuesday brings super PAC spending milestone | iWatch News

Heading into Super Tuesday, spending by super PACs aligned with presidential candidates has surpassed spending by all super PACs in the 2010 mid-term election. To date, super PACs aligned with one of the 2012 White House hopefuls have spent more than $66 million, an iWatch News analysis of data filed with the Federal Election Commission has found. Notably, the pro-Mitt Romney super PAC “Restore Our Future” accounts for almost 50 percent of this spending. The super PAC has spent more than $32 million so far this election, nearly all of it on ads bashing his opponents. That’s nearly twice as much as the $16 million spent by pro-Newt Gingrich “Winning Our Future.” And it’s roughly six times as much as the $5.3 million spent by the pro-Rick Santorum “Red, White and Blue Fund.”

The agency plans this year to press existing nonprofits like American Crossroads, on the Republican side, and Priorities USA, on the Democratic side, to justify their tax-protected status as “social welfare” organizations, a status that many tax professionals believe is being badly abused. Senate Democrats are readying a fresh legislative push to demand that such groups disclose their donors and attach disclaimers to their political advertising identifying the advertisement’s primary funders. Jonathan Parker, the state party’s executive director, is excited about the chance to hold party-building exercises on such a broad scale. ” For the first time, maybe ever, Idaho is relevant in the nominating process,” he says. But as much as he relishes the attention — Mitt Romney held a rally in Idaho Falls last week — Parker worries that the state GOP could generate the wrong kind of publicity. That is, if the Idaho caucuses turn out to be as screwed up as those in several other states this year.

There’s no mystery about why a business or industry group might be shy about how it spends money on election campaigns. Just ask department store chain Target. In 2010, Target, which had been known for its progressive employment policies, faced a customer and shareholder backlash after it donated $150,000 to a pro-business PAC in Minnesota that was backing a gubernatorial candidate who opposed gay rights. Target eventually quelled the furor with a policy change prohibiting trade groups from using its contributions to intervene in elections, but it stopped short of disclosing all its political donations. Yet had it made its Minnesota donation through a nonprofit organization known as a 501(c)4, it might have avoided all that hassle. That’s because such organizations don’t have to disclose who their donors are.

This six-person panel has long been slow-moving and frequently divided, but this year its members have taken their reputation to new heights just as money emerges as the biggest legal issue of the season. The FEC routinely stalemates along party lines on the biggest questions it faces, such as whether members of Congress can appear in ads aired by a super PAC affiliated with Karl Rove or whether to write new rules requiring political advertisers to disclose more information — effectively leaving campaigns and super PACs to decide for themselves. When they do manage to reach bipartisan agreement, it’s on relatively small-bore questions.

One of the most salient criticisms of Americans Elect — a group that bills itself as seeking to “open up the political process” and “change politics as usual” — is its dogged refusal, using the legal shield of its status as a 501c4 corporation, to disclose the names of its financial backers. This matters, in part, because Americans Elect got off the ground with $20 million of seed money given by only 50-some anonymous donors. That’s 50 nameless investors ponying up an average of $400,000 apiece, although, in one rare case in which the name is known, Americans Elect founder and CEO Peter Ackerman has given at least $1.55 million and, according to Bloomberg — the news organization, not the draft Americans Elect presidential candidate — more than $5 million.

When Georgia’s Republican leaders redrew the state’s election-district maps last year, Democrats and minorities instantly cried foul. In an increasingly diverse state where 47 percent of voters chose Obama in 2008, the new maps looked likely to hand the GOP 10 of the state’s 14 seats in Congress. Perhaps even more significantly, they were drawn so as to give Republicans a shot at a two-thirds majority in both chambers of the state legislature, allowing them to pass constitutional amendments unilaterally. They achieved this in part by “packing” the state’s black voters (who overwhelmingly vote Democratic) into a handful of districts in order to make others more solidly white (and Republican).

Fortunately for the state’s Democrats, federal law seemed to offer a time-tested remedy. Section 5 of the Voting Rights Act, a landmark civil rights bill passed in 1965 to crack down on poll taxes and other discriminatory practices, requires Georgia and a number of other Southern states to get federal approval for any changes to their voting laws. Any that harmed minorities’ chances of fair representation were to be thrown out. And that’s exactly what Georgia Democrats expected Obama’s Department of Justice to do with Republicans’ new maps. Just two years earlier, it had invoked Section 5 to block two Georgia voter-verification laws. Liberals gleefully predicted the Republican gerrymanders would likewise be “DOA at the DOJ.”

… David Wagner, University of California, Berkeley: There was no way to guarantee your vote would be counted correctly, that if someone were to hack the central computer system, then someone could change votes, and there might be no way to detect that kind of election stealing. So, I don’t think any of the voting system vendors out there right now has a solution that ensures — that’s proof against hacking or that ensures that we can detect hacking.

National: Wireless voting still has a long way to go | Computerworld

With the widespread adoption of smartphones and the use of mobile tactics in U.S. presidential campaigns, could there come a day when Americans might vote wirelessly? That question was posed to a panel of mobile campaign experts at the Brookings Institution during a webcast Tuesday. The prevailing view was that wireless voting in the U.S. is a long way off. Considering that much voting in the U.S. is still done with paper ballots, electronic voting over a wireless device such as a smartphone is “a long ways away,” said Katie Harbath, associate manager of policy for Facebook. She noted that delegates to the Iowa Republican Caucus in February still voted with pen and paper.

Top Republicans are calling for a review of the methods used in presidential caucuses after a series of vote-counting mishaps in three early states. Maine on Tuesday became the latest state to fall victim to the caucus bug, with a local report noting that the state GOP declared Mitt Romney the winner of a close race without many localities reporting votes in the totals, including some that had submitted their results and some whose caucuses were set for later this month. It was just the latest foible in what has been a very rough year for the caucus format.

National: New voting laws prompt efforts to educate students across nation | The Marquette Tribune

Last year, changes tightening Wisconsin voter ID laws sparked controversy among college students across the state, with some students and state officials claiming the new requirements would dissuade student participation in elections. Now, advocate groups have reacted to these concerns and sought to educate students about what they need for the polls. The Campus Vote Project, an initiative started in 2012 by the Fair Elections Legal Network, aims to mobilize students on college campuses across the country to work with college administrators and election officials to educate students about voting. According to Campus Vote Project’s website, the organization hopes to “overcome barriers students often face to voting that students often mention such as residency laws, registration deadlines, and strict voter ID requirements.” Students who contact the Campus Vote Project can receive a “tool kit,” which includes information about roadblocks to student voting and how to educate colleges about voting requirements.

February is supposed to be the lull in the craziness of this year’s GOP presidential primary, without a single contest between the Maine caucuses (which ended Saturday) and the Michigan and Arizona primaries on Feb. 28, but Super Tuesday has already begun. On Monday, early voting began for Georgia primary voters. The March 6 primary is three weeks off, but expect plenty of Georgians to vote between now and then. Of the 10 states where voting takes place on Super Tuesday, Georgia is the one with the most delegates: 76. But other states are significant, too. Ohio, another big prize, began its early-voting period last week. And Vermont’s began even earlier, a full 45 days before the primary is held. Tennessee’s begins Wednesday, and Oklahoma will have a brief period of early voting just before the primary.

It’s often been said that Oscar season reflects the broader splendors and dysfunctions of American public life. The Academy of Motion Picture Arts and Sciences’ ideals of scrupulous fair play have been under constant challenge in recent years, on such issues as the promotional pull of A-list stars, the power of big-studio money and negative advertising campaigns designed to undermine the competition.

Now, though, the academy may be committing a blunder of its own making. It recently announced that it would be ditching its current all-mail secret ballot system, and that its more than 5,000 members would be voting through their own computers, starting next year. The academy said the software developed by the San Diego-based computer voting company Everyone Counts would incorporate “multiple layers of security” and “military-grade encryption techniques” to ensure that nothing untoward or underhanded could occur before PricewaterhouseCoopers, its accountancy firm, captured the votes from the Internet ether. Unfortunately, leading computer scientists around the world who have looked at Internet voting systems do not share the academy’s confidence. On the contrary, they say the technology is vulnerable to a variety of cyber attacks — no matter how many layers of encryption there are — and risks producing a fraudulent outcome without anyone necessarily realizing it.

When it comes to super PACs, it’s getting hard to tell the difference between reality and a Comedy Central bit. Stephen Colbert made an ongoing gag last month out of lampooning the rules barring coordination between outside groups and campaigns. When he announced a plan to run for president, he made a big show of handing off his super PAC to his fellow Comedy Central host Jon Stewart. Stewart promised not to coordinate with Colbert — giving the camera a wink and a nod. But it was no joke last week when President Barack Obama and Mitt Romney cleared their top aides to raise cash for the super PACs supporting their campaign.

National: U.S. Voter Registration Rolls Are in Disarray, Pew Report Finds | The New York Times

The nation’s voter registration rolls are in disarray, according to a report released Tuesday by the Pew Center on the States. The problems have the potential to affect the outcomes of local, state and federal elections. One in eight active registrations is invalid or inaccurate. At the same time, one in four people who are eligible to vote — at least 51 million potential voters — are not registered. The report found that there are about 1.8 million dead people listed as active voters. Some 2.8 million people have active registrations in more than one state. And 12 million registrations have errors serious enough to make it unlikely that mailings based on them will reach voters.
