Last November, Richland County residents seeking to participate in local elections encountered an unanticipated hindrance at polling stations: stagnant lines of voters unable to cast their ballots because of malfunctioning voting machines. The lines reportedly were so outrageous that some residents had to wait upwards of seven hours to vote. Many voters grew impatient and left polling stations without submitting a ballot. Moreover, the disarray was hardly confined to election day. In the week after polls closed, a court-ordered recount of the election results sparked a back-and-forth legal battle between Democrats and Republicans over whether a local or statewide election agency should be tasked with tallying the votes in the recount. The dispute was not settled until the South Carolina Supreme Court intervened, and nearly two weeks elapsed before the election results were finalized. In 2004, the South Carolina State Election Commission (SEC) purchased roughly twelve thousand iVotronic voting machines for around $34 million. At the time of their purchase, the iVotronic systems were considered ultramodern direct-recording electronic (DRE) voting technology. Like most DRE models, the iVotronic enables voters to cast their vote via an electronic touch-screen without handling a paper ballot. Once a voter has electronically submitted his choice, the machine stores the selection in an internal memory device. Upon an election’s conclusion, the iVotronic machine prints a tape displaying the total number of votes cast for each office as well as the total number of votes cast for each candidate. In theory, DRE systems such as iVotronic provide a modern solution to antiquated election problems. In practice, however, DRE systems do not always function so smoothly.

On the political scene, growing numbers of observers have been worrying out loud about the vulnerability of our voting devices, especially those — like the ESS-manufactured machines in use in Shelby County — which depend so heavily on the computerized processing of results. Opponents, like local investigator Joe Weinberg, contend that both the hardware and software of these machines, and electronic devices like them, are inherently unreliable and subject to being hacked. Anybody who has looked into the fruits of Weinberg’s researches will realize, at the very least, how complicated these mechanisms are and how complex the potential problems they present. Rich Holden, the current administrator of the Shelby County Election Commission, has insisted that the margin for error of these election machines is infinitesimally small, and he contends that, as instruments for measuring the vote, they are far more efficient, less time-consuming, and more accurate by far than the old practice of voting via paper ballots. He sees that method as retrograde and believes that a return to it is the true goal of those who criticize the now-prevailing method.

West Virginia: State Election Commission to certify new voting system | The Charleston Gazette

For the first time in eight years, the State Election Commission is expected to certify a new voting system for use in state elections when it meets Friday afternoon. Commissioners will be asked to certify the EVS 5.0.0.0 system manufactured by Elections Systems & Software of Omaha, Neb., for use in elections statewide. Jake Glance, spokesman for the Secretary of State’s office, said a key advance in the new system is that it incorporates a high-speed digital scan central ballot counter, which can record and tabulate ballots faster than optical-scan ballot counters currently in use. “It will make the counting process faster,” he said Thursday. “It’s all about speed and accuracy.”

Indiana: New voting machine purchase put on hold in Montgomery County | Journal Review

Montgomery County Commissioners tabled a request Monday from Montgomery County Clerk Jennifer Bentley for the purchase of new voting machines to be used in future voting centers. Cost of the machines is $231,140, and commissioners requested Bentley to approach the Montgomery County Council on Sept. 3 to see if they are willing to fund the acquisition. “I don’t see any reason for us to approve this request until we know the county council is willing to spend the money,” Commissioner Jim Fulwider said. Bentley responded by saying she has approximately $140,000 she can use to pay for the machines, but would need approval from the council for the other approximately $90,000.

South Carolina: Richland County Elections Director Concerned About Voting Machine Storage | wltx.com

The new director of elections in Richland County has yet to case a vote, but says his storage space for voting machines could hurt his ability to do so. “The county has done a good job of repairing the warehouse, however, it still leaks. There’s still insulation hanging from the roof,” said Howard Jackson.  “So, it’s not very good working conditions.” Jackson spoke about the conditions during an elections board meeting Tuesday.  He said members of county council and the County Administrator have toured the warehouse recently. The board didn’t advertise the location of the warehouse, saying security there is cause for concern.

Next election could run faster and smoother if the Guam Election Commission can purchase new tabulators. During last year’s General Election, the GEC had problems with at least three of its four tabulators. Those problems drew attention to the age of the machines, and the GEC has since looked at whether it would be feasible to keep using them, Director Maria Pangelinan said. The four tabulators are based on technology from the 1980s, according to Pacific Sunday News files. And Pangelinan estimates the machines are at least 20 years old and have been well-used throughout those years. Pangelinan said correspondence with the vendor found that repairing the machines would cost about $35,000 each. She said the election commission decided that it would be too costly to repair the old machines. As a result, the commission is requesting information to purchase new tabulator machines.

Wisconsin: Dane County looks to cost share on voting machines | The Waunakee Tribune

With help from Dane County, Waunakee could be one of many municipalities replacing their vote tabulating machines by next year. Dane County Clerk Scott McDonell announced that the county would pay half of the cost to replace the machines, in a press release recently. The press release cites “reports of vote-counting machines smoking, sparking and breaking down during the last election” and urges municipalities to upgrade the equipment. While Waunakee Clerk Julee Helt has never witnessed such dramatic breakdowns in Waunakee’s machines, she does remember one snafu, she said. “We had one situation midday when we were off a number,” she said. “Sometimes, people get a ballot then decide they don’t want to vote for anybody.” But the clerks have to be accountable for each number they give out for a ballot.

Florida: New voting equipment checking in for Brevard County | Florida Today

Brevard County voters will be using new equipment starting in November. The County Commission this week unanimously approved the $1.5 million purchase. Supervisor of Elections Lori Scott said Brevard currently has among the oldest election equipment in the state, dating back to 1999. Brevard was one of the early adopters that year of “optical scan technology” to read the ballots. She says that equipment now is “aging and outdated,” and the vendor that made it is out of business, so spare parts are difficult to come by. “We can’t continue to limp through like that,” Scott said. With the new equipment, voters will continue to mark a paper ballot. But the new equipment that will collect and tabulate those ballots will make it easier for election workers to spot any problems with improperly completed ballots. “This is a much more user-friendly unit,” Scott said.

Faster, more reliable voting machines are arriving just in time to help handle an expansion of absentee voting in Minnesota and a high-profile test of Minneapolis’ ranked-choice voting in this fall’s mayoral election. Six of the seven metro-area counties are spending millions to replace hundreds of 13-year-old optical-scan ballot-counting machines, taking advantage of federal grants and the recent certification of new voting technology. Ballots cast by Minneapolis residents will be fed into the machines during the mayoral election in November, which will be the most high-profile test yet of the city’s system that allows voters to pick a first, second and third choice. The new equipment will eliminate the hand counting that took 15 days in 2009.

The city Board of Elections just re-certified the results of the race — including an additional 1,579 ballots finally counted last week. Exactly 238 days elapsed between the Nov. 6 election and the beleaguered Board’s Tuesday sign-off on the latest update — raising serious questions about how quickly and reliably the agency can make a call in the upcoming Sept. 10 primary. “There’s three weeks between the primary and the runoff election, and the Board is going to have to perform at a optimal level,” said Alex Camarda, public policy director for the Citizens Union good-government group. “The fact that they’re discovering these uncounted votes [only now] casts doubt on their ability to do that,” he said. “It diminishes public confidence in the integrity of the election system.” Under a bill awaiting Gov. Cuomo’s signature, the Board could haul out its old lever voting machines for the primary and a widely anticipated subsequent runoff that would be triggered if no candidate captures 40% of the vote.

Iowa: Pottawattamie County Board OK’s voting machine purchase | Southwest Iowa News

New voting machines will be in place for fall elections. The Pottawattamie County Board of Supervisors unanimously approved the purchase of a new stand alone central scanner, for counting absentee ballots, and 45 precinct vote scanners. The equipment will be purchased from Election Systems and Software at a cost of $322,750. The company demonstrated their latest equipment for the board June 18. Representatives of the company told the board the new equipment takes a lot of the stress away from poll workers, because it is so easy to use. The new central scanner, a DS850, is supposed to make counting absentee ballots easier. The current M650 scanner can scan equally as fast, if there were no voting variables, but the problem with the machine is that it stops every time there is an anomaly, such as an over vote – voting for more than one candidate in a given position – or write-in vote.

Minnesota: Anoka County getting new election equipment | ABC Newspapers

The Anoka County Board has awarded a contract for new election equipment that will be in place in time for the 2013 election Nov. 5. The new equipment plus election services from Election Systems & Software will cost up to $1,530,251.30 and replace the existing equipment, which is obsolete. A 10-year joint powers agreement was approved last year by the county, school districts and cities in the county that spells out a cost-sharing formula to pay for the new equipment, its maintenance and operations. According to Cindy Reichert, Anoka County elections manager, the software associated with the new equipment will begin arriving the week of June 24. But delivery of the 140 ballot counters that the county is purchasing under the contract won’t be delivered until August, Reichert said.

Before the start of last Wednesday’s sparsely attended Charleston County Board of Elections and Voter Registration meeting, Frank Heindel turned around in his seat to ask a question of the woman sitting behind him: “You don’t think I’m crazy, do you?” Heindel, a Mt. Pleasant resident, has almost single-handedly taken up the crusade of reforming South Carolina’s electronic voting system, and the idea he presented to the BEVR last week might sound crazy to the uninitiated: He wants the county to go back to using paper ballots. “I believe every citizen in Charleston County deserves an election process that is transparent, conforms to existing laws, and can produce an audit paper trail,” Heindel said. The board heard him out, and it voted to have its executive director look into new options for the November 2013 general elections — including new electronic machines and old-school paper ballots read by optical scanners. Heindel’s full proposal was that the county conduct some, if not all, local elections this November without using its iVotronic touchscreen voting machines, which the election-integrity hellraiser says are flawed due to problems like vulnerability to virus attacks and a lack of hard-copy verification. Heindel also asked the board to require a post-election audit be conducted.

New York: ES&S says it can prevent disaster during city’s upcoming mayoral election — for a fee | NY Daily News

The company that made the city’s controversial new voting machines claims it has a solution to the city’s looming election crisis: Pay the company more money. The city Board of Elections has warned that the mayoral primary election this fall could turn disastrous if no candidate wins at least 40 percent of the vote. State law requires the city to hold a runoff election two weeks after the primary but the board says it needs more time to reset the new ballot scanners. The company that made the scanners, Elections Systems & Software, has now stepped up with an offer to save the day — and get a big check. It offered to send a team of its own consultants and technicians to help pull off the two-week turnaround.

The Jackson Free Press is hearing about a number of Election Day issues that seem to be associated with the use of new voting machines. This morning, the Jackson Free Press received a tip about issues at Ward 7’s Precinct 97 in south Jackson, located at the Wahabi Shriners, 4123 Interstate 55 S. The precinct is supposed to have one voting machine to read hand-marked ballots and count the votes. The machine, which poll workers said was scheduled for delivery at 6:15 a.m., didn’t show up until 8:43 a.m., nearly two hours after the polls opened. And then it didn’t work. In April, after a months-long process, the Hinds County Board of Supervisors agreed to a $1.2 million five-year contract with Electronic Systems and Software for new voting machines. Headquartered in Omaha, Neb., ES&S also holds a contract with the Mississippi secretary of state to facilitate overseas and military voting.

A Los Angeles filmmaker’s documentary isn’t giving South Carolina’s voting system rave reviews. “It really is incumbent upon us, ‘We the people,’ to own our elections,” Filmmaker Jason Smith said. Jason Smith wasn’t a big fan of politics until 2010. “I didn’t know anything about election integrity prior to what happened with this Alvin Greene story,” he said. After Greene won the state’s Democratic primary for a U.S. Senate seat in 2010 without much of a campaign, Smith took a hard look at voting integrity.

When you think of Maine you think of lobsters and blueberries and quaint, picturesque towns. For years, ballot clerks in hundreds of these small towns have spent election night painstakingly hand-counting ballots. Depending on the size of the town and the size of the election, this process could last well into the morning hours. In early 2012, there were approximately 500 towns throughout Maine still hand-counting ballots. The Secretary of State’s Office, in an effort to speed up the process and get results to Augusta more quickly, offered the towns with more than 1,100 registered voters access to 225 vote tabulators (ES&S DS 200) free of charge under the state’s contract with the vendor. “We are providing 225 tabulators free of charge,” explained Julie Flynn, deputy secretary of state. “The majority of the municipalities with more than 1,100 registered voters accepted the tabulators.” Only Greenville, Litchfield and Winterport declined two offers from the state and continue to count their ballots by hand.

Nebraska: Governor signs bill reducing in-person early voting in Nebraska | Nebraska City News-Press – Nebraska City, NE

Governor Dave Heineman has signed legislation that will reduce the period of in-person early voting in Nebraska from 35 days to 30 days, a bill that will help assure that Nebraska complies with the Help America Vote Act. State lawmakers passed an amended version of LB271, which reduced the voting period to 30 days. The bill does not impact the start date for absentee ballot requests.

North Carolina: Bill would do away with touchscreen voting machines | WRAL

A bill filed by Rep. Bert Jones, R-Rockingham, and Rep. Justin Burr, R-Stanly, could force roughly 25 counties to do away with their voting machines.  House Bill 607 would require that all ballots cast in North Carolina be paper ballots. That would not change voting procedures in Wake County, where voters fill out bubble-sheet ballots with pen on paper. But counties like Guilford and Cumberland use touch-screen devices that record votes electronically. Those touch-screen machines would be outlawed by the bill.  “Paper ballots give an accurate record of the vote,” Jones said Monday night as he left the House chamber. “There were some concerns during the last election.”

Nebraska: Measure trimming number of days for early voting advances | Omaha.com

Nebraskans would have five fewer days to walk into an election office and cast early ballots under a bill advanced Thursday by the Legislature. But Legislative Bill 271 aims to make it possible for everyone, both visually impaired and not, to vote at that time. State Sen. Scott Lautenbaugh of Omaha, who introduced the bill, said it should bring Nebraska into compliance with a federal law about voting access for disabled people. “This is not meant to keep anyone from voting,” he said. “This is meant to address a complaint of alleged discrimination.”

Indiana: Decision on Floyd County voting machines questioned | News and Tribune

While his company came up short on its bid to supply Floyd County with new voting equipment, Jeremy Burton with ES&S — Election System & Software — wanted to at least voice concerns with the Floyd County Commissioners at a special meeting Wednesday night at the Pine View Government Center. Burton and attorney John Kraft, who represents ES&S, told the commissioners and members of the election board that the county overspent when deciding to purchase new machines, along with software and other equipment, from RBM Consulting, for $396,000. Floyd County will move to vote centers in 2014. Burton said his company’s bid was 21 percent less than others, including RBM. Also, ES&S has been supplying voting equipment and services to Floyd County since 1992. Kraft told commissioners they could have stayed with the current voting machines, which would have saved tax dollars. He said ES&S could have continued to service the current machines through 2016, and there was no reason to end the relationship or move to new equipment. However, Commissioner Chuck Freiberger said there were several meetings held on the subject before deciding on vote centers. He said the idea was first discussed five years ago.

Kansas: Computer problems lead to vote discrepancy | Garden City Telegram

The Finney County Clerk’s office is reporting that a computer system malfunction Tuesday night led to an error in the precinct ballot numbers reported by various media outlets covering the local elections. It also led to confusion for people waiting for results to be posted at the clerk’s office Tuesday night. Election workers who posted the results said they were unofficial, but many observers left with the impression that, other than the normal provisional ballots that are counted when all results are canvassed, there weren’t additional regular ballots to be counted. None of the unofficial winners changed as a result of the error. Election results will be canvassed at 9 a.m. Monday in the Finney County Commission chambers at the County administrative Center, 311 N. Ninth St. County Clerk Elsa Ulrich said the computer problem was discovered Tuesday night after polls closed and the results began to be tallied. Ulrich said a card that contains a program reads ballots as they go through the counting machine. The results are saved to a disk. But for an unknown reason, the card would not read in Ulrich’s card reader.
“Until the card was read, I didn’t know how many ballots were counted at each precinct,” she said. “I insert it into one of my card readers and it drops into a software program. The problem was it wouldn’t go into the software program.”

Nebraska: Lawmakers begin debate on early voting measure | Journal Star

Nebraska lawmakers began debate Wednesday on a bill to reduce the number of days for in-person early voting in order to prevent situations like the one in which a blind Lincoln woman couldn’t cast an early ballot because the machine to help disabled voters was not ready. Late last year, a hearing officer, Lincoln attorney Robert Kinsey Jr., suggested reducing the period for in-person, early voting from 35 days to 25 days. Kinsey was appointed to oversee the case, which stemmed from a complaint filed by Nebraskans for Civic Reform on behalf of Fatos Floyd of Lincoln. Floyd, who is blind, called the Lincoln Election Commissioner’s Office on Oct. 3 — two days after in-person early voting began — to say she was bringing in a friend with visual impairment to vote on the county’s Automark terminal but was told the machine’s software wasn’t yet available. Neal Erickson, deputy secretary of state for elections, said earlier the main problem is that Nebraska law says ballots for early voting must be ready 35 days before the election. The law also says the ballots must be certified by the secretary of state 50 days before the election. In the 15 days between the two deadlines, election officials must finalize the ballot layouts, print the ballots and program Automark terminals.

Hinds County this fall will use a digital voting system in which residents mark a paper ballot, but officials say that’s not a step backward. The optical scanner machines made by Omaha-based Election Systems and Software, used by the state’s 81 other counties, will replace Hinds County’s decade-old, touch-screen system. County leaders say it will make precinct check-in and voting quicker and more foolproof. But just as importantly, they say, the new process will restore confidence to a Hinds County system plagued in recent years by machine malfunctions and accusations that absentee and affidavit ballots were lost or mishandled. The machines will be delivered by July 1, not quite in time for spring municipal primaries and the June general election, but in time for any special elections in August. Pennsylvania: Batteries for Lawrence County voting machines to cost $26K | Ellwood City Ledger

When Lawrence County purchased electronic voting machines more than five years ago, the batteries were included. But after several years of recharging and reusing those batteries, they are near the end of their useful life, which stands to take a bite out of the county Department of Voter Registration and Elections’ budget. In response to a request by Ed Allison, director of Voter Registration and elections, the commissioners designated approximately $26,000 from the county contingency fund to replace the batteries in more than 250 machines at a rate of nearly $100 apiece. The voting machine battery funding was the largest of Lawrence County’s first 2013 budget transfers.

South Carolina: Report: Updating electronic voting machines would cost $17.3 million | The State

South Carolina’s electronic voting machines do not produce hard copies of votes, and it would cost taxpayers $17.3 million to add that capability to the state’s existing machines, according to a report by the Legislative Audit Council. “The audit process in South Carolina is limited by the absence of a voter verifiable paper audit trail,” the report said. The report notes that “without paper ballots, the reconstruction of the votes cast is not possible.” But the report does not give a recommendation on whether the state should update its electronic voting machines to produce a hard copy of votes. The report notes the paper ballots “undermines the voting access of people with disabilities” and that hand counting ballots always introduces the possibility of “human error.”

A review released by the South Carolina General Assembly Legislative Audit Council says voting machines used in South Carolina are not certified by a federal Election Assistance Commission (EAC). The 62-page report breaks down where the state stands with current voting machines, evaluates training requirements and looks at alternatives to the current voting machines. The review, which was requested by the former President Pro Tempore of the South Carolina Senate, Glenn McConnell, goes on to say the machines South Carolina uses are not certified by the EAC and do not produce paper audit trails. However, South Carolina’s requirements meet the minimum requirements in the Help America Vote Act. The EAC was established in 2002 after Congress passed the Help America Vote Act. According to the review, the EAC is without its four commissioners and has not revised the 2005 Voluntary Voting System Guidelines. The report also says an EAC official claims the lack of commissioners does not affect the testing and certification of voting systems except in accrediting new test laboratories or if a voting system manufactureer wants to appeal a decertification deicision.

Maine: Litchfield says ‘no’ a second time to state-sponsored ballot counting machines | The Morning Sentinel

The town of Litchfield has rejected a second state offer of a machine to tabulate state and federal election ballots in favor of continuing to count votes by hand. Litchfield recently rejected a second offer by the state for a machine to tabulate state and federal election ballots, in favor of continuing hand-counting. Litchfield’s rejection was signed Tuesday by Rayna Leibowitz, chairwoman of the Board of Selectmen, following an earlier vote. “When the ballot clerks were asked their opinions, nobody, nobody wanted the machines,” said Leibowitz, who serves as a ballot clerk when she’s not a candidate for office. “We just feel it’s too important a process to rely on the machines, and we’d miss out on the social opportunities here. It’s very much a team effort. We have some people doing it for years and years and years, and they absolutely love the process.” In contrast, officials in Belgrade are enthusiastically cheering the benefits of that town’s new tabulator, which saved nine hours of counting time in the last election.

Nebraska: Secretary of State Gale testifies in support of reducing in-person early voting days | Nebraska City News-Press

Secretary of State John Gale testified today in support of LB271 which would reduce the number of in-person early voting days in Nebraska from 35 to 25. The bill, sponsored by Senator Scott Lautenbaugh, arose from a complaint filed under the Help America Vote Act against the Lancaster County Election Commissioner’s office by a visually impaired voter. She was unable to vote in early October, due to the unavailability of the AutoMARK machine, which allows disabled voters to cast an unassisted ballot at their precinct. Following a hearing on that complaint, the hearing officer recommended that in-person early voting days be reduced to 25. Speaking to the Government, Military and Veterans Affairs committee, Gale said that the recommendation made by the hearing officer and supported by the proposed legislation, was the simplest and most accommodating way to address the problem.

Pennsylvania: Voting machine questions explored – Unused ballot design software has cost county up to $45,500 | Times-Leader

Luzerne County has been paying $6,500 a year for ballot design software that was not used, the new election director said, a decision that might have cost the county as much as $45,500. Marisa Crispell-Barber informed the county election board of the expenditure at Wednesday’s board meeting. She believes the software was purchased annually since the county started using the electronic voting machines in the 2006 primary. The board gave her permission to seek county funding to obtain training to fully implement the software and prepare ballots in-house. The training would cost $15,000 but would pay for itself because the county would no longer have to pay the voting-machine vendor to prepare ballots, she said. The county paid the vendor, Election Systems & Software, $33,563 to prepare the ballot in the 2012 primary alone, she said. She wants to secure training to design the ballot for the May 21 primary. Another employee also would be trained, and in-house preparation would gradually build a ballot database that can be used by her successors, she said.
