Senate Dems met with the capital press Monday to lobby for seven steps they want to see in the final elections bill. Never mind that the Republican-controlled Legislature is moving to change the state’s election law to prevent the long lines of last November, Democrats say the GOP proposal doesn’t go far enough.

On the heels of a failed Republican-backed constitutional amendment that would have required Minnesotans to present photo identification at the polls, Democrats in the Minnesota Senate have introduced legislation designed to make voting easier through early voting. Under the proposed Senate omnibus elections bill, eligible Minnesota voters could begin casting their ballots 15 days before Election Day. The new early voting window would close on the Friday before the election. The sweeping bill also would allow more people to vote by absentee ballot without having to state a reason why they can’t vote in person at their neighborhood polling place on Election Day. So far, however, the proposed election chances have yet to receive any Republican support, which could be the key to their becoming law. Even though Democrats control both houses of the Legislature, Gov. Mark Dayton, a Democrat, has said he will sign election bills only if they have bipartisan support.

Now a state lawmakers is proposing early voting – letting people cast ballots up to three weeks before election day. State Rep. Deb Ruggiero (D-Rhode Island) said, “It was the perfect storm. You know we had polling places that were reduced. We closed the closing times at polls 8 o’clock versus 9 o’clock.  Some people were confused as to where they voted.” Republicans are worried, saying more voting days may lead to more mistakes.

A Republican lawmaker is proposing limits on the hours and days voters can cast in-person absentee ballots even as such voting increases in popularity in the state. The bill would have a heavy impact in Madison, one of several municipalities that have held extended hours on nights and weekends to accommodate in-person absentee voters. Critics said the bill, introduced in the state Assembly late last week, would force municipalities to spend more on mail-in absentee ballots while making it harder for people to vote. The measure proposed by Rep. Duey Stroebel, R-Saukville, would prohibit clerks from opening early, late or on weekends to accommodate voters wishing to cast their ballots before Election Day.

It is the misfortune of Shelby County, Ala., to challenge a key provision of the Voting Rights Act of 1965, a landmark piece of civil rights legislation, following an election when political partisans tried new, more subtle ways of suppressing minority voting participation. Voter surveys showed Republicans trailing badly among blacks and Hispanics, a gap that could potentially cost them the election, and ultimately, combined with disparate support for the Democrats among women and the young, did. Certain Republican-run jurisdictions tried a number of tactics to hold down minority voting: unnecessarily strict voter-ID laws, restrictions on early voting, bans on same-day voter registration, or understaffed or inconveniently located polling places that led to frustratingly long lines. Indeed, one Pennsylvania GOP official boasted — prematurely and mistakenly, as it turned out — that the state’s new voter-ID law had handed the election to Mitt Romney.

It’s unclear how Democrats expect the measure to gain Republican backing going forward. “It gives us a little bit of power, too — almost like a veto,” House Minority Leader Kurt Daudt said on Friday. “If we don’t put any Republican votes up, he’s pledged to veto that stuff.”

Florida’s election troubles last November are prompting state lawmakers to consider changing the state’s election laws this spring, but critics say the current proposals don’t go far enough. On Thursday, a group of African-American leaders accused Republican state leaders of enacting election changes in 2011 that deliberately tried to keep certain voters from casting ballots. They said the reforms caused long lines at polling places and made it harder for people to vote. Now the Legislature is moving to undo some of those changes. The main election reform bills currently under consideration would restore 14 days of early voting, limit ballot summaries from the Legislature and allow counties to open more early voting sites.

The bipartisan commission on Thursday released its recommendations for overhauling Missouri’s voting laws. Missouri now allows people to vote by mail only if they meet certain conditions, such as a disability or absence from their district on Election Day. The commission says voters should be allowed to mail their ballots without such restrictions.

On Wednesday, the justices will get a second chance in the case of Shelby County v. Holder — Shelby County is in Alabama — which seeks to determine if Congress overstepped its authority when it passed the 25-year-long renewal of the Voting Rights Act passed by Congress is 2006. In other words, the case should decide whether or not the Voting Rights Act is constitutional. This is a big deal for a lot of people.

Of all the things that deserve the federal government’s focus right now, the last is the reform of election laws. Yes, it’s shameful that 102-year-old Desiline Victor of Miami faced a six-hour-long line when she showed up to vote last November. Indeed, as many as 201,000 frustrated Floridians left the polls before voting that day, according to an analysis by an Ohio State researcher for the Orlando Sentinel. So on election night, President Obama was right to say “we have to fix that.” But during his State of the Union address, at which Victor was an invited guest, the president was wrong to suggest a federal fix for standardizing how elections are held across the country. A one-size-fits-all formula is not the most effective and efficient way to manage elections from Miami, which experienced long lines, to Milton in Florida’s Panhandle, which did not.

The measure, which restores 14 days of early voting and imposes a maximum of 168 hours, restores many of the changes made in 2011. Republican lawmakers pushed legislation that year that limited elections supervisors to eight days of early voting and a maximum of 96 hours, sparking the waiting lines and delayed results that gave Florida another Election Day black eye. But the Republican-controlled committee agreed with Rep. One of the biggest stories talked about in the wake of Election Day 2012 were the long lines at the polls. As Election Night played out in real time on television, people were able to see firsthand–or not see, as the case was–the votes come in from districts in states that had closed their polls hours ago. Jump over to any local station in these areas, and you could probably find a local reporter talking to prospective voters, many of whom said they had been waiting in line for hours. President Obama, speaking the day after, declared: “we have to fix that.” Some states have already started to address these problems. Florida Secretary of State Ken Detzner filed a report earlier this month with his findings as to the best ways to reduce long lines and streamline elections. Florida saw some of the worst lines last year. Chief among Detzner’s proposed solutions include requiring county commissioners to pay for technological upgrades, giving election administrators greater leeway to make decisions that will shorten lines, and requiring that legislators have a word limit for the constitutional amendments they place on the ballot. He also suggested that, besides unpreparedness among election officials, one of the greatest problems leading to Election Day lines was the cutback passed by the state legislature on the number of early voting days and locations. He says that, despite the budget concerns that led to these being cut back after the 2010 election, they remain a pivotal reason why lines were so long.

Advocates for that change gathered Wednesday at the State House to urge passage of LD 156, a bill that would trigger a statewide referendum to change language in the Maine Constitution to allow early voting. The bill would require two-thirds majority votes in both chambers of the Legislature. Early voting, which takes place in 32 other states, differs from in-person absentee ballot voting, which Maine now allows without proof of hardship by the end of a municipality’s business day on the Thursday before Election Day.

Following an election season marked by long lines and long ballots, Maryland lawmakers are confronting a flurry of bills aimed at tweaking the voting process. “Just after an election, everyone wants to make corrections,” said Del. Sheila Ellis Hixson (D-Montgomery), chairwoman of the House Ways and Means Committee, where 16 bills dealing with elections are scheduled to be heard Thursday. “We had a lot of long lines, so a lot of the bills are to fix logistical sort of stuff,” she said. “We also had five referendums on the ballot, more than ever before, so we want to make sure we clean it up, make sure those rules are fair.” One of the bills is from Gov. The Post’s Nia-Malika Henderson and Felicia Sonmez report that critics are already attacking the idea. Conservatives question why the federal government needs to get more involved with voting. Voting-rights activists wonder why the president needs a commission when he could champion any of the sensible reform proposals already sitting in Congress. But the commission is a good idea, for at least two reasons.

Bush urged the justices to uphold again four years ago in one of his final acts in office, a law that has demonstrably defeated myriad efforts both flagrant and subtle to suppress or dilute the African-American vote, is now hanging by a thread? Of the hanging-by-a-thread part, there’s little doubt. Four years ago, in Northwest Austin Municipal Utility District No. One v. Holder, a case commonly referred to as Namudno, the Supreme Court came within a hair’s breadth of declaring the Voting Rights Act’s Section 5 unconstitutional. “Things have changed in the South,” Chief Justice John G. Secretary of State John Gale testified today in support of LB271 which would reduce the number of in-person early voting days in Nebraska from 35 to 25. The bill, sponsored by Senator Scott Lautenbaugh, arose from a complaint filed under the Help America Vote Act against the Lancaster County Election Commissioner’s office by a visually impaired voter. She was unable to vote in early October, due to the unavailability of the AutoMARK machine, which allows disabled voters to cast an unassisted ballot at their precinct. Following a hearing on that complaint, the hearing officer recommended that in-person early voting days be reduced to 25. Speaking to the Government, Military and Veterans Affairs committee, Gale said that the recommendation made by the hearing officer and supported by the proposed legislation, was the simplest and most accommodating way to address the problem.

Senators on of both sides of the aisle have called for changes to make true early voting a reality in South Carolina, but the senate bill could face some setbacks if nothing happens soon. If early voting does not pass Tuesday, another piece of legislation will take the front seat, pushing the bill back on the calendar. “I thought we had it very close to being resolved, every close, but it just fell apart,” said Senate President John Courson. The last few days in session senators have struggled to advance the bill that would allow South Carolinians to head to the polls and cast their ballots early, but failed deals have stalled that process.

Following unprecedented lines of early voters leading up to last November’s election, state officials want to dramatically alter the process of moving ballots. A proposed measure that would change early voting procedures—and presumably speed up the vote count—moved through an Idaho legislative committee this morning with a “do pass” recommendation to the full membership of the Idaho House. “In Ada County, our population has grown 33 percent while our election costs have grown 313 percent,” Phil McGrane, Ada County chief deputy clerk, told members of the House State Affairs Committee today. “The cost and complexity has risen dramatically. But we’re trying to reduce the complexity so that we can focus on the accuracy and integrity of the voting process.” McGrane told lawmakers that Ada County needed to hire 90 additional workers on Election Night simply to open envelopes containing early ballots.

The president said that Desiline Victor had to wait three hours last year to vote in North Miami. “Hour after hour, a throng of people stayed in line to support her,” Obama said. “[Because] Desiline is 102 years old. And they erupted in cheers when she finally put on a sticker that read, ‘I Voted.’ But Obama’s plan to fix the problem — setting up a presidential commission — hasn’t gotten many cheers. Voting-rights advocates are lukewarm at best, while Republicans are dismissive. So far, there are few details about the new commission. Obama said it will be headed by two longtime election lawyers, “who, by the way, recently served as the top attorneys for my campaign and for Gov. [Mitt] Romney’s campaign.”

Virginia is heading toward tough new restrictions on voting following last November’s election, while across the Potomac, Maryland is doing just the opposite. It’s the latest evidence that the two states are following the diverging national trends of the parties that control their respective statehouses. The Virginia Senate approved a Republican-backed measure Friday that requires voters to show a photo ID at the polls in order to cast a ballot starting in 2014. If it’s signed into law, it would make Virginia the 10th state to pass such a mandate. Republicans said it’s a necessary step to prevent election fraud. But Democrats said the GOP is moving the goal posts after changing voting laws last year to require that Virginians bring any ID, with or without a photo, to the polls. “A year later, we still have no evidence of voter fraud. None at all,” said Sen. Don McEachin, D-Henrico. Gov. Bob McDonnell has not indicated whether he would sign the bill, but a spokesman said “the governor believes Virginia’s current system generally has proven successful.”

The measure (PCB EES 13-01) would allow supervisors to increase the number of early-voting days to 14, though they could remain at the current standard of eight. It would also limit some ballot summaries for legislatively-sponsored constitutional amendments to 75 words, a standard that already applies to citizen initiatives. However, if the Legislature approved more than one summary for an amendment as a fallback to deal with court challenges, only the first would be subject to the 75-world limit. And if the attorney general were required to rewrite a flawed ballot summary, that revision would also not fall under the new rules.

President Obama has a long agenda for his State of the Union address, but it is important that he not forget the most fundamental democratic reform of all: repairing a broken election system that caused hundreds of thousands of people to stand in line for hours to vote last year. It is time to make good on his election-night promise. Those seeking political power by making voting more inconvenient will resist reforms, but a better system would actually be good for both parties and, more important, the country.Long lines are not the inevitable result of big turnouts in elections. They are the result of neglect, often deliberate, of an antiquated patchwork of registration systems that make it far too hard to get on the rolls. They are the result of states that won’t spend enough money for an adequate supply of voting machines, particularly in crowded cities and minority precincts. And they are the result of refusals to expand early voting programs, one of the best and easiest ways to increase participation.

At tonight’s State of the Union address, Michelle Obama will be joined by 102-year-old Desiline Victor, who, like many in Florida and elsewhere, waited hours to vote on Election Day. “By the way,” Obama said in his election speech. “We have to fix that.” But how to fix it remains unclear. Though new research on states’ performance in the November election reveals long lines kept thousands from voting, there’s still much we don’t know about what would best speed up the process. Victor’s home state of Florida had the longest average wait timeof any state at 45 minutes. Victor waited for three hours. Other Floridians reported standing in line for up to 7 hours. Not every voter had Victor’s stamina: Professor Theodore Allen at Ohio State University estimated that long lines in Florida deterred at least 201,000 people, using a formula based on voter turnout data and poll closing time. The number only includes people discouraged by the wait at their specific polling site, and not those who stayed home due to “the general inconvenience of election day.” The real number, Allen says, is likely much higher. One study also showed that black and Hispanic voters nationwide waited longer on average than white voters.

An Assembly panel today advanced a Democrat-sponsored bill that would allow early voting  in primary and general elections. The bill (A-3553) aims to give residents more voting alternatives following the Election Day woes created by Hurricane Sandy. “People are busy, and many have long work days or responsibilities that prevent them from hitting the polls on Election Day,” said Assemblyman John Wisniewski (D-Middlesex), one of the bill’s sponsors. “Then there are natural disasters that we simply can’t plan for. Sandy threw a wrench into the machinery of Election Day and created tremendous confusion. This is a matter of convenience and ensuring every resident who is registered and wants to vote will have the opportunity to do so.”

Secretary of State William Gardner takes a dim view of congressional efforts to address with federal legislation the long lines some states saw at polling places during the November election. In his experience, he said, “One-size-fits-all usually fits very few.” The White House and some in Congress are pushing for changes to federal election laws, such as those involving early voting and online voter registration. But if such measures were to pass, Gardner said, “we would first work to get out of it like we did with the National Voter Registration Act.” New Hampshire got an exemption from that 1993 “motor-voter” law by passing same-day voter registration and making it retroactive to the date of the federal legislation. Gardner stressed that different states have very different cultures. “We are who we are because of our history,” he said. And, he said, “the federal government hasn’t had the best of track records when it comes to changing election laws for states. And I would prefer that the federal government stay out of this.”
