Voting Blogs: The Effects of Florida’s HB1355 Early Voting Law on Turnout | electionsmith

As was reported widely in the press, if not entirely accurately, last Thursday night a Washington, DC, panel of federal judges handed down a unanimous ruling that restrictions placed on early voting in Florida should continue not to be implemented in the five counties covered by Section 5 of the 1975 amendments to the 1965 Voting Rights Act.  Florida, said the judges, “has failed to satisfy its burden of proving that those changes will not have a retrogressive effect on minority voters.” With respect to early voting, House Bill 1355–which was passed on party line votes by the Florida legislature and signed into law by Republican Governor Rick Scott in May 2011–is likely to have a differential impact it is likely to have on racial and ethnic minority voters in the 2012 general election.  In addition to my testimony before the US Senate on the topic, I’ve co-authored with Professor Michael Herron of Dartmouth College a soon-to-be published article in Election Law Journal that reveals the heavy reliance of early voting by minorities in the 2008 general election.  We found that in the 10 Florida counties that offered voting on the final Sunday of early voting in 2008, there was a surge in turnout among minority voters, especially African Americans.  That final Sunday of voting was eliminated under HB1355. Since then, Florida voters have participated in two statewide primary elections in 2012 under a dual system of elections, which very well may violate state law.

A federal court says a Florida law that restricts the number of early-voting days could result in a dramatic reduction in participation by blacks. The Republican-controlled Florida legislature last year cut the number of early-voting days to 8 from 12. But the U.S. District Court for the District of Columbia ruled late Thursday that because of the law’s potential impact on minority voters, it would not allow Florida to put the changes in place in five Florida counties covered by federal voting laws.

The law’s Republican backers and, they say, the integrity of the Nov. 6 presidential election were the winners of Wednesday’s decision by a state appellate judge to reject an injunction that would have halted the law from taking effect in November, as part of a wider challenge to its constitutionality. About a dozen rights groups and registered voters filed an appeal Thursday. Democrats say the law will trample the right to vote for countless people in an echo of the now-unconstitutional poll taxes and literacy tests once designed to discriminate against poor and minority voters. The GOP-penned law, signed by Republican Gov. Tom Corbett in March and opposed by every Democratic lawmaker, has ignited a furious debate over voting rights in Pennsylvania, which is poised to play a starring role in deciding the presidential contest.
Lawyers are asking the state’s highest court for a speedy review of the appeal, requesting that oral arguments be scheduled during the court’s session in Philadelphia the week of Sept. 10.

Defenders of the right to vote have a new high-tech weapon in their arsenal. A consortium of civil rights groups unveiled a smartphone application Thursday as part of a comprehensive strategy to combat what it called a nationwide effort to disenfranchise minority and youth voters. “The Election Protection smartphone app is a dynamic tool that will educate voters on their rights and empower them to take action so they can vote,” said Barbara Arnwine, executive director of the Lawyers’ Committee for Civil Rights Under Law, on a Thursday conference call with other organizations that developed the app. The free app is a “critical tool in our fight against voter suppression,” Arwine said, referring to recent state voter identification laws that aroused concerns among civil rights advocates. The tool gives voters the ability to digitally verify their registration status, find their polling place, encourage their friends and family to vote, fill out voter registration forms, and contact election protection officials, amongst other means to encourage voting.

Partisan legal showdowns in battleground states over a spate of new voting laws could turn the 2012 elections into a repeat of the 2000 presidential vote recount saga, political experts say. “Whenever you change the rules by enacting new laws, it triggers a round of litigation. I don’t think we’ll see an end to this anytime soon,” said Dan Tokaji, an Ohio State University law professor. “It could come down to the states counting of absentee ballots. … We could see a replay of the 2000 election, where we don’t have a winner for weeks.” This year’s fight has gotten ugly, especially in the hotly contested states of Florida and Pennsylvania, where there are high-profile fights over new voter identification laws, and Ohio, where President Barack Obama’s and Republican presidential candidate Mitt Romney’s campaigns are locked in a showdown over early voting. According to the Brennan Center for Justice, a legal think tank at the New York University School of Law that has criticized the increase in what it sees as prohibitive voting laws, 16 states have passed measures “that have the potential to impact the 2012 election.” The endgame, political experts say, is all about parties crafting laws to help ensure that their side wins.

On Election Day 2004, long lines and widespread electoral dysfunctional marred the results of thepresidential election in Ohio, whose electoral votes ended up handing George W. Bush a second term. “The misallocation of voting machines led to unprecedented long lines that disenfranchised scores, if not hundreds of thousands, of predominantly minority and Democratic voters,” found a post-election report by Democrats on the House Judiciary Committee. According to one survey, 174,000 Ohioans, 3 percent of the electorate, left their polling place without voting because of the interminable wait. (Bush won the state by only 118,000 votes). After 2004, Ohio reformed its electoral process by adding thirty-five days of early voting before Election Day, which led to a much smoother voting experience in 2008. The Obama campaign used this extra time to successfully mobilize its supporters, building a massive lead among early voters than John McCain could not overcome on Election Day. In response to the 2008 election results, Ohio Republicans drastically curtailed the early voting period in 2012 from thirty-five to eleven days, with no voting on the Sunday before the election, when African-American churches historically rally their congregants to go to the polls. (Ohio was one of five states to cut back on early voting since 2010.) Voting rights activists subsequently gathered enough signatures to block the new voting restrictions and force a referendum on Election Day. In reaction, Ohio Republicans repealed their own bill in the state legislature, but kept a ban on early voting three days before Election Day (a period when 93,000 Ohioans voted in 2008), adding an exception for active duty members of the military, who tend to lean Republican. (The Obama campaign is now challenging the law in court, seeking to expand early voting for all Ohioans).

Whyatt Mondesire, president of the Philadelphia chapter of the NAACP, said at Bright Hope Baptist Church in North Philadelphia. Researcher Tamara Manik-Perlman conducted a geographic analysis of voter data from Singer’s office, Pennsylvania’s Department of State, and the 2010 census. Manik-Perlman, who works at the Philadelphia-based geographic data analysis firm Azavea, conducted the analysis free over a day and a half. She reported a strong statistical relationship between certain racial groups and the percentage of the population without valid driver’s licenses or other state Department of Transportation ID that would qualify under the new law.

From redistricting to voter ID, the Texas government and the federal government haven’t exactly seen eye-to-eye lately. There are more than 13 million registered voters in Texas, roughly 71 percent of the voting age population, however, there’s a fight brewing over exactly who can register the rest. At issue are a handful of components of current Texas law, from a pair of items passed during the last session to legislation dating to the mid-1980s. One element keeps third-party voter registration groups from working in more than one county. Another specifies only Texas residents can register voters. Other elements include legislation to keep registrars from being paid in relation to the number they sign up, from photocopying registration certificates and from mailing completed forms. Last week, a federal judge put those laws on hold with an injunction against the State of Texas. In his 94-page opinion, U.S. District Judge Gregg Costa of Galveston called the rules “more burdensome… than the vast majority, if not all, other states.”

A group opposed to the state law that requires Kansans to show a government-issued photo ID to vote will have volunteers at some polls Tuesday to see whether any voters are being deprived of their right to vote. “This law was pushed forward without thinking things through,” said Louis Goseland, coordinator for the KanVote campaign. On Tuesday, voters across the state will participate in Republican and Democratic party primaries. Kansas Secretary of State Kris Kobach pushed the photo ID requirement through the Legislature, saying it was needed to protect against voter fraud. Critics say that incidents of voter fraud are almost nonexistent in Kansas and that the ID requirement will disenfranchise some elderly and minority voters who don’t have a photo ID. There have been several local elections in Kansas since the photo requirement took effect at the start of the year. But this is the first statewide test.

The outcome could determine if voters are required to present a photo ID at the voting booth on Election Day in November. After Pennsylvania Governor Tom Corbett signed the measure into law in March, voter advocacy groups, including the American Civil Liberties Union and the NAACP, quickly challenged it. They said the law will deter elderly and minority voters, who are less likely to have photo identification, from voting. These groups tend to vote Democratic. Proponents say the law will prevent voter fraud. The week-long case included testimony from Lorraine Minnite, a Rutgers University expert on voter fraud, who said such fraud was “exceedingly rare.” “I’m just not persuaded in the absence of evidence it exists,” she said.

The U.S. District Court is soon to rule on Texas’s new voter ID law. Ostensibly to combat voter fraud — the existence of which has yet to be demonstrated — the law would require every voter to present a government-issued photo ID at the poll. After a week of arguments this month, the question before the panel of federal judges is whether this law — one of many to emerge in the wake of 2010’s Republican legislative resurgence — places an undue burden on minorities. Under the Voting Rights Act of 1965, jurisdictions such as Texas with a history of suppressing minority voting must prove that any new requirements don’t “have the effect of denying or abridging the right to vote on account of race or color.” In March, the Justice Department denied the Lone Star State the necessary clearance for this new law, arguing that it would disproportionately affect Hispanic voters. Texas officials appealed. To preserve the access of all citizens to the right to vote — certainly among the most sacrosanct in our democracy — the District Court should follow the Justice Department’s lead and strike down this highly suspect and unnecessary law.

Pennsylvania’s voter ID law goes on trial this week. The first thing this challenge to the state’s law has going for it are the real people who will testify about why it means they can’t vote. The second thing is the Pennsylvania constitution. And the third is the utter lack of legitimate justification for the burdens the law imposes. This law should go down, and now, before it can cause problems in November. But if you’re a Democrat worried that the law — which requires voters to show an approved form of photo ID at the polls — is going to cost President Barack Obama the election, there’s a possible silver lining. The number of voters affected may not be as huge, or as overwhelmingly Democratic, as it seems. Let’s start with the trial. The Talking Points Memo website and The New York Times have introduced us to 93-year-old Viviette Applewhite and 60-year-old Wilola Shinholster Lee. Applewhite has never had a driver’s license, lost her Social Security card when her purse was stolen, and can’t easily get a new one because she has changed her name twice to marry. Lee — who was born in Georgia but has lived in Pennsylvania since she was 5 years old — lost her birth certificate in a house fire and she can’t get another one. (According to the state of Georgia, her original birth certificate was lost in a fire there, too.)

By law the high court has to hear the appeals of the challenges. U.S. Attorney General Eric Holder laid down the gauntlet for the administration in his speech to the NAACP annual convention in Houston July 10. “As many of you know, yesterday was the first day of trial in a case that the state of Texas filed against the Justice Department, under Section 5 of the Voting Rights Act, seeking approval of its proposed voter ID law. After close review, the department found that this law would be harmful to minority voters — and we rejected its implementation. “Under the proposed law, concealed handgun licenses would be acceptable forms of photo ID — but student IDs would not,” Holder said. “Many of those without IDs would have to travel great distances to get them — and some would struggle to pay for the documents they might need to obtain them.” Holder said some recent studies show only 8 percent of white voting age citizens nationally lack a government-issued ID, while 25 percent of African-American voting age citizens lack one. “But let me be clear: We will not allow political pretexts to disenfranchise American citizens of their most precious right,” Holder said.

Suppose Mitt Romney ekes out a victory in November by a margin smaller than the number of young and minority voters who couldn’t cast ballots because the photo-identification laws enacted by Republican governors and legislators kept them from the polls. What should Democrats do then? What would Republicans do? And how would other nations respond? As suppositions go, this one isn’t actually far-fetched. No one in the Romney camp expects a blowout; if he does prevail, every poll suggests it will be by the skin of his teeth. Numerous states under Republican control have passed strict voter identification laws. Pennsylvania, Texas, Indiana, Kansas, Tennessee and Georgia require specific kinds of ID; the laws in Michigan, Florida, South Dakota, Idaho and Louisiana are only slightly more flexible. Wisconsin’s law was struck down by a state court. Instances of voter fraud are almost nonexistent, but the right-wing media’s harping on the issue has given Republican politicians cover to push these laws through statehouse after statehouse. The laws’ intent, however, is entirely political: By creating restrictions that disproportionately impact minorities, they’re supposed to bolster Republican prospects. Ticking off Republican achievements in Pennsylvania’s House of Representatives, their legislative leader, Mike Turzai, extolled in a talk last month that “voter ID . . . is gonna allow Governor Romney to win the state of Pennsylvania.” How could Turzai be so sure?

Ohio has requested access to a massive federal immigration database so election officials can verify voters’ citizenship. Republican Secretary of State Jon Husted acknowledged the sensitivity of immigration issues but said the information, which he requested, would be valuable in unique situations when a voter’s citizenship is called into question. The database would not be used on a widespread basis to purge Ohio’s voter rolls of non-citizens, he said. “I feel like I have an obligation to pursue this to make sure we have all the tools necessary to make sure the integrity of the election system is upheld,” Husted said. Husted’s request comes at a volatile time. The hotly contested presidential election has put a spotlight on voting rights issues across the country, and there already have been accusations in Ohio of voter suppression tactics by GOP lawmakers aimed at poor and minority voters. Just this week, President Barack Obama’s re-election team sued Husted to allow in-person voting the three days before Election Day. Voting rights advocates cautioned Husted to use the information carefully.

A nationwide discourse over numerous proposed and enacted changes to state voting laws has reached a new level of fervor in the United States. State legislative sessions in 2011 and 2012 have resulted in 180 different bills that restrict some aspect of state voting laws. Types of legislation introduced have varied from new demands for voter identification to tighter restrictions regarding voter registration periods and processes, as well as a shortening of time frames for casting early ballots ahead of election days. The majority of this activity has occurred in Southern and Midwest states, the bulk of which are controlled by Republican legislatures and governors whose ostensible premise is to increase protection against electoral fraud. Citing the findings of New York University’s Brennan Center for Justice’s Voting Law Changes in 2012 report, Democrats have criticized the wave of legislation as deliberating placing restrictions on youth, minority, elderly and poor voters. The report argues that voting will become significantly more burdensome for five million eligible voters than it was in 2008 elections. The main source of debate has revolved around the questions over an increased burden on voters in the November elections, and whether it will contribute to a marked decrease in electoral fraud.

His exact statement to a crowd of state Republicans — that the new voter ID law “is going to allow Governor Romney to win the state of Pennsylvania” — was the most truthful accounting of why the party is pushing for allegedly more stringent voting rules across the nation. This is not about voter fraud, a claim that has never been substantiated, but about politics. Pennsylvania’s new rules will require a government photo ID to be able to vote, which disproportionately burdens those without cars: the poor, elderly, and minority voters who trend Democratic. Students without drivers’ licenses will also be stuck.

His trip was less arduous than the one some residents would have to endure to get a government-issued photo ID. “In West Texas, some people would have a 200-mile round-trip drive” to the nearest state office to get a card, he testified, according to The Dallas Morning News. More than a quarter of the state’s counties don’t even have an office to get a driver’s license or voter card. Lines at the San Antonio motor vehicles offices are often more than two hours long, he said. Texas is one of 10 Republican-controlled states that have imposed a government ID requirement to vote, purportedly to reduce fraud but actually to dissuade poor and minority voters who tend to vote Democratic. (Seven other states have passed slightly less-restrictive rules.) In most cases the federal government can do little to resist this incursion on voting rights, because the Supreme Court upheld ID requirements in 2008. But Texas is different. The U.S. Supreme Court ended its term with a flurry of decisions in cases with strong Alabama connections, and there are signs that trend will continue this fall as Shelby County prepares to send the justices its challenge to the Voting Rights Act in the next few weeks. The Shelby County case has been a contender for Supreme Court review ever since it was filed two years ago, and the likelihood has increased as other similar voting cases have slowed down and Shelby County’s has speeded up. It’s had two hearings in federal court and two decisions, both of which upheld the constitutionality of key sections of the Voting Rights Act. The Supreme Court is the next and last stop for the county, which is trying to dismantle the 47-year-old law that puts elections in all or part of 16 states under strict federal supervision. “We are proceeding with our plan to file a petition with the Supreme Court,” said Shelby County’s attorney, Frank “Butch” Ellis of Columbiana.

Texas is preparing for a legal showdown next month in federal court over a new voter photo ID law passed by the Legislature but blocked by the Justice Department which cited discrimination against minority voters. “We objected to a photo ID requirement in Texas because it would have had a disproportionate impact on Hispanic voters,” U.S. Attorney General Eric Holder told a recent conference of black clergy. Despite legal maneuvering by Texas and Justice Department lawyers, a three-judge U.S. District Court panel has cleared the docket for a July 9 trial. And it remains highly questionable whether the new law could be implemented in Texas by the November general election.

Florida’s proposed elimination of non-U.S. citizens from its voter rolls is necessary to preventing voter fraud, a spokesman for the state’s Division of Elections said Friday after the U.S. Department of Justice called into question the legality of the action. The so-called “voter purge” would remove names from Florida’s voter rolls months before the 2012 presidential election, when Florida will play a key role as a battleground state with a large chunk of electoral votes. In a statement, Chris Cate said the decision to remove names from the list was essential to preventing non-citizens from casting ballots illegally. “The Department of State has a duty under both state and federal laws to ensure that Florida’s voter registration rolls are current and accurate. Therefore, identifying ineligible voters is something we are always doing,” Cate wrote. He added that the action was not meant to prevent minority voters from voting.

Viriato deMacedo (R-Plymouth) introduced an amendment to the mid-year spending bill that would require voters to show identification at the polls – a proposal that failed Wednesday when the House passed a package of election reforms. Democrats immediately offered a further amendment to send the idea to study – an oft-used tactic by House Speaker Robert DeLeo’s leadership team that Republicans refer to as an “inoculator” because it prevents a vote on the underlying issue. DeMacedo has filed the bill for the past 12 years.

Alabama: Legislature passes redistricting plan amid anger | The Montgomery Advertiser

The Alabama Legislature passed plans early Thursday morning to redraw the 140 districts of state lawmakers, but did so in the Senate over angry and loud objections of Democratic senators. Democratic Sens. Rodger Smitherman and Bobby Singleton yelled for the proposed map of the 105 House districts to be read in its entirety, which some estimated would take 36 hours or longer. They said it violated the constitutional right of a senator to ignore their request to have it read. Smitherman, a Birmingham Democrat who had already had an angry confrontation with a senator in the chamber earlier, walked the Senate floor yelling about racism and prejudice, referring to the Ku Klux Klan and saying Alabama has gone backward. He continued shouting those words and phrases during the vote, and after the Senate recessed and members began to leave the floor.

Mississippi: Voter ID bill signed, awaits feds’ scrutiny | Houston Chronicle

Mississippi Gov. Phil Bryant on Thursday signed a bill requiring voters to show photo identification at the polls, but it’s unclear whether it will become law. Because of Mississippi’s history of racial discrimination, the state is required to get federal approval for any change in election laws or procedures. The U.S. Justice Department in recent months has rejected voter ID laws from Texas and South Carolina. The state chapter of the National Association for the Advancement of Colored People is asking the department to reject Mississippi’s proposed law, saying it could disproportionately create hardships for poor, elderly or minority voters who might be less likely to have a photo ID.

On May 4 the Washington Post published what Brian Beutler at Talking Points Memo called an “alarming—and darkly ironic” story stating voter registrations have dropped for African-Americans and Latino Americans. WaPo reporter Krissah Thompson wrote in her lead:

The number of black and Hispanic registered voters has fallen sharply since 2008, posing a serious challenge to the Obama campaign in an election that could turn on the participation of minority voters.

By some accounts, it was true. Census numbers, which measured between the 2008 presidential and the 2010 midterm elections, showed that the number of African-American registered voters had fallen from about 17.3 million to about 16.1 million nationally. But the Obama campaign and a number of academics disputed the Post’s conclusion that Obama might be in trouble, instead saying the Census’s methodology is flawed and that voter registration among African-Americans and Latino Americans is actually up.
