On December 16, 2011 the Milwaukee chapter of the NAACP and Voces De La Frontera, a Wisconsin group that fights for immigrant rights, filed a suit against the state of Wisconsin’s new voter ID law. The new law is Wisconsin Act 23 and will require voters to show photo identification at the ballots beginning in 2012.

Voces De La Frontera and the NAACP are challenging the law, saying that it is unconstitutional and is intended to marginalize voters. The two organizations’ challenges follow the American Civil Liberties Union’s (ACLU) that was announced on December 13, 2011. The ACLU is challenging the law because they say that it violates the Equal Protection Clause of the 14th Amendment as well as the 24th Amendment which was enacted to protect against poll taxes.

Waukesha County Clerk Kathy Nickolaus said last week she believes she has been exonerated even though her office is undertaking numerous changes in how it handles ballots following the nonreporting of 14,000 votes in the spring Supreme Court election. State investigators in September determined that Nickolaus likely broke the law by not reporting the votes in the hotly contested race between Justice David Prosser and challenger JoAnne Kloppenburg, but her conduct was unintentional and not criminal.

… The Government Accountability Board on Tuesday approved numerous changes designed to improve the procedures used by Nickolaus's office on election night. Both before the meeting and during a break, Nickolaus told reporters that the investigative report vindicated her handling of the votes.

"I've been exonerated," she said. Government Accountability Board director Kevin Kennedy disagreed. "I would not characterize it that way," Kennedy said. The September report, led by former Dane County prosecutor Timothy Verhoff, found that Nickolaus likely broke state law requiring the posting of all returns on election night.

Scott Walker's campaign and the state Republican Party director sued the state's elections and ethics agency in Waukesha on Thursday over its handling of duplicate and bogus signatures in the ongoing recall effort against the governor. The top GOP lawmaker in the Assembly also took a shot at the Government Accountability Board - which he voted to create - saying it had strayed from its nonpartisan mission and might need to be replaced.

The lawsuit filed Thursday in Waukesha County Circuit Court asks a judge to order the accountability board to look for and eliminate duplicate signatures, clearly fake names and illegible addresses. The lawsuit can be brought in one of the most conservative counties in the state because of a change in state law earlier this year by Republican lawmakers and Walker that allowed lawsuits to be brought against the state outside liberal Dane County, the seat of state government.

Wisconsin's voter ID law is again being challenged, this time in federal court. It's the only active federal challenge of a photo ID law, say representatives of the national and state chapters of the American Civil Liberties Union and the National Law Center on Homelessness and Poverty, who are bringing the lawsuit.

The lawsuit, filed Tuesday in the Eastern District of Wisconsin federal court, seeks an injunction against enforcement of the voter ID law, which takes full effect on Feb. 21, 2012 for Wisconsin's spring primary elections.

"The photo ID law imposes a severe and undue burden on the fundamental right to vote under the Equal Protection Clause of the Fourteenth Amendment of the United States Constitution; violates the Twenty-Fourth and Fourteen Amendments to the United States Constitution as an unconstitutional poll tax; and violates the Equal Protection Clause o the Fourteenth Amendment in arbitrarily refusing to accept certain identification documents," the December 13 complaint (PDF) states.

The League of Women Voters of Wisconsin Education Network filed suit in October against Wisconsin's law in state court, and the Milwaukee branch of the National Association for the Advancement of Colored People is also expected to file a state challenge this week.

Civil rights activists protested stricter voting laws Saturday with a march from the New York offices of Koch Industries, whose owners have supported an organization that favors tighter safeguards against election fraud.

"You can't accomplish anything if you're not prepared to fight," said U.S. Rep. Charles Rangel, wearing a hat with embroidered with "NAACP." Rangel and other labor leaders and politicians said they wanted to roll back new voting rules passed in several states.

Some of the laws passed in more than a dozen states around the country include requiring photo IDs at the ballot box and restricting voting by ex-felons. Critics say the laws will have a negative effect on blacks, Latinos, students and the elderly.

The reports of how the Republican-inspired voter ID law is disenfranchising Wisconsin citizens, particularly the elderly, keep coming in. Last week the Wausau Daily Herald ran a heart-rendering story about 84-year-old Ruthelle Frank of nearby Brokaw, who has not only voted in every election since she turned 21 in 1948, but has served on the Brokaw Village Board for the past 15 years.

Because of a paralysis she suffered at birth, Frank has never had a driver’s license. That being the case, she, like tens of thousands of other Wisconsin residents without licenses, needs to get a so-called state picture ID card so she can go to the polls to exercise what should be her right as an American citizen.

Under the onerous provisions of this new law, which was gleefully signed by Gov. Scott Walker earlier this year, she has to produce a birth certificate to get the ID. Ordinarily it cost her $20 to obtain a birth certificate since she doesn’t have one — something she finds “crazy.” She has a baptism certificate, a Social Security card, a Medicare statement, a checkbook. “I’ve got all this proof. You mean to tell me that I’m not a U.S. citizen? That I don’t live at 123 First St. in Brokaw?” she said. “It’s just stupid.” But, wait, there’s more to the stupidity foisted on Wisconsin citizens by this Republican-led Legislature.

A second lawsuit challenging Wisconsin's new voter I.D. law is expected to be filed next week. The Milwaukee branch of the National Association for the Advancement of Colored People will be the lead plaintiff in the suit, which will also include Wisconsin immigrant rights group Voces de la Frontera and several individuals, said Milwaukee attorney Richard Saks.

"We're arguing that the photo I.D. requirement is an unreasonable and onerous burden on the state constitutional right to vote for Wisconsin citizens," said Saks, who is representing the plaintiffs. Saks said the law is tantamount to a denial of the right to vote for "scores of thousands of voters, if not hundreds of thousands of voters, throughout the state of Wisconsin who don't have the types of I.D." now needed at the polls.

According to a survey completed for the website www.GetvoterID.org, those attempting to obtain a copy of their birth certificate to prove name and birth date to then obtain a voter photo ID may encounter a confusing application process. Many counties are directing applicants to a mail-in form which incorrectly informs applicants they need a copy of their photo ID prior to requesting the copy of the birth certificate. Applicants attempting to obtain voter photo IDs are instructed they need their birth certificate to get a voter photo ID, which results in a frustrating cycle with the potential to deter those trying to obtain IDs to vote in 2012.

Confused yet? State law does NOT require applicants to present identification when the copies of birth certificates are mailed to the applicant. However, since the form wasn't properly updated, the Election Division of the Government Accountability Board,  the Department of Health Services, the Wisconsin Register of Deeds Association and 48 Wisconsin counties all post a link to this outdated and confusing form.

No charges will be brought against two groups that were accused of election law violations in the run-up to the August recall election of Sen. Alberta Darling, according to a statement released this morning.

“It is unclear, at best, whether an offer to pay persons to gathers absentee ballot applications on a quota basis comes within the scope of the Election Bribery statute,” wrote Asst. Dist. Atty. Bruce Landgraf, the lead prosecutor on the case for Milwaukee County. “The statute as currently written does not give much guidance to those who wish to follow the dictates of the law, especially in the area of absentee voting.”

Wisconsin Right to Life gave campaign workers $25 gift cards for every 15 voters sympathetic to the anti-abortion cause that were enlisted for absentee voting. Wisconsin Jobs Now, a community and labor group, held five block parties on the northwest side of Milwaukee. They provided food, prizes and a lift to Milwaukee City Hall where voters could cast absentee ballots.

Last week, UW-Madison announced plans to issue students a special identification card for voting. UW-Milwaukee is following suit. The university said Tuesday it will create a secondary card to comply with Wisconsin’s new photo ID law.

As WUWM’s Ann-Elise Henzl reports, schools are deciding whether to accommodate students. It comes with a cost. Under Wisconsin’s new voting law, a variety of identification cards are acceptable at the polls, including university IDs. However, UW System spokesman David Giroux says no UW ID cards contain all the information the law demands.

Wisconsin's election board on Tuesday authorized a state university to issue identification cards that students can use to comply with the new law requiring voters to present photo ID at polling places. University of Wisconsin-Stevens Point joined six other schools authorized by the Government Accountability Board to issue secondary ID cards that comply with the law in Wisconsin, one of several states to pass such legislation this year.

In addition to Stevens Point, the system's flagship university in Madison along with schools in Milwaukee, Whitewater, La Crosse, Eau Claire and Green Bay will issue the secondary ID cards. The eighth school -- the University of Wisconsin-Superior -- has received approval to re-issue primary identification cards to all students that meet the voter ID requirements.

A planned mass deputation organized by members of Student Council on Monday night coincided with the announcement that the University of Wisconsin will be issuing voter IDs to students requiring them.

The deputation was organized by Associated Students of Madison first year representative Colin Higgins and involved 13 students. These now-official special registration deputies will be able to register other students and community members to vote.

At least $650,000 will be needed by state election officials to cover the costs of handling petitions for Wisconsin's upcoming wave of recalls, according to a memo from the state Government Accountability Board. But that estimate doesn't include costs for local governments, which are expected to be in the millions statewide.

The election watchdog agency said it will need an additional $652,699 to cover recall expenses, including personnel costs, mainly from hiring and supervising about 50 temporary workers to review as many as 1.5 million signatures, renting additional office space, buying supplies and equipment and doing public outreach about the state's new voter ID law.

Opponents of Gov. Scott Walker said they have faced threats and thefts in the days since the recall effort began. Two volunteers in the petition drive reported violent threats made against them to the police. Neighbors in Monona also complained to authorities of politically motivated thefts from their yards.

The threats involved phone calls from an area code in Minnesota. The calls came overnight after Walker's opponents began the recall, said Madison resident Tom Peer, who said he received a call at 2 a.m. on Thursday. "They said, 'If you don't stop circulating recall petitions, we will kill you,'" said Peer.

State election officials anticipate they will need an extra $650,000 next year for a new wave of recall efforts that will require them to review petitions with perhaps 1.5 million signatures. Those costs would go toward hiring 50 temporary workers, renting office space to house them and the petitions, and running advertisements about the state's new requirement that voters show photo identification at the polls.

The preliminary estimates from the state Government Accountability Board do not include the recall costs for local officials, which are expected to be much higher than those for the state if enough signatures are gathered to hold elections. The board is still developing estimates for what the costs would be for local officials. Recall elections this year for nine state senators cost state and local taxpayers $2.1 million, according to the board.

A legislative committee asked state election officials to turn their motions on electoral issues into formalized rules to be approved by the governor Tuesday, a move critics say takes away the group’s independence from the Legislature. In a 6-4 vote split down party lines, the Joint Committee for Review on Administrative Rules voted to change a motion made by the Government Accountability Board into a finalized rule requiring Gov. Scott Walker’s approval.

Jason Rostan, spokesperson for JCRAR Chair Sen. Leah Vukmir, R-Wauwatosa, said the motions on voter ID stickers, technical college IDs and who can pre-fill petitions must go through a fairly lengthy process to become formalized. Rostan said a majority of the committee believed the GAB’s motion allowing the voter ID law to accept the use of technical college IDs is essentially new law created without legislative oversight.

All 26 campuses in the UW System use "smart" cards for student identification. These cards can be used for a wide array of monetary and security functions. But the issue at hand is that across the System's 26 campuses, there are as many as 14 different versions of student IDs, and not all of them meet the new requirements, said David Giroux, spokesman for the System.

For example, the cards currently issued by UW-Madison do not meet the new voter ID law's standard for voter identification. Wiscard IDs expire every five years, exceeding the two-year allowable time between issue and expiration dates on student IDs for voting, said Government Accountability Board Spokesman Reid Magney.

The League of Women Voters of Wisconsin Education Network filed suit Thursday in Dane County Circuit Court, challenging the state's new voter ID law, which is considered by many to be one of the most restrictive in the country. The league argues that the new law violates the state constitution by creating a new group of disenfranchised voters.

"Some people say that you have to show ID to use the library, cash checks, and so on," says Melanie Ramey, the league's president in a prepared statement. "That is very different than a right that is guaranteed by the constitution of the state or federal government. Those transactions are generally based on personal business decisions of companies or other entities. They are not rights of citizenship."

It also raises the prospect of a fierce legal battle over the issue, as Republicans could ask a court to require the elections in the new districts. The accountability board, which consists of six former judges, will review Kennedy's opinion Nov. 9 and decide whether to sign off on it.

Nine senators - six Republicans and three Democrats - faced recall elections this year because of their stances on Republican Gov. Scott Walker's legislation that greatly limited collective bargaining for public workers. Democrats gained two seats in those elections.

Do voters need their ballots emailed to them? Legislators are now debating whether it's necessary, or even possible. Emailing absentee ballots isn't new. In fact, it's done all the time for the military and overseas voters. But, state democrats say email availability should be extended to everyone.

City clerks say most people vote the day of the election. And if they're out of town, they'll fill out their ballot early at the city clerk's office, voting absentee. Some democrats in the state legislature say there should be more options.

“I support the idea that clerks should be able to email out ballots. People are using email today instead of the post office. It’s a fast, easy way to get information,” says State Senator Kathleen Vinehout.

Local universities have found thrifty ways to make student IDs mesh with looming requirements at the polls, but their plans rest on a state board’s interpretation of the new voter ID law. Student IDs at Viterbo University and the University of Wisconsin-La Crosse will not be accepted as valid forms of photo ID when the law takes effect next year.

All student IDs will need a signature and posted issuance and expiration dates with a two-year life span to be acceptable for voting. UW-L officials plan to keep existing student IDs and issue an extra voting card to students upon request.

“We’re only going to provide these to students that need them and request them,” said Larry Ringgenberg, UW-L director of university centers. “Typically, we’re not seeing this as a huge population of our students.”

When heading to the polls in Madison in 2012, hope for short lines and plenty of poll workers, or you could be queueing up for awhile. Statistics put together by the Madison city clerk's office following the mock election on Tuesday showed if there are 30 people waiting to vote, you should plan on being in line for at least 32 minutes.

The mock election at the City-County Building was held to give election workers (and voters) an early look at how it will be at the polling place when 2012 elections roll around, the first elections that will implement a new voting law in Wisconsin. According to the news release from the city clerk's office, a total of 154 voters and nine election officials took part in the three-hour mock election; 15 of those voting cast provisional ballots.

A provisional ballot means the voter didn't have acceptable photo ID but was allowed to vote, providing proper ID is shown at the clerk's office by 4 p.m. of the Friday following an election. Two key elements of the law, showing a photo identification card and signing the poll book, were looked at as possibly bogging down the vote. The mock election showed just how much.

A Republican lawmaker in Wisconsin wants to change how Wisconsin awards electoral votes — a proposal that spurred a swift, negative reaction Wednesday from Democrats who see the move as an attempt to help Republican presidential candidates.

Wisconsin joins at least two other states where changes to how Electoral College votes are being discussed heading into the 2012 presidential election. The 10 electoral votes in Wisconsin, which has a winner-take-all system, went to President Barack Obama in the 2008 election.

Wisconsin state Rep. Dan LeMahieu on Wednesday circulated a proposal for co-sponsors that make so a single electoral vote would go to the winner in each of Wisconsin’s eight congressional districts. The statewide winner would get two electoral votes.

Nothing can rile a taxpayer quite like an unplowed street or missed garbage pickup. The delivery of basic services can make or break a mayoral career. But a funny thing happened in the last year or so: In two separate city surveys, Madison residents identified election administration as one of the priority services delivered by city employees. In one case, 94% of respondents who attended a community budget meeting on city administration said that election administration was of "high" importance to them, right after the provision of emergency medical service by the fire department but before bus, sewer, snow removal, recycling and refuse services.

A web survey of city residents conducted between July 26 and Sept. 1 had similar results: 72% of respondents rated election administration of high importance. That also ranked higher than such city services as park maintenance, street repair, the management of communicable diseases and traffic safety control.

City Clerk Marybeth Witzel-Behl says she was surprised — and gratified — by the results. "We always thought elections were the most sacred thing we deal with," says Witzel-Behl. But, she adds, "I didn't realize the community echoed that value."

Wisconsin's voter ID law will present new hurdles to some students and cost UW-Madison as much as $700,000 if the university provides all students new identification cards to comply with the law. It's not clear how many students would use university IDs to vote, and school officials are waiting further clarification from the state Government Accountability Board about what kind of university ID would be acceptable at the polls.

All Wisconsin voters must present a valid photo ID in order to vote starting with the Feb. 21 spring primary, including a Wisconsin driver's license, U.S. passport, military ID or tribal ID. College students without those forms of identification can use a university ID that includes a date of issuance, the student's signature and an expiration date within two years of issuance. They must also present additional proof of enrollment.

Currently, UW student IDs do not comply with the voter ID law because they have five-year expiration dates and do not include signatures. "Students are extremely confused," said Hannah Somers, an out-of-state UW-Madison student and legislative affairs chairwoman for Associated Students of Madison, UW's student government. "I've heard students say 'I'm just going to vote absentee at home because that's going to be easier.'"

A new, little-noticed state law guarantees voters can receive absentee ballots by email, but it may not be on the books for long. When legislators in May adopted a requirement that voters show photo ID at the polls, they also changed the law to ensure voters can receive absentee ballots by email if they ask for them. While voters can receive the ballots by email, they still have to return them by traditional mail or drop them off in person.

But in June, the state Senate included a provision in another bill that would repeal the requirement that municipal clerks email absentee ballots to all voters who request them. The clerks would still have to email absentee ballots to military and overseas voters, but not other voters.

Repealing the provision on emailed ballots was tucked into a bill that would move the partisan primary from September to August. Moving the primary is required to comply with a federal law meant to ensure military and overseas voters have enough time to return their ballots.
