A state senator announced Monday he will propose legislation to exempt senior citizens from the recently signed voter ID law. Sen. Tim Carpenter, D–Milwaukee, is currently looking for co-sponsors for the legislation, and expects to introduce the bill by the end of the week. The proposal would allow registered seniors who are above the age of 65 to vote without having to present any identification, according to a statement from Carpenter.

The voter ID law, signed by Gov. Scott Walker on May 25 of this year states that starting next year, all registered Wisconsin voters will be required to present a valid, state-issued identification card in order to vote in any election.

“The voter ID bill prevents election fraud by requiring that the voter prove that they actually are who they say they are. In the past if someone else next to me says, ‘yeah that’s who he is,’ [the election attendants] will believe it,” Andrew Welhouse, spokesperson for Senate Majority Leader Scott Fitzgerald said.

Dozens of community members lined up to cast fake ballots for their favorite sports teams and tailgating food Tuesday as part of a mock election conducted by the Madison City Clerk. The trial run was to prepare for the full implementation in 2012 of the Republican-backed voter ID bill.

City Clerk Maribeth Witzel-Behl said the city is making voter ID education a top priority throughout the rest of the year, with 74 educational presentations planned. The mock election was to prepare election officials as well as voters for what to expect on a future Election Day.

On Thursday, state election officials retracted changes which could have circulated recall petitions for the possible upcoming recall efforts more efficiently, including the effort to recall Gov. Scott Walker. At a meeting Thursday, the Joint Committee for Review of Administrative Rules oversaw several of the Government Accountability Board’s retracted plans to recall election operations, including the distribution of online petitions.

At the meeting, Kevin Kennedy, head of the GAB, said the rule changes previously sought would allow an individual to open a “petition for recall” online with both their name and address on the form, increasing the speed of the petition’s circulation. This petition would also be considered valid even if this individual was the only one to sign the petition, he said.

Kennedy said this proposition would have allowed for a faster process because groups would not have to gather the signatures face-to-face and the petition signers would not have to fill in their addresses.

On Monday, the Appleton Post Crescent wrote in an editorial that Nickolaus should be punished.The paper said it believes her mistake was “an honest mistake,” but that sometimes even those need to be punished.

Debate continues in Madison over Wisconsin’s new photo ID law.  It takes full effect in February, but some rules are not yet settled.  For instance, what identification should college students use?

As WUWM’s Ann-Elise Henzl reports, election officials are floating a new possible solution.  Wisconsin’s photo ID law allows college and university students to use their school IDs at the polls — with the exception of technical college IDs. The state presumes those students live nearby.

However, no student IDs in Wisconsin meet the new law’s requirements, according to the Government Accountability Board. Kevin Kennedy directs the non-partisan agency, which oversees elections. “The key elements that I think were missing in most cases were an issuance date, an expiration date that was within two years of that, and the student’s signature. Those were the key issues,” Kennedy says.

Officials with the Government Accountability Board have backed away from two controversial interpretations of election laws that some argued would have made it easier for college students to vote and political organizations to recall politicians.

The move, announced just prior to a meeting by the Legislature’s body that reviews agency rules, came in response to Republican concerns last week that the policies could lead to cases of voter fraud. The change by GAB officials led Democrats to immediately accuse the nonpartisan agency of succumbing to pressure by the majority party.

Reacting to a new state law that requires photo identification for voting, some state and local officials are pushing to waive the $20 fee for copies of Milwaukee County birth certificates.

Earlier this year, the Legislature adopted the voter ID law, which says voters must show one of several approved forms of photo identification – such as a driver’s license – at the polls, starting next year. For those who don’t have a driver’s license, lawmakers provided for the state Division of Motor Vehicles to waive fees for state ID cards at a voter’s request.

But applicants still need copies of their birth certificates to obtain either driver’s licenses or state ID cards. And state law sets fees of $20 for the first copy and $3 for subsequent copies. That’s $60 for a family with one voting-age child “to exercise the constitutional right of voting,” state Sen. Spencer Coggs (D-Milwaukee) told a Milwaukee Common Council committee Monday. “That just seems like it’s a poll tax.”

More than 9,000 students at UW-Milwaukee could be ineligible to vote in future Wisconsin elections without substantive modifications to university ID cards. Based on previous studies, The UWM Post estimates that 9,179 students, approximately 30 percent of the campus, do not have valid, state-issued driver’s licenses, a prerequisite to voting in upcoming elections.

Black students ages 18 to 24 will be impacted most by the Voter ID Bill, on average being 27.5 percent less likely than white students to have a Wisconsin driver license, according to a 2005 study conducted by UWM’s Employment and Training Institute.

Hispanic students ages 18 to 24 will also be impacted considerably, with Hispanic women being 28 percent less likely than white women to have a driver license, and Hispanic men being 17 percent less likely than white men. Junior Julio Guerrero, chairman of the Latino Caucus of the Democratic Party of Wisconsin, said the bill will have a negative impact for students and Latinos alike.

Republican lawmakers signaled Tuesday that they will likely give Gov. Scott Walker authority over how recall petitions can be gathered, just as Democrats gear up to recall him next year.

The move would allow Walker to halt a policy developed by nonpartisan election officials that, at least in theory, could make it easier for groups to gather signatures to recall the governor, as well as legislators from either party. “You have given the governor control of the chicken coop, so to say,” Sen. Lena Taylor (D-Milwaukee) told Republicans.

But GOP lawmakers raised concerns that election officials had gone too far with their interpretation of state laws and said the governor and lawmakers should have a chance to weigh in on them. Under the changes Republicans are considering, Walker would also get to decide whether universities can put stickers on their identification cards that would allow them to be used for voting.

There’s been a strong push as of late, by Republican legislators in the state and news media alike, to restrict the terms under which recall elections can occur. This call has come after an historic nine recall elections occurred this year alone, more than doubling the number of recalls that had previously been seen at the state legislative level.

… To alter the conditions of recalls would also ignore the intent of what recalls were all about. Our state constitution doesn’t limit why recalls can happen — in fact, no recall election at the legislative level has ever occurred on the bases or merits that the proposed constitutional amendment would restrict them under.

The state Government Accountability Board has concluded an investigation into the behavior of Waukesha County Clerk Kathy Nickolaus after the April election for state Supreme Court. The board says Nickolaus violated the law by not posting all returns on election night.

However, the board says her violation was not willful, and therefore did not constitute criminal misconduct. Initial results on election night posted by Nickolaus showed challenger JoAnne Kloppenburg with a narrow lead over Justice David Prosser.

Two days after the election, Nickolaus announced that she had previously failed to report 14,000 votes. With the additional votes turned in, Prosser pulled into the lead.

An independent investigation for the Government Accountability Board has found probable cause to believe that Waukesha County Clerk Kathy Nickolaus violated state election law on the night of the Supreme Court Election.  However, the investigator also found that the violation was not willful and therefore does not constitute criminal misconduct.

Nickolaus failed to report results from Brookfield on election night.  The failure led to an initial vote total that showed the race was too close to call.  Nickolaus caught the mistake before reporting final vote totals.

“It was pretty clear to me that there wasn’t fraud,” said, former Dane County Prosecutor Tim Verhoff who conducted the investigation.

Republican leaders are considering a move that could make it easier for Gov. Scott Walker to fight off a potential recall election in January.

The Legislature’s rules committee ended its meeting Tuesday without voting on two new Government Accountability Board (GAB) policies dealing with changes in technology and vagaries in the state’s new photo voter ID law. But the committee’s co-chairwoman said she heard enough testimony to warrant further investigation and possible action in the near future.

Sen. Leah Vukmir, R-Wauwatosa, said nothing she heard during the three-hour meeting allayed her fears about the new policies by the state’s election watchdog agency. Republican leaders say the rules endanger “clean, fair elections across the board in Wisconsin.”

The Fitzgerald brothers requested Monday that a legislative committee review the legality of a statewide policy that allows universities and colleges to put stickers on student identification cards for students to vote under Wisconsin’s new voter ID law.

The Wisconsin Government Accountability Board decided earlier this month to allow stickers on student IDs with the information now required to vote—an issuance date, a student signature and an expiration date—under the Republican-backed law.

This move came after critics of the law argued it would marginalize student voters originally from outside the state, because no Wisconsin college currently has IDs with the necessary details and the process to change IDs would be costly.

Milwaukee County prosecutors have opened a John Doe investigation into voter bribery allegations stemming from last month’s state Senate recall elections, according to sources.

Details of the secret investigation are sketchy, but it is clear the Milwaukee County district attorney’s office is investigating charges that Wisconsin Right to Life offered rewards for volunteers who signed up sympathetic voters in the recall races. Several people familiar with the investigation said subpoenas were being distributed “like candy.”

Prosecutors had earlier acknowledged that they also were looking into complaints about get-out-the-vote block parties sponsored by a liberal group, Wisconsin Jobs Now. But Assistant District Attorney Bruce Landgraf, who investigates election law violations, now won’t discuss either matter. “Absolutely no comment,” Landgraf said.

Democrats blasted Republicans on Tuesday for hastily convening a hearing on how state election officials plan to handle photo identification requirements for student voters and online recall petitions, accusing the GOP of using the process to put the decisions directly in Gov. Scott Walker’s hands.

The Republican-controlled Joint Committee for Review of Administrative Rules called a hearing on barely 24 hours’ notice to discuss the Government Accountability Board’s new policies on student IDs and downloadable recall petitions with an eye toward directing the board to adopt rules to its liking. The committee ultimately adjourned without taking any action.

Democrats on the committee questioned why the panel was even meeting and suggested Republicans who control it wanted to give Walker, a Republican who faces a potential recall push next year, the ability to make collecting signatures against him more difficult and suppress the student vote.

The Joint Committee on Administrative Rules will hold a hearing later today to review the GAB’s recent decisions on the state’s new voter ID law and recall petitions. Assembly Speaker Jeff Fitzgerald and Senate Majority Leader Scott Fitzgerald said they called on the committee to hold the hearing to ensure clean, fair elections. Both said they wanted to ensure election laws are properly enforced and interpreted in a non-partisan way.

“Wisconsin used to have a reputation for clean government, balanced budgets and real reform, but the recalls, the rhetoric, and the permanent campaign cycle have changed that,” said Scott Fitzgerald, R-Juneau, in the statement. “Restoring public trust can very easily be a bipartisan goal, and we have a process in place to make sure that this non-partisan board is enforcing the Legislature’s laws in a non-partisan way.”

Leaders in the Wisconsin Technical College System are fighting a ruling that student IDs issued by the state’s 16 technical colleges cannot be used to vote. Technical college officials are formally requesting that the Government Accountability Board reconsider its interpretation of a new voter ID law at its next meeting on Nov. 9.

The new law will take effect next year and requires residents to show a photo ID to vote. The board, which oversees elections in Wisconsin, clarified at a meeting earlier this month that University of Wisconsin System IDs could be used for voting – if they include all the required information – but technical college IDs could not.

In an email last week, Paul Gabriel, executive director of the Wisconsin Technical College System District Boards Association, put out a call to college leaders, staff, students and stakeholders to advocate for acceptance of technical college IDs.

Setting a higher threshold for recall elections in Wisconsin is a good idea. And while the devil will be in the details, and this has to be done right, a proposal from Reps. Robin Vos, Gary Tauchen and Paul Farrow at least offers a starting point.

Wisconsin was host to a record number of recall elections this summer, all stemming from the controversy surrounding Gov. Scott Walker’s budget-repair and budget bills earlier this year. Six Republicans and three Democrats were the subjects of recalls – the Republicans generally because they had favored Walker’s proposals, the Democrats generally because they had left the state to delay action on the proposals.

The recalls were unwarranted. A vote or stance on one issue is not sufficient in our view to justify the expense of a recall election. And they were expensive: The elections cost the state and local governments $2.1 million; the opposing sides in those campaigns spent a record $44 million, with Democrats and their allies outspending Republicans by just under $3 million, or about 14%.

Republican State Representative Robin Vos wants to change the state constitution so that a summer of political turmoil like the one we just had could never happen again.

The epic showdowns over collective bargaining, and the budget spurred a series of summer recall elections. State Democrats picked up two senate seats, but failed to change the balance of power. Under Rep. Vos’s proposal, a recall could only happen if a lawmaker were to commit a felony or an ethics violation. He says, “All we’re saying is you have to have committed a breach of trust, not a difference of opinion.”

Did telling the truth about free voter ID cards get Chris Larsen fired? Larsen, who worked as a mail room employee at Wisconsin’s Department of Public Safety and Professional Services, was fired just hours after sending an email informing his colleagues about the Department of Transportation’s policy regarding free voter IDs. That policy? Only offer the free ID if someone asks for it—otherwise, charge the normal $28 fee.

Larsen described his firing to Campus Progress: “They asked why I sent the email. I said I felt people should be informed. They said it was inappropriate and [DSPS Secretary] Dave Ross would be upset, and they felt it was best if we parted ways.”

But John Murray, executive assistant at the DSPS, says Larsen “had a series of workplace violations, including inappropriate use of email resources” and that Larsen had been counseled on these violations.

Wisconsin republicans support new legislation that would change how long you would have to vote absentee in person.  The proposal cuts the time frame from three weeks to two.  One election specialist talked about the impact she expects.

“We’re expecting more through the mail, and we’re expecting to have more employees on staff to handle absentee voting the last two weeks because we anticipate the numbers being up,” says Eau Claire Election Specialist Cheryl Brunner. One local republican says it’s important to approve this bill alongside the voter ID changes to protect against fraud.

There’s a solution in place to help address a concern of the new Voter ID Law.  To meet requirements of the new law, many universities have been worried they’d have to spend tens of thousands of dollars to update all student IDs.

Earlier this week, a solution was approved.  Universities will be able to issue students a sticker to place on their ID.  “They approached us about the idea of having special stickers that universities would issue that would bear the university’s logo and have a signature and the issuance and expiration dates,” says Reid Magney, Government Accountability Board spokesman.

However, not all student IDs work under the new law.  IDs issued to students at technical colleges are not valid.

The Government Accountability Board, which runs state elections, unanimously adopted a policy Monday that said schools could put stickers on existing IDs to include the information needed to make the IDs compliant with the voter ID law. That could save public and private schools money by not having to completely overhaul their IDs.

However, the board discussion highlighted the difficulties students may find in using their student IDs to vote – sticker or not. For one thing, voters who present a proper student ID would still have to show proof they were currently enrolled at the school. Those using other types of IDs, such as Wisconsin driver’s licenses, would not have to prove they were enrolled at the school.

A new law that goes into effect next year will require voters to show photo IDs at the polls and allow only very limited types of student IDs from Wisconsin institutions. Few if any of those schools currently issue IDs that comply with the law, which says the IDs must expire within two years of being issued, include the expiration date and include a signature. The sticker could help meet those requirements. Nevertheless, only IDs from certain types of institutions would be accepted. IDs issued by technical colleges, for example, are not valid for voting.

Chris Larsen, a low-level Wisconsin state employee, was fired for the apparent cause of using his work e-mail to mock and disparage state policy to his co-workers, the Milwaukee Journal Sentinel reports. The policy in question: The state’s decision for DMV employees to not tell citizens about the availability of free photo identification to satisfy the state’s new Voter-ID law, unless they ask first.

Larsen, a limited-term employee at the state Department of Safety and Professional Services, sent this e-mail Thursday morning to colleagues, encouraging them to tell all their friends about the free ID cards:

“Do you know someone who votes that does not have a State ID that meets requirements to vote? Tell them they can go to the DMV/DOT and get a free ID card. However they must ask for the free ID. a memo was sent out by the 3rd in command of the DMV/DOT. The memo specifically told the employees at the DMV/DOT not to inform individuals that the ID’s are free. So if the individuals seeking to get the free ID does not ask for a free ID, they will have to pay for it!!

“Just wanted everyone to be informed!! REMEMBER TO TELL ANYONE YOU KNOW!! ANYONE!! EVEN IF THEY DON’T NEED THE FREE ID, THEY MAY KNOW SOMEONE THAT DOES!! SO TELL EVERYONE YOU KNOW!!”

He was subsequently fired for misuse of e-mail.

People opposed to Wisconsin’s voter identification law are concerned about an internal memo circulated to Department of Motor Vehicles employees in July. WisDot Executive Assistant Steve Krieser said in an interview that the memo instructed customer service representatives to comply with state law and only issue a photo identification card for free if it was specifically asked for by the customer.

Kreiser said the law states, “we have to charge people the regular $28 rate (for photo identification) unless customers come in and request it, and certify that they need it for the purpose of voting.”

Kreiser said customers have been purchasing photo identification long before the new law went into effect. He said those looking for the cards for any other reason besides voting need to pay the fee. He also said as long as a customer actively seeks a free photo ID, workers at the DMV will help them.

An internal memo from a top Department of Transportation official instructs workers at Division of Motor Vehicles service centers not to tell members of the public that they can obtain voter identification cards free of charge — unless they know to ask for it.

The memo, recently obtained by The Capital Times, was written by Steve Krieser and sent to all state Department of Transportation and Department of Motor Vehicles employees on July 1, the same day employees were to begin issuing photo IDs in accordance with a controversial new Voter Photo ID law adopted earlier in the year.

As laid out in the memo, failure to check a box when applying for photo ID with the Division of Motor Vehicles will result in the payment of $28. Interviews conducted about the memo suggest the state is more interested in continuing to charge the fee, which is required for a photo ID used for non-voting purposes, than it is in removing all barriers and providing easy access to a free, photo ID.

The Wisconsin state bar civil rights section’s chairwoman wants the U.S. Department of Justice to review the state’s new voter photo identification law and monitor its implementation.

In an Aug. 26 letter to Attorney General Eric Holder released Wednesday, Sally Stix says the law could potentially suppress the vote of thousands of Wisconsin residents without solving any voter fraud problems.

In a possible recall election, are Gov. Scott Walker and Lt. Gov. Rebecca Kleefisch a package deal or separate tickets? It’s an unprecedented question for an unprecedented period in Wisconsin politics, and so far there’s no official answer. The Government Accountability Board, which runs state elections, won’t yet weigh in, saying that it’s still researching the issue.

“It’s the unanswered question that somebody needs to provide some guidance on,” said Mike Wittenwyler, a Madison election and campaign finance attorney. “To me, it’s an issue that deserves serious study before this begins.”

So far, any talk of a recall of Walker or Kleefisch by Democrats and unions is just that – neither official is even eligible for recall until early November, one year after they were elected to office. To do it, recall organizers would need to gather a whopping 540,208 signatures across the state within 60 days and then back a pair of candidates in a costly statewide election.

The League of Women Voters of Wisconsin Education Fund will challenge Wisconsin’s new Voter ID law based on the state constitution. As a nonpartisan organization that encourages participation in government, the league is concerned about voter disenfranchisement and as a result is is working with Attorney Lester Pines of Cullen Weston Pines & Bach to challenge the legislature’s authority to enact the law.

“The League of Women Voters has been fighting for open and fair elections ever since its founding by the suffragists who won the right to vote for women in 1920. Our Wisconsin state constitution specifically protects the right to vote and limits what the legislature can do to exclude eligible citizens,” said Melanie G. Ramey, president of the Wisconsin League of Women Voters.
