Sen. Curt Bramble calls the “Count My Vote” initiative a “gun to the head” of Utah’s political parties. If the CMV initiative gets on the ballot and passes in November, it would do away with the state’s caucus and convention system for nominating candidates in favor of a direct primary. Bramble says CMV backers and Utah’s political parties were unable to find a middle ground, so that’s why he’s sponsoring SB 54, which is a compromise between the two positions - and would essentially make the "Count My Vote" initiative a moot point. “The best kind of political compromise is where both sides can claim victory,” Bramble told a packed Senate committee hearing room on Friday morning. “I crafted this bill so that both sides don’t get what they want. Under the legislation, ‘Count My Vote’ gets what they were asking for from the parties, while the parties get to keep the caucus system if they meet certain criteria.”

Last month, the big news coming out of Utah Republican Party State Central Committee meeting was the race to replace former Attorney General John Swallow. But, the group also changed a key rule in its caucus system for nominating candidates. The SCC voted to allow a caucus attendee to bring same-day ballots to a caucus meeting on behalf of three others. Utah Republican Party Secretary Michelle Mumford believes the “Count My Vote” citizen’s initiative prompted the change. “I think that’s great,” she said. “Voluntary reforms from within always have the greater, longer-lasting, positive effect. I welcome the catalyst that CMV has become.” Right now, the caucus system allows candidates at party conventions with enough votes from delegates chosen at those caucus meetings to qualify for the general ballot. CMV would trash that system by allowing any candidate who gets signatures from 2 percent of his party’s registered voters in his district, or office, to get on the ballot.

Just days after Utah Attorney General John Swallow announced his retirement the Utah Democratic Party is taking issue with the governor's office. The Democrats are calling the process of finding a new attorney general unconstitutional. As it stands right now, the governor will appoint a new attorney general once Swallow is done next week, but the democrats instead want Swallow's election thrown out and are calling for a special election.  Can an elected official resign from an office that they never legally held?  That is the question that the Utah state Democratic Party takes issue with in the case of Utah Attorney General John Swallow.

Utah will have a new Attorney General by next month. Gov. Gary Herbert said he has the power to hand pick John Swallow’s successor, but the minority party in the state says not so fast. Senator Jim Dabakis, D- District 2, is the chair of the State Democratic Party, and he said Democrats plan on suing. They want last year’s election to be invalidated and think a state judge will ultimately side with them. “We will be going to court,” Dabakis said. He is taking the fight to the top, a judge. He believes the Lt. Governor’s report proves the election is invalid.

In the Wasatch County town of Wallsburg, the city employee responsible for oversight of elections brought new meaning to the job description by overlooking the election altogether. The new recorder in the town of about 275 just east of Deer Creek Reservoir forgot to announce the opening of the filing period or arrange to hold an election Nov. 5, when voters across the state cast their ballots in municipal elections. By the time the oversight was caught shortly before Election Day, it was too late to field candidates and hold the balloting on the fly. "Wallsburg never advertised or prepared for an election this year, so no one signed up," said Wasatch County Clerk Brent Titcomb. "They’re going to have to appoint the current mayor and council for two more years and they’ll advertise and have people elected [in 2015]."

Two cities in Salt Lake County that agreed to be test cases for voting by mail recorded higher turnout in their municipal elections than most other cities across the state. "I'd like to think that we had great voter turnout because we had great candidates and they wanted to vote for the mayor. I would like to think that, but I know better," said reelected Cottonwood Heights Mayor Kelvyn Cullimore, Jr. "We had the opportunity to be one of the test cases for voting by mail, and we thought that was a great opportunity to engage our citizens more than is typical in a municipal election." Cullimore and city council members approved the vote-by-mail election this year, after the county asked them if they were interested. The turnout in Cottonwood Heights was about double what previous municipal election in the city have yielded, according to Cullimore. "We had 40 percent voter turnout, and that was incredible for a municipal election," Cullimore said. The other test case in Salt Lake County, West Jordan, saw 30 percent turnout, as voters weighed in on a nearly $500 million Jordan School District Bond.

Republicans have taken "a great first step" toward improving Utah's unique system for selecting party nominees by approving absentee ballots and other changes, state GOP Chairman James Evans said Monday. The changes were made by the Utah Republican Party Central Committee on Saturday, the same day the Count My Vote initiative petition drive to replace the nominating system with a direct primary election began collecting signatures. Evans described the initiative as the "agitation" that prompted action. "These were changes that were certainly needed," he said. "I think the fact that Count My Vote is pushing to eliminate the caucus system, most certainly the party has taken note."

But party insiders pledged to spend the next year exploring improvements — including a possible hybrid system that could set a lower vote threshold at convention to allow candidates onto a primary ballot. "There is nothing built in and I anticipate tremendous dialogue now," Democratic Chairman Jim Dabakis said after the vote. "My sense is people want more primaries. This preserves that option."

Mike Leavitt is among the prominent Republicans in the group Count My Vote, which wants to increase the number of votes required in a nominating convention before a candidate can forgo a primary. GOP delegates rejected proposals on Saturday to raise the current 60 percent threshold to either 66.6 percent or 70 percent.

A bill to allow Election Day voter registration died Thursday — ironically killed by election officials who worried that it could work too well, and cause them too much work, in a state that has among the worst voter turnout in the nation. HB91 died on a 10-18 vote in the Senate, after earlier passing the House 58-14. Most of the opposition cited was from county clerks who said it could create more work than they could now handle between when votes are cast and when counts must be finalized. Sen. Scott Jenkins, R-Plain City, Senate sponsor of the bill, tried to overcome that by amending the bill to delay enactment for two years to give clerks time to prepare. Another amendment was added to sunset the bill after another two years — unless lawmakers decided it worked well enough to extend.

A bill making it possible to register and vote in Utah on the day of an election has been forwarded to the House for further review. HB 91 changes the way provisional ballots would be handled for those who have never before registered to vote in Utah and opens the door for voters to register and vote on Election Day. Bill sponsor Rep. Rebecca Chavez-Houck, D-Salt Lake City, said these provisional ballots would only be counted once the voters were determined to be eligible. Utah has one of the lowest percentages of voter turnouts in the U.S., the representative says.\ “What I am proposing is that we move the line and allow a broader spectrum of individuals to vote,” Chavez-Houck said. Under existing state law, a resident who has not registered to vote is given a provisional ballot, if they show up at the polls on Election Day. The provisional ballot serves as a registration mechanism, but is not counted among final election results.

A bill attempting to make the requirements for a candidate to seek a recount consistent throughout the state passed the House Tuesday and now goes to the Senate. Rep. Craig Hall, R-West Valley, the sponsor of HB85, said the current law allowing recounts only if a candidate loses by no more than one vote per precinct is "bad policy." He said that the number of precincts in legislative districts, for example, varies from 16 to 56.

HB85 would amend the state election code by changing the formula for determining when a voting recount may be requested by a losing candidate. Craig Hall, R-West Valley City, would change the recount criteria to 0.25 percent of total number of votes cast.

The House Government Operations Committee voted 4-3 Wednesday against the bill, after its sponsor, State Representative Patrice Arent, D-Millcreek, said a single vote breeds confusion. “Someone walked up to me at the grocery store the other day and said, ‘I was thrilled to have voted for you this year,’”Arent recounted in a 2News interview, and during testimony before the panel.  “And I said, ‘Great.’  And she said, ‘Yeah, I voted straight ticket Republican.’  And I said, ‘No, you didn’t actually vote for me.’”

A state senator from Utah County spent much of Election Day trying to sort out a problem with early-voting ballots. It seems the Utah County Clerk's Office mistakenly mailed duplicate ballots to a number of registered voters, raising questions about how the early-voting process was being managed and how to prevent multiple votes from one person. Sen. Curt Bramble on Tuesday evening told the Daily Herald that duplicate ballots had been mailed through a private fulfillment company using mailing lists provided by the county. Each ballot had a unique serial number, which means that each was legal tender for voting purposes. That raises the question of control. Were any safeguards in place to prevent someone from voting twice?

Prior to the Primary Elections on June 26, the Summit County Clerk's Office is unveiling a slew of online features to make registering to vote, finding a polling location or previewing the ballot even easier. According to Summit County Deputy Clerk Ryan Cowley, anyone who has a current Utah driver's license can register to vote online, change their registration information or request an absentee ballot. Residents can also download a voter app to their smart phones or tablets that uses their current location to locate the proper polling place and give them directions. "If someone is in college, or away, they can just go online to request an absentee ballot and even track its delivery," Cowley said. "It makes the process a lot easier and may encourage residents to get absentee ballots and vote."

Veteran U.S. Senator Orrin Hatch of Utah will face a Republican primary fight after delegates to a party convention on Saturday denied him the nomination, forcing him into an election with a Tea Party-backed challenger who finished second. Hatch, 78, won the day over nine challengers, but narrowly fell short of reaching the 60 percent of the vote needed in a pairing against his number two challenger, Dan Liljenquist, to win the nomination outright and avoid the primary, Reuters reported. Heavily Republican Utah last elected a Democrat to the U.S. Senate more than four decades ago, so the Republican nominee is usually considered the presumptive winner of the general election. The nominating convention held in Sandy, Utah, marked a test for the continuing strength of Tea Party activists, who played a decisive role nationally in the 2010 mid-term elections and helped unseat then-Republican Senator Bob Bennett of Utah. In a final delegate vote on Saturday, Hatch took 59.2 percent of the votes to 40.8 percent for Liljenquist, a former state senator with a Tea Party following. Hatch was only 32 delegates short of getting the required 60 percent vote that would have allowed him to avoid a primary contest. A total of 3,908 delegates participated. In the first round, eight challengers were eliminated.

Brian Jenkins, who is running against U.S. Congressman Jason Chaffetz, says he is upset about the possibility of electronic voting being used at the upcoming Republican state convention. Jenkins says the electronic method can be manipulated and he’s worried about the inability to check the votes after they are cast. “I actually think that if we can verify, there won’t be any skullduggery,there won’t be any kind of cheating if there is true verification,” Jenkins says. ” But if there is not verification the temptation to alter the outcome is almost irresistible.”

Utah could move toward voting by mail in upcoming elections under a bill that passed the House and is awaiting action in the Senate. HB172, sponsored by Rep. Steve Eliason, R-Sandy, would allow county clerks to conduct voting by mail, if they choose. It also directs the Lieutenant Governor’s Office to study how the state could move to vote by mail by 2015. Eliason noted that Utah has some of the nation’s worst voter-participation rates and said that studies have shown that vote-by-mail programs could increase turnout by as much as 40 percent.

The Navajo Nation has filed suit in U.S. District Court for Utah, alleging that San Juan County is attempting to keep Navajos from capturing a second seat on the county’s three-member commission by failing to redraw voting districts to reflect the 2010 U.S. Census. The suit, filed Thursday in Salt Lake City, alleges that San Juan County is in violation of the Equal Protection Clause of the 14th Amendment and in violation of the 1973 Voting Rights Act by ensuring that non-Indian voters hold majorities in two of the county’s three voting districts.

County officials recounted the ballots cast for the Provo Municipal Council District 1 Tuesday morning, but the discrepancy between the recount total and the total from election night became so large that officials stopped the counting process. There will be a recount by hand at 10 a.m. today in the Utah County Commission conference room in the Utah County Administration Building, 100 E. Center St.

"They did a recount and the numbers came out so extremely in favor of the opposite candidate that there appears to be something wrong with the machine," said Helen Anderson, spokeswoman for Provo city.

Only three candidates filed for three available City Council positions in the Nov. 8 election. "In a small city sometimes you beg for candidates," said Carolyn Jorgensen, the city's clerk/treasurer. So Castle Dale took advantage of a new state law that allows cities and towns to cancel municipal elections if it would not affect the outcome. Altogether, 38 Utah cities and towns have cancelled their municipal election for the same reason.

State Elections Director Mark Thomas estimates savings to the mostly smaller communities will total almost $250,000. Castle Dale hasn't calculated how much its savings will be, but the cost of holding an election where the outcome is already known is what led communities to ask Lt. Gov. Greg Bell, the state's top elections official, to push for a provision that would allow municipalities to cancel those elections.

Five Utah cities are taking advantage of a new law that allows them to cancel municipal elections when the number of candidates for at-large seats does not exceed the number of positions available. Providence and Cornish in Cache County, Fielding in Box Elder County, Marriott-Slaterville in Weber County and Beaver in Beaver County all fit that profile and have chosen not to hold November elections.

Providence had four candidates file for three City Council positions. But then incumbent David Low withdrew, leaving incumbents Bill Bagley and John Russel and newcomer Ralph Call on the ballot.

But other than being able to advance candidates to a November general election through a nominating convention -- a process that Fruit Heights uses -- the state election code offers little flexibility for cities trying to reduce election costs.

However, efforts are being made at the county level to consolidate municipalities' polling locations, and there are rumblings at the state Capitol that lawmakers during the 2012 legislative session may look at changes in the state's election code. "Cost is certainly an issue," State Director of Elections Mark Thomas said of lawmakers' interest in revisiting the code. "But it shouldn't be the No. 1 issue."
