Stanislaus County leaders have dismissed the balance owed for the recount of the Riverbank mayoral election of 2012. County officials entered an agreement last month with former mayor Virginia Madueño to dismiss a remaining balance of $3,250, with neither side admitting fault. After Madueño lost by 53 votes to Richard O’Brien last year, one of her supporters asked for the Dec. 10 recount, which was stopped after five hours because the results were not changing. Madueño was stunned when county elections sent her campaign an invoice six weeks later showing a $7,817 balance owed in addition to the $2,400 deposit paid the day of the recount. The Registrar of Voters’ total charges for counting about 500 ballots was $10,217, or $20 per ballot. The person who requests a recount is expected to pay for it, but the invoiced costs tend to vary from county to county in California. And critics have suggested that county registrars arbitrarily impose recount charges.

Dallas County commissioners voted 4-1 along party lines Tuesday to spend up to $275,000 fighting the state’s controversial voter ID law. But how equitable that contribution is compared with the amounts other plaintiffs chip in may never be known. The county is one of 15 parties, including the U.S. attorney general’s office, suing Texas over its photo identification requirement. That means Dallas County residents’ local, state and federal taxes are being used on both sides of the legal battle. Tuesday’s legal contract with Brazil & Dunn was the first time the public caught a glimpse of the potential cost of the lawsuit since commissioners narrowly agreed to join it last month. Commissioner Mike Cantrell, the court’s lone Republican, cast the only vote against the legal contract. Democratic Commissioner Elba Garcia voted against the lawsuit in August because potential costs weren’t yet disclosed. But Garcia joined her fellow Democrats on Tuesday and voted to support spending the money. The county will pay up to $275,000 to cover legal expenses that Brazil & Dunn incurs in the suit. It will not have to pay for any legal fees, such as the hours attorneys spend working on the case. If the county and its co-plaintiffs win the lawsuit and their attorneys are awarded legal fees and expenses, the county can recoup its $275,000.

Asking for a recount of an election could get a whole lot more expensive under a bill passed by the state House of Representatives on Thursday. Currently, a candidate requesting a recount must pay $10 per precinct to get a recount underway. Under the bill passed Thursday on a 95-9 vote, that amount would increase to $25 per precinct. And for candidates who lost by more than 50 votes, it would cost them $125 per precinct if they asked for a recount. The bill was drafted long before the election mess in Detroit, where the votes have been counted multiple times by city, county and state officials.

The head of the Licking County Board of Elections knows she’s in for a bumpy November after nearly half of the county’s voting locations were eliminated. “People are going to be upset, and I understand that,” said Director Sue Penick. “But we’re playing with their money and trying to ultimately be fiscally responsible with it. Hopefully, we’ve done that.” Most central Ohio counties have streamlined their precincts in recent years, and Licking County became the latest by announcing on Tuesday that it is eliminating 30 precincts and more than 20 polling locations. The move is expected to save about $20,000. Licking County will go from 125 precincts to 95, and consolidate 47 voting locations into 24 or 26 for the November election. The impetus, besides cost-cutting, was efficiency, Penick said. Seven precincts that served villages with fewer than 200 voters were consolidated into locations that now will serve a village/township split.

Wayne County elections workers are expected to begin their eighth day recounting ballots from disputed Detroit elections this morning, and little information is being made available on how much longer the recount will take — or how much it is costing. County officials said Monday that about 80% of the ballots have been counted. Paperwork then has to be completed after the count. Delphine Oden, Wayne County’s director of elections, declined to say Monday when she expected the recount to end. The recount was approved by the Wayne County Board of Canvassers, which is looking into allegations of fraud detailed in a petition filed by former mayoral candidate Tom Barrow. Barrow’s allegations include, among other things, that the number of applications for absentee ballots was lower than the number of absentee votes cast, and that similar handwriting appears on several ballots cast for former Detroit Medical Center CEO Mike Duggan, who will face Wayne County Sheriff Benny Napoleon in November’s general election. Carol Larkin, chair of the Wayne County Board of Canvassers, said the overall cost for the recount appears headed closer to $100,000 than the $500,000 price tag Barrow has suggested. “We won’t know the total until it’s done,” she said. “It is going to get costly, though.”

An elections reform bill passed by the General Assembly has drawn national attention for its shortening of early voting and Voter ID requirements. But little mention has been given to its impact on county coffers. A 15-page analysis by the legislature’s Fiscal Research Division says local election boards will spend $4 million statewide to hold an additional primary in early 2016 and $10.9 million to switch to paper ballots by 2018, as required under House Bill 589. Henderson County will spend around $500,000 to convert from its current touchscreen voting systems to optical scanners used to read paper ballots, special machines for the visually impaired and voting booths for privacy, elections officials estimate.

After Madison county voters took to the polls in a special election, two county jobs will not be merging into one job. County commissioners said the election cost taxpayers more than $300,000. “Special elections are always a big production,” said Probate Judge Tommy Ragland. On the ballot for the special election held Tuesday was a proposal to combine the county tax assessor and tax collector jobs into one.  Voters ultimately decided to keep the two jobs separate. “Everybody is needed in both offices,” said tax collector Lynda Hall. “There are over 175,000 parcels in this county that are supposed to be appraised annually, mapped and valued – and this is just in the assessor office.” After county commissioners said the election would cost taxpayers around $300,000, we started asking questions.

Gov. Chris Christie today vetoed a measure that would had New Jersey voters casting ballots on just one election day this fall: Oct. 16. “Moving the date of the general election has the potential to cause unnecessary voter confusion, as the general election takes place at the same time each year,” Christie said in his veto message of the bill to move the election (A4237). “While the bill would require the Secretary of State to provide appropriate notice regarding the date change, there is no guarantee that every voter would know that the general election had been moved to October.” After U.S. Sen. Frank Lautenberg (D-N.J.) died on June 3, Democrats wanted Christie to call the special election to fill his seat for Nov. 5 — the same day Christie and candidates for all 120 seats in the Legislature are on the ballot. Christie, however, called the Senate special election for Wednesday, Oct. 16. The special election is estimated to cost an extra $12 million. Democrats charged it was because he did not want to share the ballot with a high profile Senate race.

Madison County Probate Judge Tommy Ragland says this special election should cost around $300,000. Getting all those voting machines out there costs money.  For one, Ragland notes the county doesn’t own them.  The machines have to be rented from a private company, the ballots purchased from them as well.

The San Diego City Council unanimously voted to hold the special mayoral election on Tuesday, Nov. 19. Mayor Bob Filner recently resigned amid sexual harassment allegations and his last day will be Friday. City Council President Todd Gloria will fulfill duties of the mayor and Council President Pro Tem Sherri Lightner will lead council meetings in place of Gloria until a new mayor is elected. At least seven people have filed paperwork for candidacy, including former mayoral candidate Nathan Fletcher. Other San Diego leaders, including Gloria and Councilmember Kevin Faulconer, have also considered running. The estimated cost is roughly $6 million for a polls election, which was voted for in favor of a mail election.

Chances are the name on your voter registration card doesn’t match that on your driver’s license, and that could create some headaches come Election Day. A preliminary comparison of the 13.8 million names on the state’s voter registration rolls against Texas Department of Public Safety records resulted in a match of only 7 million of those names. The variation between the two documents could be as simple as the addition or dropping of a middle name or initial, but according to the state voter ID law that comes into play for the Nov. 5 election, the name on the voter card has to match exactly with that on the ID card. If a voting official deems the names “substantially similar” a voter is off the hook, sort of. He or she will still be required to sign an affidavit stating he/she is the person named in the two documents. However, if the voting official cannot readily make a connection between names, the voter will have to cast a provisional ballot, which takes longer to fill out and process. The state had recommended local election administrators send out letters to voters advising them their voter cards and IDs need to match, but the postage cost has made that prohibitive. With about 890,000 registered voters in Bexar County, that mailout would have cost more than $400,000.

The special election to replace outgoing Mayor Bob Filner will cost roughly $6 million and could force city leaders to tap reserves or make budget cuts in order to pay for it. The City Council voted unanimously Wednesday to set the special election for Nov. 19 as the city charter gave the panel zero wiggle room to choose a less-costly option. The voter-approved charter requires a special election if a mayor resigns with more than one year left on his term. Filner, who took office in December, has more than three years remaining on his term. If Filner had less than a year remaining, the council would have appointed a successor. Filner is scheduled to resign at 5 p.m. Friday in response to lurid allegations of inappropriate sexual behavior and unwanted advances toward nearly 20 women. The council accepted his signed resignation letter last week which allowed them to call a special election before he officially exits office.

Indiana: New voting machine purchase put on hold in Montgomery County | Journal Review

Montgomery County Commissioners tabled a request Monday from Montgomery County Clerk Jennifer Bentley for the purchase of new voting machines to be used in future voting centers. Cost of the machines is $231,140, and commissioners requested Bentley to approach the Montgomery County Council on Sept. 3 to see if they are willing to fund the acquisition. “I don’t see any reason for us to approve this request until we know the county council is willing to spend the money,” Commissioner Jim Fulwider said. Bentley responded by saying she has approximately $140,000 she can use to pay for the machines, but would need approval from the council for the other approximately $90,000.

The new director of elections in Richland County has yet to case a vote, but says his storage space for voting machines could hurt his ability to do so. “The county has done a good job of repairing the warehouse, however, it still leaks. There’s still insulation hanging from the roof,” said Howard Jackson.  “So, it’s not very good working conditions.” Jackson spoke about the conditions during an elections board meeting Tuesday.  He said members of county council and the County Administrator have toured the warehouse recently. The board didn’t advertise the location of the warehouse, saying security there is cause for concern.

Hinds County special election preparations will go on. That’s the bottom line after Hinds County District 1 Supervisor and board president Robert Graham and county Election Commission chair Connie Cochran met this morning. They reached an agreement for Cochran to do what the commission must do to get ready for Sept. 24 primaries, including preparing absentee and other ballots in time to meet state-mandated deadlines. The anticipated $67,000 cost wll be paid out of the Election Commission budget, and not from the county’s general fund, they agreed. Their action came after three days of wrangling by the board. Three members didn’t want to pay for the primary to fill District 2 and District 4 supervisor vacancies despite an attorney general’s opinion that makes it clear counties must fund special elections despite their ability to pay for it.

Despite an Attorney General’s opinion that makes it clear counties must pay for special elections despite their ability to pay for it, three Hinds County supervisors today would not vote to do that, furthering a three-day impasse and all but guaranteeing legal action from political parties. District 1 Supervisor and board president Robert Graham, District 5 Supervisor Kenneth Stokes and interim District 2 Supervisor Al Hunter didn’t ask board attorney Tony Gaylor to read the opinion delivered by fax at mid-morning today, instead voting to adjourn the meeting and abruptly walking out after Election Commission chair Connie Cochran told them there are plenty of public funds in the commission’s budget to cover the costs. That left District 3 Supervisor Peggy Hobson Calhoun and interim District 4 Supervisor Robert Walker sitting by themselves, with Calhoun offering her comments after being cut off by Graham when the vote to adjourn was taken.

The law says the state’s boards of supervisors must pay for all county elections. But that goes out the window, Hinds County District 5 Supervisor Kenneth Stokes says, if the election costs exceed what he believes the county can afford. He and two other board members voted to ask the Mississippi Attorney General’s office to rule on whether Hinds County has to pay, with Hinds County Election Commission members warning him that ballots by law must be printed out by Friday. Stokes’ train of thought prompted an immediate threat of a lawsuit by Hinds County Republican Executive Committee chair Pete Perry. Stokes got into a shouting match today with Perry, Hinds County Democratic Executive Committee head Jackie Norris, and the Hinds County Election Commission when he said the county doesn’t have the money to pay for primary elections in September to fill supervisor seats in Districts 2 and 4. It’s estimated that costs to run the primary will be about $67,000, and that’s after both Democratic and Republican parties sat at the table together and honed costs down from about $200,000.

Wisconsin: Dane County looks to cost share on voting machines | The Waunakee Tribune

With help from Dane County, Waunakee could be one of many municipalities replacing their vote tabulating machines by next year. Dane County Clerk Scott McDonell announced that the county would pay half of the cost to replace the machines, in a press release recently. The press release cites “reports of vote-counting machines smoking, sparking and breaking down during the last election” and urges municipalities to upgrade the equipment. While Waunakee Clerk Julee Helt has never witnessed such dramatic breakdowns in Waunakee’s machines, she does remember one snafu, she said. “We had one situation midday when we were off a number,” she said. “Sometimes, people get a ballot then decide they don’t want to vote for anybody.” But the clerks have to be accountable for each number they give out for a ballot.

Pueblo County reached out to the state to pay for a Sept. 10 recall election this week. But all County Clerk and Recorder Gilbert Ortiz got was a law lecture. Monday Ortiz sent a letter to Secretary of State Scott Gessler asking for the state to pay for an election on recalling state Sen. Angela Giron, a Democrat who riled up opponents earlier this year when she supported gun-control legislation. “Because of the last minute nature of the Recall Election, our Office does not have the money in our budget for these unexpected expenditures, nor does Pueblo County as a whole,” Ortiz stated in the one-paragraph letter. “Pueblo County has experienced recent emergency expenditures that have caused an unexpected financial burden to the County adding to our budgetary challenges and making additional funding from Pueblo County unlikely.” Clerk and Recorder Gilbert Ortiz told Secretary of State Scott Gessler that Pueblo County doesn’t have enough money in its budget to fund a Sept. 10 recall election.

Colorado Secretary of State Scott Gessler said Tuesday that his office doesn’t have legal authority to reimburse or fund Pueblo County’s recall election in September. Pueblo County Clerk and Recorder Gilbert “Bo” Ortiz sent a letter Monday to the governor’s and secretary of state’s offices, and to state Sen. Pat Steadman, D-Denver, chairman of the Joint Budget Committee, asking for advance payment for the election. State Sen. Angela Giron, D-Pueblo, is being recalled by gun-rights supporters who say she overreached in supporting gun legislation. If voters decide to recall her, George Rivera, a former Pueblo police deputy chief and Republican, will take her place in the Legislature. In his response, Gessler said: “This office does not have the legal authority to reimburse your office for the recall election in Senate District 3. Your office should, however, be able to reduce your costs by 25-40 percent based on El Paso County’s experience.”

Virginia: Caroline County approves new voting machines | The News Desk

The Caroline County Board of Supervisors Tuesday night approved the purchase of 11 new voting machines that will likely be installed before the November election. Members of the electoral board and the county’s voter registrar asked the board for $50,763 to purchase optical scan voting machines. The county currently uses touchscreen voting machines. John Nunnally, vice-chair of the electoral board, told the supervisors that all localities are facing an unfunded mandate from the state that they replace their machines with optical scan machines by 2016. That means that instead of touchscreen machines, voters would use a paper ballot and feed it into the optical scan machine. Nunnally said the change could cut down the time it takes to vote and reduce lines. The machines the county has now are about 10 years old and have problems that require more immediate replacement, according to a staff memo. Additionally, the memo says that if the county purchases the machines now, the county will get a better deal than waiting until 2016, when there is more competition and more localities are in the market for the machines.

Alabama’s new law requiring people to show a government-issued photo identification to vote is raising some concerns for Jefferson County officials. The law — to get around accusations that it’s a modern poll tax to make people buy ID — requires that the state have an option for a free ID. Jefferson County, which has more voters than any other county in the state, may be forced to come up with money to cover personnel and labor costs associated with producing new voter IDs, said Barry Stephenson, chairman of the Board of Registrars. “I want to do everything possible to help the voters and to have fair and honest elections,” Stephenson said. “However, I only have so many resources in my budget and the state has made no mention of reimbursing the counties for any personnel or labor costs associated with producing the new free identification cards.” The state is going to provide the equipment for the ID cards, “but that’s it,” Stephenson said.

With special elections to fill a vacant U.S. Senate seat fast approaching, Mercer County election officials received word yesterday that the state will reimburse their election expenses — but they are still trying to figure out how they will come up with the upfront costs of the balloting. “It looks like it’s going to cover the majority of the costs,” Mercer County Clerk Paula Sollami-Covello said. “It’s a very good thing and I was pleased to see the letter.” Mercer County’s costs for a primary next month and the special election in October are expected to approach $1.2 million. A letter from the Department of State says the state will cover costs such as ballot printing, board worker salaries, overtime for county or municipal election office staff, polling place rentals and voting machine transportation.

State reimbursement for the costs of the upcoming special primary and elections will not come until after October’s election is over, Hunterdon County Administrator Cynthia Yard told freeholders Tuesday. That means the county should be prepared to authorize and pay overtime for poll workers during both elections, Yard said. Though the board offered no protest, Freeholder Matthew Holt asked Yard to reassure him that poll workers would be closely monitoring their hours and expenses. “I just want to make sure they’re tracking that,” Holt said. …The state Office of Legislative Services projects both elections to cost about $24 million statewide.

Saying they will likely refuse to pay the $2.4 million costs associated with the special election to fill the U.S. Senate seat left vacant by the death of Frank Lautenberg, the Hudson County Board of Freeholders said at its July 11 meeting that they may force the state to take the county to court. The county is expected to use funds dedicated to the November regular election to cover the cost of the August primary and then inform the state it does not have the revenue to cover the remaining elections that include a special election in October, and a number of state and local elections in November. Freeholder Bill O’Dea said the county will explore its options, but will likely withhold payment for additional elections now that the budget for the year has been depleted by the cost of the August primary. Representatives from various county departments dealing with the election said the primary and the special election would cost about $1.2 million each.

Heads of state from the Economic Community of West African States, ECOWAS, are meeting this week in the Nigerian capital ahead of elections in Mali and Guinea-Bissau, two countries in turmoil. After the French-led invasion of northern Mali in January that wrested territories away from Islamist militant groups, nationwide presidential and parliamentary elections are scheduled for July 28.

Douglas County Clerk Jamie Shew is expecting about $32,500 in new costs for running elections next year, largely due to the state’s new voter identification laws. “I did build in some requests for anticipated costs for implementation of the new law,” Shew said. “I added additional temp employees who will be responsible for following up with voters to get documentation, additional printing for additional notices and mailings, and more postage, anticipating a large increase in mailings to voters.” Election officials are preparing for a busy 2014, when there will be races for governor and other statewide elected offices, as well as a U.S. Senate race, congressional races, and elections for the Kansas House of Representatives. The draft budget that county commissioners approved for publication last week includes about $350,000 for the clerk’s office in 2014. That’s an increase of $32,735, or about 10 percent, over the clerk’s budget in 2010, the most recent comparable election year. Most of that increase, Shew said, is related to the cost of implementing the new voter identification rule.

Jefferson County election officials are concerned about the impact of Alabama’s new voter photo ID law. Outgoing Sec. of State Beth Chapman announced the new requirement last week. It will start in January of 2014 where all voters will be required to present a voter photo ID before they vote. If a voter does not have an ID card, the state will provide a free one for them. “They mentioned they would provide the equipment and the paper but…I haven’t seen anything about actually covering the cost that we will incur,” Barry Stevenson, Chairman of the Jefferson County Board of Registrars said.

Court documents have shed light on the thousands of dollars several lawsuits between Dutchess County’s top election officials have cost taxpayers in legal fees. Three attorneys’ invoices could total $14,688 for expenses incurred while they filed and defended Dutchess County Democratic Election Commissioner Fran Knapp in lawsuits alleging violations of the state election law that requires the Democratic and Republican commissioners to act together on election-related matters. Taxpayers may be on the hook for thousands of dollars more. An appeal is being filed to overturn a May decision to dismiss a contempt-of-court charge against Republican Commissioner Erik Haight. Meanwhile, Haight’s attorney fees are pending court approval. Payments come out of the county Board of Elections’ budget, Knapp previously told the Journal. Knapp wasn’t immediately available for comment Wednesday.
