Utah: Legislature moves to bottle up some Utah voter data

Stung by the release of detailed voter information on 1.5 million Utahns online in January, Utah lawmakers are taking action to protect voter information. A bill making two changes in the voter information process passed the House by a 71-2 vote on Tuesday. The bill, HB 302, would keep voter birth date information classified and would also allow voters to opt into a program to protect all of their information, going forward. The bill now advances to the Senate for further consideration. Sponsored by Rep. Becky Edwards, the bill is one of two voter information related items being considered by the Legislature this session. It comes weeks after a New Hampshire man bought a voter registration list from the state and made that personal information available online for free. The information includes names, birth dates, phone numbers and the voting activity of everyone in specific households during recent elections.

State lawmakers are trying to figure out how to prevent Utah voters’ information from being used for personal gain after a New Hampshire man bought it from the state and posted it online. The Senate last week unanimously passed SB36 to limit access to the state’s voter registration rolls and prohibit putting it on the Internet. It includes exceptions for political, scholarly, journalistic and governmental purposes. But a House committee Monday expanded those exceptions to include banks, hospitals and insurance companies. It now goes the full House for consideration.

Hoping to make voting accessible without opening the door to fraud, Colorado is turning to technology. In 2013, the state Legislature created Colorado’s own “electronic pollbook,” a new real-time voter-tracking system that allows the state to combine an all-mail election with traditional in-person voting, maximizing the opportunities for residents to cast ballots. Colorado already had a robust vote-by-mail system—about three-quarters of the state’s voters mailed their ballots in 2012—but now, every registered voter in the state, including previously “inactive” voters, will receive a mail ballot in upcoming elections. Yet unlike in Washington state or Oregon, which run all-mail elections, Coloradans can still vote in person if they choose. Instead of being tethered to a local precinct, voters can cast ballots or return their mail ballots at any “voting center” in their county, where poll workers can check them in using the real-time connection in the new e-pollbook to ensure they haven’t already voted using a mail ballot. The process is spread over a couple of weeks of early voting and Election Day itself to reduce crowding and wait times at polling places.

A house bill that would provide a process for the public to register to vote at polling sites on election day will be heard before the House Finance Committee this afternoon. House Bill 2590 was introduced by Representative Kaniela Ing of South Maui. Under the bill, late voter registration would be allowed at absentee polling places beginning in 2016. The measure would also allow late voter registration on election day at both absentee polling and precinct polling places beginning in 2018.

Boise Democratic Rep., and Idaho Secretary of State candidate, Holli High Woodings is pushing what she calls a DMV voter registration bill, which would allow registration to vote through the Department of Motor Vehicles. But even she admits that could be a challenge to get it through her House State Affairs Committee. “Tough crowd,” wrote Woodings on her Facebook page after presenting before the committee Feb. 18. The bill, as written, would allow, but not require, Idaho citizens to register to vote at the same time they register with the DMV.

While saying it had received no complaint against the Democratic group Battleground Texas, the office of Texas Secretary of State Nandita Berry suggested Wednesday that the group’s voter registration practices might rise to a “potential level of offense” of state election law. Battleground Texas strongly disputes breaking any laws and said a flap over its registration efforts has Republicans running scared. At issue is a videotaped conversation with Battleground Texas volunteers in Bexar County. It was gathered surreptitiously by controversial conservative activist James O’Keefe, who has sent people posing as interested volunteers to infiltrate Democratic or liberal activist groups, after which he disseminates video that was secretly gathered.

Just a just a tiny percentage of the estimated 5.5 million British expats are currently registered. The Electoral Commission has therefore launched an international campaign via radio and social media to encourage more to sign up. An overseas registration day on Wednesday February 26 aims to achieve at least 25,000 overseas voter registration form downloads from the website www.aboutmyvote.co.uk.

An elections bill that took several strange turns through the legislative process passed the state Senate Friday, helping to quell concerns of anxious fire districts and city councils worried about having enough time to prepare for spring elections. House Bill 1164 is an update of the election code for nonpartisan elections: municipal, special district and school districts. Democrats say it creates one standard for residency in Colorado elections and allows people who move the ability to vote where they live. But Republicans argued the bill invites voter fraud and is a continuation of problems created with last year’s Democratic elections measure that allowed for all mail ballots and same-day voter registration. The measure passed the Democratic-controlled Senate on a party-line vote.

The United States Census Bureau reports that Americans aged 18-24 have the lowest voter registration rate of any age group.  Only 53.6% of U.S. citizens in that age group were registered to vote as of November 2012.  By contrast, more than 79% of citizens aged 65 and older were registered.  These disparate numbers raise questions about the health of our nation’s civic culture and the fairness of our elections, a concern so real it made it into an episode of The West Wing. Between its implementation in 2010 and its repeal in 2013, a North Carolinaelection law attempted to mitigate the age-registration gap by allowing otherwise qualified 16 and 17-year olds to pre-register to vote.  Upon turning eighteen, individuals who had pre-registered would be automatically registered to vote following verification of their address.  According to Common Cause North Carolina, an estimated 160,000 of the state’s teenagers who pre-registered were able to vote in the 2012 election.  The North Carolina election law was unique in requiring county election officials to hold voter registration drives on high school campuses.

In December 2012, two longtime Democratic strategists started the SoS (Secretary of State) for Democracy super PAC, which plans to be involved in six races — including Ohio and Iowa. Why has a series of elections known to send the most aerobic of election-year browser refreshers into a deep sleep suddenly taken on the contours of a close Senate contest? Blame a string of events that started with the 2000 presidential election and reached their climax with the current battle over voting rights. The Constitution states, “the Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof,” and in 38 states, secretaries of state are tasked with carrying out the will of the legislature and orchestrating the complex system that decides who gets to run the country.

Signed into law as a federal holiday 30 years ago by President Ronald Reagan, the occasion to honor and remember Martin Luther King Jr. is also a moment to reflect on the state of democracy in the United States. After the Voting Rights Act of 1965 passed, King called it “a great step forward in removing all of the remaining obstacles to the right to vote.’’ His carefully chosen words highlighted the triumph of the act while signaling that there was more work to be done. For his part, King announced in his annual report to the Southern Christian Leadership Council (SCLC) a new initiative, the Political Education and Voter Registration Department. Charged with equipping poor and black voters with an understanding of the voting process and the new protections of the Voting Rights Act, King and his colleagues set out to help expand the number of registered voters. Without regard for political affiliation or outcome, this initiative championed voter education and registration as a means to allay past injustices such as poll taxes and to guide the nation toward a more free and just society.

How disappointing that in a 2,866-word State of the State address quoting the Kansas Constitution’s statement that “all political power is inherent in the people,” Gov. Sam Brownback failed to speak up for the 20,000 people in Kansas whose voter registrations are stalled. At least the U.S. Election Assistance Commission mentioned them in its ruling Friday. Kansas, Arizona and Georgia wanted the commission to provide an instruction on the federal voter-registration form regarding their requirements that those registering in their states provide proof of citizenship such as a birth certificate or passport. Since the Kansas law went into effect in January 2013, more than 20,100 applicants have seen their voter registrations put on a suspense list for lack of paperwork. The EAC staff ruling denying the states’ requests said Congress specifically considered and rejected requiring such documentation when passing the National Voter Registration Act in 1993. “Such burdens do not enhance voter participation, and they could result in a decrease in overall registration of eligible citizens,” the ruling said. It pointed to Kansas’ lengthening list of applicants placed in suspense status, saying the requirements risk discouraging voter-registration drives.

The now ongoing FBI’s investigation of the Shelby County Election Administrator’s office, first reported as imminent by the Flyer in December, is moving — in the often-used bureaucratic phrase — “with all deliberate speed.” So far one employee of the Election Administrator’s office has been interviewed by the FBI, but five more designated on the Bureau’s ask list have not been, nor has the Administrator himself, Richard Holden. Earlier reports had suggested that Holden would be interviewed this week, but Robert Meyers, chairman of the Shelby County Election Commission, said he had been informed that Holden’s interview had been rescheduled for some time in early February. Meyers confirmed that, besides Holden himself, the FBI had designated six employees for interviews — “two in voter registration, three in the election officials department, and one trainer.” The chairman — one of three Republicans on the five-member Commission, which also includes two Democrats — declined, on grounds of “fairness,” to identify the names of the six employees involved, or to indicate the category of the employee already interviewed.

In a rebuff to state officials, the head of the federal Elections Assistance Commission has rejected Arizona’s request to require proof of citizenship by those using a federal form to register to vote. In a 46-page order late Friday, Alice Miller, the commission’s acting director, said Congress was within its rights to conclude that those seeking to vote need not first provide documentary proof of eligibility. Miller said the affidavit of citizenship, coupled with criminal penalties for lying, are sufficient. Friday’s ruling is yet another significant setback for Arizona’s effort to enforce the 2004 voter-approved law. North Carolina is asking a federal judge to keep secret Republican state lawmakers’ communications as they pushed through the nation’s most restrictive voting law last summer. “They are doing everything they can to try to keep us from finding out what they did and how they did it and who was involved,” Rev. William Barber II, the president of the state’s NAACP chapter, which is challenging the law, told reporters Thursday. “It’s time for what was done in the dark to come into the light.” Barber’s NAACP, backed by the Advancement Project, wants access to the lawmakers’ emails and other internal communications in order to bolster the case that the law’s Republican sponsors knowingly discriminated against racial minorities. In response, the state argued late last week that the communications are protected by legislative privilege. In October, a GOP precinct chair resigned after saying that it would be OK if the law keeps “lazy blacks” from voting. The spat comes as the civil rights groups add more claims to their lawsuit, which was originally filed in August. The U.S. Justice Department has filed its own lawsuit against the measure.

I’m not going to jail, at least not for voting. That means good news for me, and a chance to keep Coloradans’ trust in our election results, but only if the new General Assembly is willing to act on the terrible election law passed last year. While anti-gun legislation dominated the media during the last Colorado legislative session, the most dangerous bill passed was a revamp of our voting laws. Thanks to House Bill 1303, Colorado is now the poster child for sloppy election law. Not only does a cable TV or phone bill serve as a valid form of voter identification, but we’re also the only state in the country that has both all mail-in ballots and same-day voter registration. Under the new law our ballots, including yours, are flung through the mail like grocery-store coupons, whether you want them delivered that way to you or not. As the news site CompleteColorado.com reported, ballots in the last election were readily found in trash cans and apartment mail rooms, just ready to be harvested.

Alabama could see more low-income citizens signing up to vote now that voter rights groups and state officials have reached an agreement ensuring people who apply for social services also receive voter registration applications. The Alabama State Conference of the NAACP and others announced the agreement Tuesday. It calls for the state Medicaid Agency and the state Department of Human Resources to automatically distribute voter registration applications to people when they apply for social services, renew the services or file a change of address. Citizens whose transactions are completely remotely, such as by computer, will be mailed voter registration applications.

Iowa is moving to revise its voter registration application to help clear up widespread confusion over felons’ voting rights, according to an administrative rule published Tuesday. The change, adopted by a bipartisan commission, would remove a question that some voters have erroneously marked indicating they are felons without the right to vote. Another revision would explain that convicted felons aren’t qualified to vote until they have their rights restored by Gov. Terry Branstad. Prospective voters still would have to attest that they are not felons without voting rights when signing the application. If the changes go into effect, as expected, a new application will be in use starting April 9. The state will gather public comment on the proposed changes through Jan. 28, and a legislative rules committee will review them in February.

Voters should be required to show photo ID at polling stations in Great Britain to lessen the risk of fraud, the Electoral Commission has said. The elections watchdog said it planned to introduce the change in time for the 2019 local government and European Parliament elections. Although it has yet to confirm full details of the plan, it said it would be based on the Northern Ireland model, where voters already need photo ID. Campaigners No2ID condemned the plan. But Electoral Commission chairwoman Jenny Watson said most voters could use passports, driving licences or even public transport photocards to prove who they are at polling stations. Those without any of these documents could request a free elections ID card, she added.

North Carolina Gov. Pat McCrory announced a Nov. 4 special election to replace longtime Democratic Rep. Melvin Watt, ensuring the contest coincides with previously scheduled elections in the Tar Heel State. The 12th District primary — which will mostly likely determine the next member of Congress from this deeply Democratic district — will be held May 6. A runoff is scheduled for July 15. “Because of the various filing deadlines, ballot preparation time, state and federal calendar requirements for ballot access, voter registration deadlines and to avoid voter confusion, it was determined the most efficient process would be to roll the special election into the already established primary and general election dates,” a news release from McCrory’s office said.
