Schultz bypassed the normal state rulemaking process claiming he didn’t have enough time before November’s general election to allow for a public hearing and comment period. Assistant Attorney General Jeff Thompson argued that the new rules are intended to provide protection to all voters by ensuring that people who are not citizens are not voting. The Corbett administration must subscribe to the theory that a strong offense is the best defense. Its response to a request from the U.S. Justice Department for information concerning Pennsylvania’s compliance with the Voting Rights Act starts out with sarcasm and goes on to accuse its Civil Rights Division of engaging in a political stunt. This from a Republican administration that oversaw the passage of a new voter identification law that could keep an untold number of citizens from exercising their right to cast ballots in the upcoming presidential election. By the Corbett administration’s various tellings, the voter ID law will negatively impact a scant 1 percent of the state’s eligible voters (says the governor’s office) and nearly 759,000 registered voters lack appropriate ID from the state Department of Transportation (says the secretary of the commonwealth who oversees the election department). That discrepancy alone justifies the interest of the Civil Rights Division, which sought, among other items, records supporting those assertions, along with the complete state voter registry and PennDOT’s lists of licensed drivers and those holding PennDOT-issued non-driver ID cards.

Schultz, a Republican, was joined by Democratic Attorney General Tom Miller at a news conference to announce the state’s formal response to a lawsuit filed by the American Civil Liberties Union and a Latino group challenging new administrative rules related to voter registration. Miller backed up Schultz’s actions and said the state would oppose the ACLU’s request to prevent the rules from taking effect.

Pennsylvania Commonwealth Court Judge Robert Simpson’s 70-page decision yesterday refusing to block the state’s strict voter ID law is a rather curious document. The decision fails to connect legal principles with practical realities and consequently the court failed to protect the rights of Pennsylvania’s voters.  Simpson quickly waves away the facts and devotes nearly 50 pages to various legal theories and standards. Simpson conceded that should the voter ID law prevent any qualified person from casting a ballot; that voter will suffer “irreparable harm.”  Nonetheless, he ignores the real and substantial burdens imposed by this law on Pennsylvania’s voters and instead finds that because he does not believe that any voter will be “immediately” or “inevitably” fully disenfranchised, the law must stand.  More importantly Judge Simpson agreed that there are circumstances where some voters may be erroneously charged a fee to obtain a photo ID.  Ignoring the fact that the United States Supreme Court clearly stated in Crawford v. Marion County Election Board that a charge for a photo ID constitutes an illegal poll tax, Judge Simpson simply says that if charged, a voter could sue after the fact and obtain monetary damages, and therefore would not suffer “irreparable harm.”

University of Washington political scientist Matt Barreto, a witness for the plaintiffs (the suit was brought by the ACLU, the Advancement Project and other voting rights groups), found more than 1 million registered voters in Pennsylvania—12.8 percent of the electorate—don’t have sufficient voter ID. Moreover,379,000 registered voters don’t have the underlying documents, such as a birth certificate, needed to obtain the right ID; 174,000 of them voted in 2008.

At a recent meeting of the Pennsylvania GOP State Committee, the top Republican in the state House of Representatives, Mike Turzai, declared that a new requirement for voters to show identification with a photograph on it “is going to allow Gov. [Mitt] Romney to win the state of Pennsylvania.” He drew wild applause from Republicans in the crowd. The new law being referred to won approval under the state’s Republican Governor Tom Corbett and the GOP majority in the state legislature. The result is that 9.2 percent of the state’s 8.2 million voters are suddenly at risk of losing their right to vote. Eighteen percent of the registered voters in Philadelphia do not have government issued photographic identification. That means they won’t be able to vote.

PennDot offices throughout the state seem ill-equipped to handle the expected demands of voters seeking state-issued identification cards, according to witnesses testifying Tuesday in Commonwealth Court. In recent visits to the Department of Transportation’s offices, the witnesses said, they found long lines, short hours, and misinformed clerks, which made obtaining voter identification cumbersome, and in some cases impossible, for those who don’t have supporting documentation. Lisa Gray of Chadds Ford said she was caught in a Catch-22 situation. She does not drive because of a psychological disability and therefore has no license – and she was born in Germany. To get her birth certificate from the U.S. government, she needs a photo ID. Gray said she had exercised her right to vote for 35 years. “I vote because it’s important to me to make my voice heard,” Gray testified. “I may now be prevented by clerical stumbling blocks.”

The letters also do not tell voters where to go to obtain ID, but direct them to a website and phone number they can use to obtain more information.

Tomorrow the Commonwealth Court of Pennsylvania will hear a challenge to the state’s new voter ID law from the ACLU and other voting rights groups. The lead plaintiff is Viviette Applewhite, a 93-year-old great-great grandmother who marched with Martin Luther King Jr. Applewhite worked as a hotel housekeeper and never had a driver’s license. Four years ago, her purse was stolen and she lost her Social Security card. Because she was adopted and married twice, she cannot obtain the documents needed to comply with the state’s voter ID law. After voting in every election for the past fifty years, she will lose the right to vote this November. The ACLU will argue that Pennsylvania’s voter ID law needlessly disenfranchises voters like Applewhite and violates Article I, Section 5, of the state constitution, which states: “Elections shall be free and equal; and no power, civil or military, shall at any time interfere to prevent the free exercise of the right of suffrage.” As in Wisconsin, where two federal judges have blocked that state’s voter ID law, the Pennsylvania Constitution affords strong protections to the right to vote. (The Justice Department is also investigating whether the law violates Section 2 of the Voting Rights Act.)

Schultz has already checked the lists of registered Iowa voters against lists of people who are here legally on visas or green cards, but who aren’t U.S. citizens. “I don’t have the exact number off the top of my head, but I can tell you there were more than a thousand hits,” he says. The “hits” came when Schultz compared voter registration rolls with Iowa Department of Transportation records, because legal non-citizens — who have a visa or a green card — can get a drivers license.

Widely respected as fair player, whose work is well regarded by members of both major political parties, Mayer is someone conservatives and liberals listen to for reasoned comment on the political processes of the state. So when Mayer talks about the challenges raised by Wisconsin’s new voter ID law, we should all take him seriously. In testimony this week before Dane County Circuit Court Judge David Flanagan, Mayer estimated that roughly 220,000 potential voters would be unable to cast ballots in coming elections because of the new voter identification measure.

Did telling the truth about free voter ID cards get Chris Larsen fired? Larsen, who worked as a mail room employee at Wisconsin’s Department of Public Safety and Professional Services, was fired just hours after sending an email informing his colleagues about the Department of Transportation’s policy regarding free voter IDs. That policy? Only offer the free ID if someone asks for it—otherwise, charge the normal $28 fee.

Larsen described his firing to Campus Progress: “They asked why I sent the email. I said I felt people should be informed. They said it was inappropriate and [DSPS Secretary] Dave Ross would be upset, and they felt it was best if we parted ways.”

But John Murray, executive assistant at the DSPS, says Larsen “had a series of workplace violations, including inappropriate use of email resources” and that Larsen had been counseled on these violations.

First, we believe that UW-Milwaukee should begin offering these stickers as soon as the law goes into effect. The GAB’s decision stopped short of mandating that colleges issue acceptable voter identification, leaving it to individual schools to pursue a sticker program if they so choose. However, it would be unconscionable for UWM to decline to provide makeshift voter IDs.

I’m officially done arguing with people about whether the new photo ID law is a plan to suppress the vote in the minority community or not. Thanks to a whistle-blower in Madison, I’ve finally got my answer.

For a long time I’ve argued with readers that a photo identification law for Wisconsin wasn’t really necessary but could actually open the door for voter suppression among low-income minorities in a city like Milwaukee.

Even after Wisconsin Republicans passed the photo ID bill last May, I argued about the need to make sure it wasn’t overly restrictive or difficult to obtain. I have also pointed out my troubling racial concerns about a photo ID bill passed in a state where white Republicans currently run things. How many times have you heard the Democratic Party referred to as the main party for minorities and poor people?

When Wisconsin legislators passed the most restrictive voter ID law in the country earlier this year, they enacted what legal experts and voting rights activists have correctly identified as a poll tax. Proponents of the law argued otherwise. They pointed out that eligible voters who could not afford a state ID could obtain one without charge.

With the decision of the Wisconsin Department of Transportation to direct DMV employees to refrain from actively informing the public about the ability to receive a free identification card for the purposes of voting, however, the potential that the voter ID law could serve as a poll tax becomes realistic — and legally significant. Notably, the head of the DOT is a former Republican legislator with close ties to Gov. Scott Walker, and the author of the memo on denying information to prospective voters is a political appointee.

The term “poll tax” has a sordid history. With roots in the anti-democratic practice of allowing only the landed gentry to vote, poll taxes became even more notorious when they were associated with the efforts of Southern segregationists to deny the franchise to African-Americans. A critical turning point came in 1962 with the ratification of the 24th Amendment to the Constitution, which outlawed poll taxes in federal elections.

Wisconsin: Wisconsin Employee Fired For E-Mail Defying Voter-ID Policy | TPM

Chris Larsen, a low-level Wisconsin state employee, was fired for the apparent cause of using his work e-mail to mock and disparage state policy to his co-workers, the Milwaukee Journal Sentinel reports. The policy in question: The state’s decision for DMV employees to not tell citizens about the availability of free photo identification to satisfy the state’s new Voter-ID law, unless they ask first.

Larsen, a limited-term employee at the state Department of Safety and Professional Services, sent this e-mail Thursday morning to colleagues, encouraging them to tell all their friends about the free ID cards:

“Do you know someone who votes that does not have a State ID that meets requirements to vote? Tell them they can go to the DMV/DOT and get a free ID card. However they must ask for the free ID. a memo was sent out by the 3rd in command of the DMV/DOT. The memo specifically told the employees at the DMV/DOT not to inform individuals that the ID’s are free. So if the individuals seeking to get the free ID does not ask for a free ID, they will have to pay for it!!

“Just wanted everyone to be informed!! REMEMBER TO TELL ANYONE YOU KNOW!! ANYONE!! EVEN IF THEY DON’T NEED THE FREE ID, THEY MAY KNOW SOMEONE THAT DOES!! SO TELL EVERYONE YOU KNOW!!”

He was subsequently fired for misuse of e-mail.
