The Legislature's recent changes to Florida's elections law were so massive and controversial, it would be ironic if the overhaul came tumbling down because of one slightly obscure overstep. Here's hoping that's the case.

The overstep, pointed out June 12 in a front-page article by The Ledger's Lloyd Dunkelberger, was the Legislature's decision to disallow early voting on the Sunday before an election that features state or federal races.

That tweak might not seem like much, against the backdrop of the numerous and damaging changes imposed by the new law — such as tougher restrictions on voter registration, a severe reduction of the early voting period, and limitations aimed at young and absentee voters.

House Democratic leaders Tuesday asked the U.S. Justice Department to deny Secretary of State Kurt Browning’s request for approval of the state’s new elections law, which the Legislature’s ruling Republicans said is aimed at blunting the threat of voter fraud but which Democrats say is intended to discourage poor and minority voters from going to the polls.

Reps. Ron Saunders of Key West and Perry Thurston of Plantation cited the legislation’s (CS/HB 1355) shortening of the number of days available for early voting, penalties that could be imposed on voter registration groups, and new restrictions on changing voter registration at the polls as grounds for the Justice Department to reject the state’s request for needed preclearance in five counties under the federal Voting Rights Act.

The ACLU of Florida, the national ACLU, and Project Vote, a Washington, D.C., voters’ rights organization, sued earlier this mont in Miami federal court to stop statewide implementation of the law until Justice Department approval is obtained for the five counties.

The U.S. Justice Department was asked by Florida officials Wednesday to approve the state’s sweeping new elections law for five counties that need such preclearance under the federal Voting Rights Act.

Secretary of State Kurt Browning submitted documents detailing law changes under CS/HB 1355, which Gov. Rick Scott signed into law May 18 over opposition from legislative Democrats, the League of Women Voters, NAACP and other organizations.

Over the past few months, the world's attention has been focused on the struggle among Muslim states in the Middle East and North Africa toward the first, difficult steps of political freedom. Unfortunately for them, the road to democracy will be difficult at best, and we may not like the results. Americans understand this, as our own path to voting rights for all was long and bloody.

When the nation was founded, not everyone was able to vote, as religious clauses and property requirements limited full enfranchisement. The rights and privileges of citizenship were limited to a few land-owning, white males.

But, in the 1850s, provisions requiring citizens to own property and pay taxes in order to vote were eliminated. Not long after the end of the Civil War, black men were extended the right to vote with the 15th Amendment. Women would have to wait another half-century until the 19th Amendment in 1920 assured their right to vote.

The Florida ACLU and a Washington-based voting rights group filed a lawsuit Friday asking a federal court to halt statewide implementation of a new voting law until federal officials sign off.

The groups filed the lawsuit against Gov. Rick Scott and his administration in federal court in Miami on behalf of two Democratic state lawmakers and nine voters in five counties that require U.S. Department of Justice approval of changes to elections laws. For federal approval, the state must prove the laws will not result in voter discrimination.

It’s officially a clean sweep. After a manual recount, Miami-Dade County elections officials determined Thursday that a majority of voters rejected the charter amendment prohibiting former county politicians from returning as paid lobbyists for two years after leaving office.

The result reverses what appeared to be slim voter approval of the measure following the May 24 election. Under state law, a manual recount is held if the yes and no voters are separated by one half of one percent or less.

The final tally was 87,418 voting to approve the measure, 87,602 against.

The Federal Election Commission says a Florida car dealership formerly owned by U.S. Representative Vern Buchanan illegally reimbursed employees’ donations to his congressional campaigns.

The FEC on May 27 asked the U.S. District Court for the Middle District of Florida to fine the company $67,900, the amount it allegedly spent to reimburse employees and others for donations to the Florida Republican’s 2006 and 2008 campaigns. The dealership’s actions were “not a mere error or lapse in judgment,” the FEC said in its court filing. “It was an extensive and ongoing scheme that spanned two election cycles, three calendar years, and dozens of secret, illegal contributions.”

With a packed ballot, two weeks of early voting and several runoffs, Tampa officials were bracing for a hefty price tag from the recent citywide elections. As it turns out, those costs won't be as much as expected.

Figures from the Hillsborough County Supervisor of Elections office indicate the March 1 election cost $747,748, including expenses for early voting and the runoff elections. That's about $250,000 lower than the original estimates for the election, which Elections spokesman Travis Abercrombie attributed to keeping the staffing costs under control.

St. Johns County Supervisor of Elections Penny Halyburton wouldn’t have been disappointed if Gov. Rick Scott refused to sign the elections bill. “It puts an unnecessary burden on our voters,” she said.

The bill, called HB1355, enacts numerous election reforms in Florida. The two that most concern Halyburton are new rules regarding voters who change their address on election day and new restrictions to early voting periods.

Back in 2006, when the 1965 Voting Rights Act was up for renewal, a number of Republican lawmakers protested that its time had passed; that the states and municipalities that once worked to keep blacks away from the polls and locked into second-class citizenry had learned their lesson.

But it’s a lesson in which Florida Gov. Rick Scott and his GOP brethren are sorely in need of remediation.

Recently, Scott signed into law a bill that must be the most blatant attempt at limiting the access of black and poor people to the polls since the days when they were asked to guess how many bubbles were in a bar of soap.

Rick Scott signed a major revision to Florida’s election laws. After the law goes into effect July 1, there will be fewer early-voting days and it will be more difficult for a voter to change his or her address.

The law has drawn criticism from across the state and nation.

“This new law is going to make it very difficult for us to engage eligible voters in our Democratic process,” said Katherine Carithers, president of the Jacksonville chapter of the League of Women Voters.

But longer hours on those days.

HB 1355, which Scott signed into law May 19, cuts the number of days of early voting from 14 to 8, makes it harder for third-party voter registration groups to register prospective voters and requires voters who change their address from one county to another on the day of an election to cast a provisional ballot, which would then be reviewed by the county canvassing board.

We have a basic right here in the United States. It’s called voting.

It might sound familiar to you. It guarantees that each individual, regardless of age or status, has a say in his or her government. Does this ring a bell?

Well thanks to Gov. Rick Scott and the Republican legislature, that right is now a privilege. Last Thursday, Scott signed a bill into law that dismantles the Democratic process in Florida, and will undoubtedly disenfranchise many voters, especially students.

Florida Gov. Rick Scott hates regulations. Indeed, the phrase “job-killing regulations” has become a virtual motto. But while he has little use for rules intended to protect the public health, consumers or the environment, he doesn’t object to “vote-killing” regulations.

The governor last week signed legislation aimed at making it tougher for the young and the poor to vote. The legislation prevents people who have moved from another county from changing their address at the polls, as they have been able to do for 40 years. They now will be forced to cast a provisional ballot.

I recently spoke at the State of the County event hosted by the local chapter of the League of Women Voters. I likened some of the changes in election law made by HB 1355 to a five-ring circus, and focused on issues that I felt voters needed to better understand: early voting, address changes on election day, third-party voter registration organizations, the Presidential Preference Primary, and the full-text option for joint resolutions to amend the Florida Constitution.

After reading the Daily News’ May 17 editorial, “A fight over Florida voter rights,” I decided that voters really needed to hear a detailed explanation of what some of the changes made by HB 1355 mean to them, from the person who will be responsible for implementing those changes. If it weren’t so grotesquely un-American, you’d almost want to congratulate them for the audacity and efficiency of the attack. Governor Scott and the anti-civil liberties State Legislature have achieved an astonishing voter suppression trifecta. Whatever happens Tuesday when voters are to pick Miami-Dade’s next mayor and two commissioners — plus various proposed county charter changes — will you be able to say that your choices were considered because you voted?

Too few registered voters can say that today. Yet they will be the first to gripe about the winners in the May 24 special election. They’ll complain that county government is broken, and that they don’t vote because the fix is in.

The American Civil Liberties Union of Florida has hired two more lawyers and is planning to add another to help handle an expected workload increase resulting from the Republican-led Legislature’s recently ended session.

The ACLU, unions and some liberal and nonpartisan groups are gearing up for potential legal challenges to legislation as well as at least one of Gov. Rick Scott’s executive orders. They are reviewing measures that they say violate privacy, free speech, voting, due process, collective bargaining and other constitutional rights and requirements.

“I didn’t realize at the time of the election that when Gov. Scott said, ‘Let’s get to work,’ he was referring to the lawyers in the state, but that seems to be the way it’s working out,” Tallahassee lawyer Ron Meyer said. His clients include the Florida Education Association — the statewide teachers union — which is considering challenges to several measures.

“This legislative session has been maybe the biggest disaster for personal freedoms and human rights, and the list is long,” said Howard Simon, ACLU of Florida’s executive director. House Speaker Dean Cannon, R-Winter Park, declined to comment, citing the pending lawsuits. Calls to Scott and Senate President Mike Haridopolos, R-Melbourne, were not immediately returned.
