As the Justice Department investigates Pennsylvania’s voter ID law on the federal level, a coalition of civil rights groups is gearing up for a state trial starting Wednesday examining whether the law is allowable under Pennsylvania’s constitution. In that case, Pennsylvania might have handed those groups and their clients (including 93-year-old Viviette Applewhite) a bit of an advantage: They’ve formally acknowledged that there’s been no reported in-person voter fraud in Pennsylvania and there isn’t likely to be in November. The state signed a stipulation agreement with lawyers for the plaintiffs which acknowledges there “have been no investigations or prosecutions of in-person voter fraud in Pennsylvania; and the parties do not have direct personal knowledge of any such investigations or prosecutions in other states.”

Among the items Perez is requesting are databases of Pennsylvania voters and holders of drivers’ licenses and similar state IDs. It’s not clear precisely what triggered the letter but it refers to an estimate Secretary of State Carol Aichele issued earlier this month indicating that 9.2 percent of the state’s 8.2 million voters don’t have a state-issued photo ID. However, a state-issued ID is not the only form of acceptable voting ID, which includes passports, military ID and some student IDs.

City Commissioner Al Schmidt released a report today claiming widespread voting “irregularities” and potential “voter fraud,” in Philadelphia. The report is almost sure to attract at least some attention from the national GOP, which has used the specter of voting fraud as a justification for a slew of voter ID laws around the country, even though very few instances of voter fraud have been uncovered nationally.  This spring, both Schmidt, a Republican, and City Commissioners Chairwoman Stephanie discussed findings of voting irregularities, holding a joint press conference to announce that some machines had reported more votes than were recorded in poll logs, and promising to conduct an investigation. But today’s report was produced by solely by Schmidt and his office; minutes before his press conference, Singer told this reporter that her office had just seen the report for the first time. We’ll have more on this soon, but Schmidt essentially reported having found 7 types of voting “irregularities” in Philadelphia’s 2012 primary election. Of those, three or four — notably, “voter impersonation,” “individuals voting more than once,” might, he said, constitute fraud. It’s worth noting here that Schmidt’s investigation found very few instances of these alleged crimes. Schmidt reports one (1) case of voter impersonation, which dates back to 2007 and which has already been reported. The reports cites one (1) example of someone allegedly voting twice. The report also found 7 voters who voted in the last ten years and were subsequently rejected from the rolls because they were not U.S. citizens. It’s also worth noting that recently-passed voter ID laws wouldn’t stop most of the problems (and the most numerous) identified in the report.

On election day four years ago, Applewhite went across the street to vote. “I was waiting there when they opened the door,” she said. “I didn’t vote for [Barack] Obamabecause he was black. I voted for him because he was a Democrat.” But her record of faithfully voting for Democrats will be more difficult to maintain, thanks to a strict voter identification law adopted this year by Pennsylvania’s Republican-controlled Legislature. Ads created by his company, a Republican lobbying group, encourage Pennsylvania residents to obtain state-issued photo identification so they don’t “miss out” on their right to vote. Republican lobbyist Chris Bravacos, who according to the Center For Responsive Politics has thus far bundled $30,000 for Romney’s campaign, is president and CEO of the Bravo Group, which received a $249,660 government contract from Republican Gov. Tom Corbett’s administration for the ad campaign. Two ads the company created were posted online by the Bravo Group back in April (according to a Google cache) and taken down after Philadelphia City Paper’s Daniel Denvir published a story about the contract on Sunday. Occupy Harrisburg later reposted the two videos, one of which uses what looks like stock photos of a diverse cast of smiling individuals holding ID-sized cards that read “My Valid Pennsylvania Identification.” The campaign’s slogan? “Your right to vote: it’s one thing you never want to miss out on.”
