Every national election seems to yield a storyline for election administration - and yesterday's story, hands down, was the long lines that many voters faced at the polls. Just to be clear, when I say "long lines" I'm not talking about one-hour waits like the one I faced at my home polling place at lunchtime yesterday - I'm talking about epic waits, including those voters who, as the President was speaking just before 2am Eastern time, were still voting in Miami.

This is the day when voters raised on a reverence for democracy realize the utter disregard their leaders hold for that concept. The moment state and local officials around the country get elected, they stop caring about making it easy for their constituents to vote. Some do so deliberately, for partisan reasons, while others just don’t pay attention or decide they have bigger priorities. The result can be seen in the confusion, the breakdowns, and the agonizingly slow lines at thousands of precincts in almost every state.

He was referring to the issue of voting lines. Long, long voting lines. Across the nation yesterday, and then subsequently across Twitter and Facebook, U.S. citizens shared frustrations, photos and information about voting lines. The images of the long queues were a dime a dozen, especially when you looked at the #stayinline hashtag on Twitter. People in states like Florida and Ohio waited up to seven hours. In other states, there were shorter, though still-frustrating two- to three-hour waits. Some experts place the blame on high turnout, but many will tell you the culprit is technology – failed and faulty e-voting machine. Gone are the days of pulling the lever. Instead now there are two main voting systems: optical scan paper ballot systems and direct recording electronic systems (DREs). Very few jurisdictions still rely on punch cards and hand-counted paper ballots.

Electronic voting-machine jams, breakdowns, and glitches were strewn across the Election Night landscape, creating long lines when machines simply broke down. In at least one case, a viral YouTube video purported to show a Pennsylvania machine "flipping" a vote cast for President Obama into a vote for Mitt Romney. Vote flipping occurs when an e-voting touch-screen machine is not properly calibrated, so that a vote for Romney or Obama is flipped to the other candidate. While the Pennsylvania glitch was reported and the machine reportedly taken out of service and quickly recalibrated, other flipping was reported by news media accounts in Nevada, Texas, North Carolina, and Ohio.

The Supreme Court announced on Friday that it would take a fresh look at the constitutionality of the Voting Rights Act of 1965, one of the signature legacies of the civil rights movement. Three years ago, the court signaled that part of the law may no longer be needed, and the law’s challengers said the re-election of the nation’s first black president is proof that the nation has moved beyond the racial divisions that gave rise to efforts to protect the integrity of elections in the South. The law “is stuck in a Jim Crow-era time warp,” said Edward P. Blum, director of the Project on Fair Representation, a small legal foundation that helped organize the suit. Civil rights leaders, on the other hand, pointed to the role the law played in the recent election, with courts relying on it to block voter identification requirements and cutbacks on early voting.

"E-mail voting is insecure because it's hard to authenticate the voter, the ballots can be intercepted and changed, and the computer servers that store them can be hacked," Bloomberg reported. Additionally, the plan had provoked confusion among voters, as at first the state said no paper ballot was necessary, and later reneged, saying a mailed-in paper confirmation was also required.

The Republican National Committee on Thursday called upon Secretary of State Scott Gessler and elections officials elsewhere to look into reports of malfunctioning touch-screen voting machines that may be casting votes for Barack Obama when a voter meant to pick Mitt Romney. In Colorado, Republican officials pointed to a single example of a malfunctioning machine in Mesa County. The GOP asked that voting machines be recalibrated before the polls open Tuesday, that extra technicians be provided and that polling places remind voters to double-check before submitting their selections. In Arapahoe County, where touch-screen machines are the principal means of in-person voting, Clerk Nancy Doty, a Republican, said the request to recalibrate the machines on Election Day was unreasonable. "We have 650 machines," Doty said. "They've already been tested."

Florida: Glitch in Florida’s Voter Registration System can Disenfranchise Absentee Voters | electionsmith

A couple weeks ago, when we were investigating for our academic research patterns in rejection rates of absentee and provisional ballots cast in the August 14, 2012 primary election, we discovered some anomalies in the Florida statewide voter file. Upon further investigation, and after following up with some county Supervisors of Elections, we believe that we have found a troubling anomaly in Florida’s Voter Registration System. This oversight that we stumbled upon has the potential to disenfranchise registered voters who mailed in absentee ballots from their counties of residence and then subsequently updated their voter registration addresses with new information to reflect having moved.  By being vigilant and updating their voter registration information to reflect their current addresses, these voters risk becoming “self-disenfranchised.”

As the presidential race narrows in Ohio, the Buckeye State runs the risk of preventing the United States from calling a winner for days after the Nov. 6 election. A wild card in declaring a winner on Election Night could be thousands provisional ballots. Provisionals are given to voters when their eligibility is in question, often because of address changes or discrepancies. Election boards hold the ballots 10 days to determine eligibility. "If it's a really tight race, we could be in a position where we don't know [the winner] until provisional ballots are counted," said Edward Foley, director of Election Law @ Moritz, a program at the Ohio State University Moritz College of Law. "If Ohio is held up, and Ohio is essential to know who won, then the presidency is going to get held up."

On August 31st, one day after the Republican National Convention ended in Tampa, a federal judge in Ohio issued a ruling that stymied an effort by Republican officials there to limit early voting dates for hundreds of thousands of registered voters. Citing the United States Supreme Court's Bush v. Gore ruling, the 5-4 decision which ended the 2000 Florida recount, U.S. District Judge Peter Economus wrote that Ohio lawmakers and bureaucrats couldn't, by "arbitrary and disparate treatment, value one person's vote over that of another."

Rapid advances in the development of cyberweapons and malicious software mean that electronic-voting machines used in the 2012 election could be hacked, potentially tipping the presidential election or a number of other races. Since the machines are not connected to the Internet, any hack would not be a matter of someone sneaking through cyberspace to change ballots. Rather, the concern is that an individual hacker, a partisan group, or even a nation state could infect voting machines by gaining physical access to them or by targeting the companies that service them.

Folks, we are just a little more than two weeks away from Election Day, and we may well be the runaway train, barreling straight toward an election-night, voting-rights crash-and-burn which easily could be worse and more damaging to the nation than Bush v. Gore. Ernest Zirkle was puzzled. The resident of Fairfield Township in Cumberland County, NJ, ran for a seat on his local Democratic Executive Committee on June 7, 2011. The official results showed him earning only nine votes, compared to 34 votes for the winning candidate. But at least 28 people told Zirkle they voted for him. So he and his wife—who also ran for an open seat and lost—challenged the result in court. Eventually, a county election official admitted the result was due to a programming error. A security expert from Princeton was called in to examine the machines and make sure no foul play had occurred. Unfortunately, when he examined the equipment on August 17, 2011, he found someone deleted key files the previous day, making it impossible to investigate the cause of the malfunction. A new election was held on September 27, and the Zirkles won. A decade ago, there was a great deal of momentum toward paperless electronic voting. Spooked by the chaos of the 2000 presidential election in Florida, Congress unleashed a torrent of money to buy new high-tech machines. Today, momentum is in the opposite direction. Computer security researchers have convinced most observers that machines like the ones in Fairfield Township degrade the security and reliability of elections rather than enhancing them. Several states passed laws mandating an end to paperless elections. But bureaucratic inertia and tight budgets have slowed the pace at which these flawed machines can be retired.

Technology and process upgrades implemented since the controversial 2000 presidential election have made electronic voting machines more secure and reliable to use, the Caltech-MIT Voting Technology Project said in a report last week. Even so, the only way to ensure the integrity of votes cast with the systems is to have mandatory auditing of the results and of all voting technologies used in an election, the 85-page report cautioned. Rather than setting security standards for election equipment, the better approach for safeguarding ballot integrity is to hand-count a sufficiently large and random sample of the paper records of votes cast electronically, it said. A lifelong Democrat, she has voted in every Presidential election since she turned eighteen. So she was agitated when an official summons from the Hamilton County Board of Elections arrived in the mail last month. Hamilton County, which includes Cincinnati, is one of the most populous regions of the most fiercely contested state in the 2012 election. No Republican candidate has ever won the Presidency without carrying Ohio, and recent polls show Barack Obama and Mitt Romney almost even in the state. Every vote may matter, including those cast by the seven members of the Sharp family—Teresa, her husband, four grown children, and an elderly aunt—living in the Millsdale Street house. The letter, which cited arcane legal statutes and was printed on government letterhead, was dated September 4th. “You are hereby notified that your right to vote has been challenged by a qualified elector,” it said. “The Hamilton County Board of Elections has scheduled a hearing regarding your right to vote on Monday, September 10th, 2012, at 8:30 a.m. . . . You have the right to appear and testify, call witnesses and be represented by counsel.” “My first thought was, Oh, no!” Sharp, who is African-American, said. “They ain’t messing with us poor black folks! Who is challenging my right to vote?”

Arizona: Supreme Court voter ID case may shape the future | UPI

The fight over whether states can demand some sort of identification before allowing voters to cast ballots has finally reached the U.S. Supreme Court as the justices agreed to hear argument on Arizona's law requiring voters to show proof of U.S. citizenship before registering. In the heat of the final days of the U.S. presidential election the case is not drawing much attention. Any argument and decision in the case won't come until long after Election Day. And the arguments advanced by both sides in the case may seem as dry as unbuttered toast to the average American. The battle probably appeals mainly to political activists or Supreme Court wonks. But an eventual Supreme Court decision will help shape the voting landscape of the future.

Republicans and Democrats have long been concerned about how the vote will shake out in Arapahoe County — one of the key swing counties in an undecided state — and now they have one more thing to fear: an "I Voted" sticker. More than 230,000 ballots last week were mailed to Arapahoe County's voters in envelopes that possibly contained a participation sticker that rubbed up against the ballot and in some cases left a faint, near-linear mark that appeared exactly where voters draw a line to select their candidates.

When it comes to the integrity and accuracy of voting systems in the United States, the good news is that widespread technological upgrades have largely eliminated the voting-machine problems that were so evident when Florida's disputed recount determined the 2000 presidential election. The bad news is that some of those improvements in accuracy could be undermined by increases in early voting through the mail, which is turning out to be a relatively low-accuracy method of voting, according to a new research report released by MIT and the California Institute of Technology. "A lot of changes over the last decade have made voting in America better," says Charles Stewart III, the Kenan Sahin Distinguished Professor of Political Science at MIT, who co-authored the new report with five colleagues at four universities. "The possibility of a [situation like Florida's 2000 election] is much lower now than it was 12 years ago." However, Stewart adds, "We have possibly gotten way ahead of ourselves in encouraging people to vote by mail. It's pretty clear that the improvement we've gotten by having better voting machines in the precincts may be given back by having more and more people voting at home."
