Local Democrats are up in arms about a controversial voter ID bill that would exclude veterans' identification cards from the short list of photo IDs required to cast a vote in Texas. Ann McGeehan, director of the Secretary of State's elections division, said last week at a seminar in Austin that photo ID cards issued by the U.S. Department of Veterans Affairs are not acceptable forms of military ID to vote, according to a recording provided by the Texas Democratic Party. Jordy Keith, a spokeswoman for the secretary of state, backpedaled Friday on that determination.

“It was an informal Q&A, and (McGeehan) was answering based on what was expressly called out in Senate Bill 14,” Keith said. “Right now our office has not issued a final determination on that.”

Passed after Gov. Rick Perry declared voter ID an emergency issue in the last session, the strict bill is touted by Republicans as a way to reduce voter fraud but decried by Democrats as an effort to lower voter turnout among minorities and the elderly, disabled and poor.

The US Federal Voting Assistance Program (FVAP) is the Department of Defense Agency charged with assisting military and overseas voters with all aspects of voting, including registering to vote, obtaining ballots, and returning ballots. FVAP's interpretations of Federal law (*) says that they must perform a demonstration of electronic return of marked ballots by overseas military voters (**) in a Federal election at the first Federal election that occurs one year after the adoption of guidelines by the US Election Assistance Commission. Since the EAC hasn't adopted such guidelines yet (and isn't expected to for at least another year or two), the clock hasn't started ticking, so a 2012 demonstration is impossible and a 2014 demonstration looks highly unlikely. Hence, this isn't a matter of imminent urgency; however, such systems are complex and FVAP is trying to get the ball rolling on what such a system would look like.

As has been discussed previously on this blog, nearly all computer security experts are very concerned about the prospect of marked ballot return over the internet (which we will henceforth refer to as "internet voting"). Issues include vulnerability of client computers, issues with auditability, concerns about usability and coercion, etc. On the flip side, many states and localities are marching full steam ahead on their own internet voting systems, generally ignoring the concerns of computer scientists, and focusing on the perceived greater convenience and hoped-for increased turnout. Many of these systems include email return of marked ballots, which computer scientists generally consider to be even riskier than web-based voting.

The Ohio Legislature approved a bill Wednesday that would do away with the parts of a new law that allow Ohioans to register to vote and update their addresses online. The provisions were included in an election overhaul law signed by Gov. John Kasich almost two weeks ago.

Under the sweeping new law, voters must give their full Social Security number when casting a provisional ballot, which they're given if there are about questions about their identification, voting eligibility or voting precinct. The ballots are later counted if the voters' information checks out.

The law also requires voters to provide their full nine-digit number when registering to vote, if they choose to use their Social Security number as a way to identify themselves.

The Justice Department’s program for handling military absentee ballots suffers from major flaws, and a survey revealed low turnout among military voters in the 2010 mid-term elections, according to a report by a private group made public on Tuesday.

Less than 5 percent of 2 million military personnel in states that are home to 80 percent of U.S. troops voted last year, the report by the Military Voter Protection Project (MVP) said. The low numbers were in part the result of complicated and mishandled federal enforcement, said Eric Loveland, MVP founder and author of the report.

“We’re 10 years into conflict now, and we still can’t seem to get the absentee voting things right,” Mr. Eversole said. “This needs to be a priority now. We can’t let our servicemen suffer another election.”

The State Board of Elections made it easier on Wednesday for overseas voters, including military voters, to register to vote.

The board voted to allow overseas voters, which could also include embassy employees and contractors working in Afghanistan, to fax a voter application to a Virginia registrar.

"These people don't have mail boxes on every corner," said Charles E. Judd, chairman of the State Board of Elections. The proposed rules change would take effect Sept. 1, if approved by the U.S. Justice Department.

Gov. Pat Quinn Sunday signed three bills to provide more protections for Illinois’ servicemembers and help injured veterans get the services they need.

These bills prevent Illinois utilities from cutting off heat to veterans and servicemembers during the winter months; extend the driver’s license renewal time for servicemembers returning from overseas or out-of-state; and create a fund to support public service announcements to increase awareness of veterans’ programs, a release from the governor’s office said.

Gov. Bev Perdue Monday signed into law model legislation that makes it easier for North Carolina military serving overseas to vote. Standing in front of dozens of National Guardsmen, Perdue said the legislation was part of North Carolina's efforts to become make the state military friendly.

The bill mandates that absentee ballots be sent at least 60 days before a general election to military overseas. It would also apply to civilians stations overseas.

The measure, which had bipartisan support in the legislature, follows a model law approved last year by the Uniform Law Commission. A report by the Pew Commission of the States in 2009, found that many military stationed overseas did not have time to vote.

In the final weeks of the 97th General Assembly regular session, state Rep. Chris Nybo (R-41, Elmhurst) was chief sponsor of Senate Bill 98, a measure to ensure disabled veterans residing in federally operated veterans homes and hospitals are able to exercise their right to vote. The bill unanimously passed the Illinois Senate and House and awaits the governor’s signature.

"Every veteran, especially those who are incapacitated, should be afforded the opportunity to exercise their right to vote,” Nybo said. “Given the sacrifices these men and women have made for our country and for our freedom, every means necessary should be employed to ensure their voices are heard in our democracy.”

National: Organisation appeals for expat Americans to stand up and be counted | Telegraph

The Overseas Vote Foundation (OVF), a not-for-profit group dedicated to helping Americans overseas take part in federal elections, began its “Counting Citizens” project in April this year.

Using the power of social media to spread the word, the group is appealing for expats to register on a dedicated website, and help the organisation produce a reliable estimate of the number of Americans currently living abroad

“At the moment, there no is no accurate up-to-date estimate of how many American citizens abroad there are or where they are,” said Susan Dzieduszycka-Suinat, the president of the OVF. “Expats are not included in the US census, and previous estimates have been very rough, and often non-official.

This Tuesday, the state House of Representatives is scheduled to vote on legislation from Secretary of State A. Ralph Mollis that would change Rhode Island's presidential primary calendar in order to ensure that military voters and others living overseas get their ballots faster.

The legislation is in response to the federal Military and Overseas Voter Empowerment (MOVE) Act, which requires states to mail ballots to overseas voters at least 45 days prior to an election.

S.B. 100 from San Antonio Dem Leticia Van de Putte, brings the state in line with federal law requiring federal ballots be delivered to military and overseas voters at least 45 days before the election. It preserves Texas' current March primary date, while lengthening any primary run-off by the 45 day requirement, to the fourth Tuesday in May.

Gov. John Hickenlooper signed a bill Friday that changes some election dates in Colorado so the state complies with a federal law aimed at giving military and others living overseas enough time to vote.

The bill Hickenlooper signed into law makes Colorado's primary elections and precinct caucuses happen earlier on even-numbered years and requires that mail-in ballots be delivered or mailed to military personnel serving overseas 45 days before an election so they have enough time to vote and have their ballots counted. It's part of a provision of the Military and Overseas Voter Act that Congress passed in 2009.

Before the new law, Colorado mailed out ballots to military and other voters overseas 30 days before elections.

Alabama Secretary of State Beth Chapman on June 1 praised the Alabama House of Representatives for passing the final version of a bill that would make it easier for military and overseas voters to vote while serving abroad.

Senate Bill 55, created by Chapman and Sen. Gerald Dial, R-Lineville, was approved with a 97-0 vote and now goes to Gov. Robert Bentley for approval.

The Alabama Legislature is creating new ways for the military and other Alabama voters who are overseas to return their ballots.

Currently, the military and other Alabama voters who are overseas can only use the mail to return an absentee ballot. The legislation allows them to use fax, a commercial carrier like UPS and FedEx, and secure electronic transmissions.

Questions as to whether Texas might move its primary from March into April appeared resolved late on Tuesday when the House amended a voting bill to keep the March primary intact. Turns out the uncertainty might not be over quite yet. Under the current arrangement, local May elections and early voting for primary runoffs would be just two days apart.

Senate Bill 100, which passed the House on third reading Wednesday, is aimed at trying to make it easier for military and overseas voters to cast absentee ballots. Federal law requires that Texas make the changes.

National: Defense Department offers $15 million to improve overseas voting | Stars and Stripes

Defense Department officials late last week announced more than $15 million in grants designed to improve how voter registration forms and absentee ballots are sent to overseas voters, in an effort to solve problems well in advance of the 2012 presidential election.

Bob Carey, director of the Federal Voting Assistance Program, said officials don’t have any set plans on how many grants they’ll award or exactly what the final projects will look like. The grants are open to state and local election officials, and the parameters call for using new technologies to decrease the delivery time for registration, ballot requests and changes of address.

Bills requiring local special elections to be held on general election days and bringing military voting guidelines in line with national standards passed the House Monday night.

The special election date bill, sponsored by Harry Warren, requires special elections – such as bond referendums – to be held when voters would also be going to the polls on general election dates. The military absentee bill, sponsored by Rep. Grier Martin, D-Wake, would align North Carolina’s law with national standards. It would set standards for electronic transmission of ballots.

State Rep. Mike Dovilla was serving in Iraq four years ago when he attempted to obtain an absentee ballot to vote in that year’s municipal elections. The Cleveland-area Republican said he submitted the paperwork to the board of elections but later was told he didn’t include all of the required information.

“Through no fault of my own, and despite a proactive effort to obtain a ballot, I was disenfranchised in that year in the municipal elections,” Dovilla said. “Since that time, I’ve vowed that if I were ever in a position to be able to address this public- policy challenge and prevent it from happening to others in the military service, I would do so.”

Mike Dovilla was deployed to Iraq in 2007, he wanted to cast a vote in that years municipal elections.While on leave, he sent in his application to the Cuyahoga County Board of Elections, and when the Navy veteran returned to Baghdad, he was told he had not provided some necessary information.

“The problem was there was incorrect information on the county’s web site at that time that didn’t specify the need to include those items,” said the Berea Republican. “As a result, by the time the additional correspondence went back and forth from the theater, the ballot didn’t arrive on time. In fact, I never received a ballot at all.”Since that time, I vowed that if I were ever in a position to be able to prevent this from happening to others in military service I would do so.” Dovilla joined Rep. Michael Stinziano, D-Columbus, today in introducing a bill designed to improve access to voting for members of Ohio’s military serving overseas and other overseas voters.

It’s hard for overseas servicemen and -women to vote back home in Alabama, but bills in the House and Senate will change that, the sponsor of a Senate bill said. The Senate by a 30-1 margin on Thursday approved a bill by Sen. Gerald Dial, R-Lineville, to create a 13-member Alabama Electronic Overseas Voting AdvisoryCommittee.

The committee would determine whether secure electronic absentee voting can be developed for Alabamians living and working overseas on election days. The secretary of state would have to establish, test and implement absentee overseas balloting by secure electronic means.
