Circuit Court Judge Terry Lewis on Friday gave tentative approval to a new congressional redistricting map that has the potential to unseat at least three incumbent congressional candidates and opens the doors for others to enter the fray. Lewis rejected the Florida Legislature’s third attempt at redrawing its congressional districts and recommended a map proposed by the challengers to the Florida Supreme Court for its final review. His ruling adopted the bulk of the map approved by lawmakers in the northern and central portions of the state but specifically rejected the proposed boundaries for District 26 in Miami-Dade County, now held by Republican Congressman Carlos Curbelo. The challengers, a coalition of League of Women Voters and Common Cause of Florida and a group of Democrat-leaning individuals, agreed with the Legislature’s configuration of 20 of the 27 districts proposed in a staff-drawn base map but asked the court to adopt their changes to the remaining districts. Lewis agreed.

Kansas: Culling voter records to take weeks in some Kansas counties | Associated Press

Some Kansas counties expect to take at least several weeks to cancel incomplete voter registrations from residents who haven’t documented their U.S. citizenship, local election officials said Monday. Local officials also said even when they’re done culling the more than 31,000 records as required under a new rule from Secretary of State Kris Kobach, the canceled registrations still will be accessible in their voter registration databases. Kobach has directed counties to cancel incomplete registrations older than 90 days, with most from prospective voters who haven’t met the proof-of-citizenship requirement. A 2013 state law requires new voters to produce a birth certificate, passport or other citizenship papers when registering. Kansas is only one of four states with such a law, and its incomplete registrations ballooned to nearly 37,700 last week.

Assembly Republicans unveiled bills Wednesday to double political contribution limits, rewrite campaign financing rules and split the state’s elections and ethics board into two agencies and fill them with partisan appointees. One of the two bills would dissolve the state Government Accountability Board, which consists of six former judges who are responsible for running elections and overseeing the state’s laws on ethics, campaign finance and lobbying. It would create two new agencies — the Elections Commission and Ethics Commission — to oversee those duties. The six-member commissions are to be split evenly between Democrats and Republicans. Rep. Dean Knudson (R-Hudson) acknowledged an error in the way the legislation was written that would have allowed one party to control the commissions and said that would be promptly fixed. Daniel Tokaji, a professor at the Moritz College of Law at The Ohio State University who specializes in election law, called the accountability board a model for the nation and said it was ridiculous to turn elections over to partisans. He noted the Federal Election Commission routinely deadlocks because it is evenly split between Democrats and Republicans. “Only a lunatic or a glutton for gridlock would want to copy the FEC,” Tokaji said. “I think what they want is a commission that will routinely gridlock and get nothing done.”

The European Union’s most senior court has ruled that it is lawful for countries such as Britain to impose a voting ban on prisoners convicted of serious crimes. The unexpected ruling by the European court of justice upholds a ban on a French convicted murderer who was serving a sentence of more than five years from taking part in the European elections. The European judges ruled that the ban on him voting did represent a breach of the EU charter of fundamental rights but that it was proportionate “in so far as it takes into account the nature and gravity of the criminal offence committed and the duration of the penalty”. The ruling, which has clear implications for Britain’s blanket ban on prisoner voting, went on: “The court concludes that it is possible to maintain a ban which, by operation of law, precludes persons convicted of a serious crime from voting in elections to the European parliament.”

Ukraine: West, Ukraine, hail rebel decision to postpone disputed elections | Reuters

A decision by pro-Russian separatists to postpone local elections that Ukraine had said were illegitimate was welcomed on Tuesday by Kiev, the European Union, Washington and Moscow – the rebels’ patron – as a sign of progress in the faltering peace process. The separatists said the elections, which they had set for Oct. 18 and Nov. 1 in two regions they control, would take place next February, potentially giving time for a compromise that would suit all sides. The concession by the separatists comes at a time when Russia has adopted a more constructive tone in talks over Ukraine, according to diplomats involved in the discussion who say Russia has influence over the rebels.

National: Super PAC Contributions Can Be Considered Bribes: Judge | Huffington Post

A district court judge on Monday dismissed four corruption charges against Sen. Robert Menendez (D-N.J.) and his donor Salomon Melgen, but denied motions to toss out other charges including, notably, the senator’s solicitation of contributions for a super PAC. Lawyers for the senator had asked the court to dismiss charges related to the $700,000 in contributions from Melgen to Senate Majority PAC, a super PAC run by former aides to Sen. Harry Reid (D-Nev.) that made independent expenditures to support Menendez’s 2012 reelection, which prosecutors allege were made in exchange for official acts. The basis for dismissal offered by Menendez’s lawyers were the Supreme Court’s 2010 Citizens United and 2013 McCutcheon decisions. Those two cases redefined corruption as only explicit bribery, excluding influence and access. The senator’s lawyers argued that this redefinition of corruption and Citizens United’s declaration that independent expenditures “do not give rise to corruption or the appearance of corruption” provided freedom of speech protections for all “efforts to influence and obtain access to elected officials,” including any campaign contribution.

When we receive a summons for jury duty, we are required to present ourselves at the court. Should we treat showing up at the polls in elections the same way? Although the idea seems vaguely un-American, it is neither unusual, nor undemocratic, nor unconstitutional. And it would ease the intense partisan polarization that weakens both our capacity for self-government and public trust in our governing institutions. It is easy to dismiss this idea as rooted in a form of coercion that is incompatible with our individualistic and often libertarian political culture. But consider Australia, whose political culture may be as similar to that of the United States as the culture of any other democracy in the world. Alarmed by a decline in voter turnout to less than 60 percent in the early 1920s, Australia adopted a law in 1924 requiring all citizens to present themselves at the polling place on Election Day. (This is often referred to as mandatory voting, although Australian voters are not required to cast marked ballots.)

A group of African-American lawmakers on Friday blasted a decision by Alabama officials to shutter dozens of driver’s license offices, a move that disproportionately affects government ID services in black Democratic areas of the state. Given the state’s 2011 law that requires voters to show government-issued IDs before casting election ballots, closing the offices potentially disenfranchises thousands of black and minority voters, the Congressional Black Caucus said. “Alabama’s decision to close ID offices reminds us that 50 years after the passage of the Voting Rights Act, the fight for equal access to the polls still continues today,” the caucus said in a statement released Friday. “Having a say in our country’s Democratic process still does not exist for all.” Since a 2013 decision by the U.S. Supreme Court invalidated the section of the Voting Rights Act of 1965 that required federal approval of voting law changes in states with a history of racial discrimination, members of Congress and voting rights activists have pushed for restoration of the law. They did so as some Republican-led states passed laws requiring government-issued IDs and other forms of identification at polling places.

As congressional mapmakers defended their versions of districts in a hearing before a Tallahassee judge, the House and Senate announced Friday that they had reached agreement on how to move forward with a process to draw new lines for the state Senate in a special session starting next month. There were few revelations during Friday’s hearing on the congressional districts, expected to wrap up Monday. Leon County Circuit Court Judge Terry Lewis is expected to either choose one of seven maps — offered by lawmakers, voting-rights organizations, and a group of voters backed by the Florida Democratic Party — or combine the maps in a new proposal. Ultimately, Lewis’ recommendation will go to the Florida Supreme Court, which ruled in July that a map approved by the Legislature in 2012 and tweaked two years later violated a voter-approved constitutional ban on political gerrymandering.

Could the route toward increasing the competitiveness of Indiana elections and boosting voter participation turn on reforming how legislative district boundaries are drawn? A special 12-member study committee convened Thursday at the Statehouse to begin a two-year investigation into Indiana’s redistricting process. Currently, the General Assembly draws the maps for U.S. House, Indiana House and Indiana Senate districts every 10 years, after the U.S census tallies the state’s population. The only requirements for each district are that all parts of it be contiguous and that it be nearly equal in population to every other district of its type. Critics of legislative redistricting say those conditions provide lawmakers a significant opportunity to manipulate district lines in ways that advantage themselves or their political party.

Kansas: Officials to begin canceling incomplete registrations from 31K prospective voters | Associated Press

Kansas election officials are expected to begin removing the names of more than 31,000 prospective voters from their registration records Friday in line with the state’s tough voter identification law, which requires applicants to prove their citizenship before casting a ballot. Republican Secretary of State Kris Kobach, a leading advocate for rigorous voter identification requirements, directed county election officials to begin canceling the applications of prospective voters who after 90 days had not provided all required information and documents. Since 2013, Kansas has required new voters to provide a birth certificate, passport or other papers documenting their U.S. citizenship. The latest action would be the first purge of incomplete applications. Kobach described the culling of pending applications as just “common sense” to maintain accurate records of who is legally allowed to vote.

Sunday’s regional election results in Catalonia show that its citizens are pretty evenly divided between separation from and union with Spain — a plurinational state that must now rise to the challenge of how to accommodate ancient nations within it such as the Catalans and the Basques if it is not to break up. But first the electoral facts. Junts pel Sí, the main independence bloc made up of centre-right nationalists and centre-left republicans, came first with 62 out of 135 seats. With 10 more seats won by a separatist group of the radical left, there is a secessionist majority in the Catalan parliament. It is not a homogeneous majority: the leftist group wants to see the back of Artur Mas, president of the Generalitat, the Catalan autonomous government. Most important of all, the separatist camp presented these elections as a plebiscite for independence, but fell short of a majority of votes, with only 47.7 per cent — well below the crystal-clear majority it would need morally to justify a rupture with Spain.

President Jimmy Carter took office in 1977 with the conviction that it should be easier for citizens to register to vote. To accomplish that goal, he wrote to Democratic secretaries of state that year urging them to support legislation that would allow voters to register on Election Day. “The continuing decline in American voter participation is a serious problem which calls for the attention of all of us in public life,” Carter wrote. Advisers to Carter and Vice President Walter Mondale had concluded that Election Day registration, which they called “universal registration,” would boost low turnout rates. They cited laws passed in Minnesota and Wisconsin after the 1972 election that allowed citizens to register at the polls, which placed both states in the top five for highest turnout in 1976. But tucked away in their correspondence about the election reform proposals was an acknowledgment that the United States’ neighbor to the north had made it even easier for citizens to vote, by registering them automatically with government data.

Volkswagen stock plummeted today, because of accusations by the Environmental Protection Agency that VW uses software that turns on its emission control device when the software detects that one of its diesel cars is undergoing emission testing. When not being tested, the software disables the device, thereby causing the car to spew as much as 40 times the pollution limit of the Clean Air Act.

Like VW cars, modern voting machines contain software that is tested before use in elections. It would not be difficult to write voting machine software that would, like the VW software, know when it is being tested, and thus behave correctly during testing but not during an actual election. If such behavior were detected after an election, the vendor stock would plummet, but so would voter confidence in the outcome of the election. Furthermore, in the case of some voting systems that cannot be legitimately recounted, such as paperless voting machines or online votes, there would be no way to determine after the election if the declared winners were the actual winners.

Florida: Redistricting hearing focuses on dispute over Miami districts | Miami Herald

The latest chapter in Florida’s redistricting saga played out Thursday in a Leon County courtroom as two Miami congressional districts emerged as the heart of the differences over which of seven maps should be the one chosen by the court. Circuit Court Judge Terry Lewis must decide which map, or pieces of maps, he will recommend to the Florida Supreme Court by the Oct. 17 deadline. The court invalidated the map drawn by the Legislature in 2012 because it violated the constitutional ban on protecting incumbents and political parties. After the Legislature reached a stalemate in a special session, the high court ordered Lewis to choose from proposals from the House, Senate and the group of voters who successfully challenged the original map.

North Carolina: Voter ID lawsuit can proceed in state court, judge rules | News & Observer

A Wake County judge has refused a request from state lawmakers to dismiss a lawsuit challenging the Voter ID requirement. Judge Mike Morgan issued his ruling on Wednesday, almost four weeks after a hearing on the matter. Lawmakers amended the state’s Voter ID requirement this legislative session on the eve of a trial in federal court. Attorneys for state lawmakers and the governor contended at the August hearing in state court that the legislative amendment to the requirement – offering voters without an approved ID the option of using a provisional ballot – made the lawsuit moot. Attorneys for the challengers disagreed and Morgan found in their favor. In the lawsuit before Morgan, the League of Women Voters, Randolph Institute and several voters argue that lawmakers overstepped the bounds of the state constitution in 2013 when they added the ID requirement as part of an elections law overhaul.

A bloc of state Representatives — Scott Conklin, Tina Davis and Brian Sims — have introduced bills that would automate voter registration, form an independent redistricting commission and allow in–person absentee ballot voting. Conklin and Sims have partnered on a bill that would automatically register eligible individuals when that person obtains a Pennsylvania driver’s license; Davis and Sims introduced a bill that acts on the precedent set in Arizona, which ended gerrymandering there. “Any serious discussion about reforming government begins with redistricting and establishing a fairer system for drawing our state’s voting maps,” said Davis, D–Bucks. “The independent commission that our measure would create would put voters — and not political advantage — at the forefront when electoral districts are revised.

Virginia: State pushes to dismiss voter ID suit | Daily Press

Private attorneys defending the state against a lawsuit that targets Virginia’s voter ID laws and long election-day waiting times have asked a federal judge to dismiss the case. In filings this week they argued that the plaintiffs, including the Democratic Party of Virginia, don’t have standing to file the case, and that some arguments against the state amount to “speculative hypothetical.” The suit – one of several in swing states that target voting procedures ahead of the 2016 presidential elections – describes Virginia’s 2013 photo ID law and other state regulations as race-based efforts to curtail voting. Attorneys with Perkins Coie, which has brought challenges in other states as well as two separate redistricting suits here in Virginia, filed the case in June.

Much has been made of the proposal to use local body elections to trial e-voting in 2016. Just this week, Dunedin City Council became the latest local authority to vote not to participate in the experiment. Its withdrawal has reduced the original pool of 13 councils interested in the trial to just eight. The small remaining number has raised questions over the financial viability of the experiment, with calls for the Department of Internal Affairs to finance the project, rather than the local councils themselves. The decision by Dunedin Council to withdraw was based around three main themes – cost (put at $165,000 on top of the price of running a ‘standard’ postal vote election), security and access. Whatever online solution is used, there are remaining fears that security cannot be guaranteed. Indeed, the recent scandal involving Ashley Madison highlights such risks and, internationally, there are a number of countries where e-voting has been banned because of such fears.

Catalonia heads to the polls on Sunday to elect the 135 members who will sit in the region’s 11th parliament. Billed as a plebiscite on independence, the vote will be the most important Catalan election since its parliament was first elected in 1980. Before the previous election (in 2012), the Catalan parliament adopted a resolution asserting “the right of the people of Catalonia to be able to freely and democratically determine their collective future through a referendum”. In the elections that followed later that year, the mostly pro-referendum parties – Convergence and Union (CiU), Republican Left of Catalonia (ERC), Initiative for Catalonia Greens-United and Alternative Left (ICV-EUiA) and the the Popular Unity Candidature (CUP) – won the most votes and seats.

As the US presidential election season heats up, the public has focused on the candidates vying for the nation’s top office. But whether Donald Trump will secure the Republican nomination is secondary to a more serious quandary: whether the nation’s voting machines will hold up when Americans head to the polls in 2016. Nearly every state is using electronic touchscreen and optical-scan voting systems that are at least a decade old, according to a report by the Brennan Center for Justice at New York University School of Law (.pdf). Beyond the fact the machines are technologically antiquated, after years of wear and tear, states are reporting increasing problems with degrading touchscreens, worn-out modems for transmitting election results, and failing motherboards and memory cards. States using machines that are at least 15 years old include Florida, Kentucky, Massachusetts, New Hampshire, Texas, Virginia, and Washington, which means they are far behind even a casual tech user in keeping pace with technological advancements. The average lifespan of a laptop computer is three to five years, after which most consumers and businesses replace their machines. Computer users also generally upgrade their operating systems every other year or so as Microsoft and Apple release major software overhauls—including security upgrades. But US voting machines, which are responsible for overseeing the most important election in the country, have failed to keep up. “No one expects a laptop to last for 10 years. How can we expect these machines, many of which were designed and engineered in the 1990s, to keep running?,” write Larry Norden and Christopher Famighetti, authors of the Brennan Center report. “[T]he majority of systems in use today are either perilously close to or past their expected lifespans.”

The 2016 campaign is already underway, with nearly two dozen candidates vying to be the next president. Americans may have no idea who they will vote for next year, but they are likely confident that when they show up at the polls, their votes will count. And for the vast majority, of course, they will. But with rapidly aging voting technology, the risk of machines failing is greater than it has been in many years. In a close election, the performance of that old equipment will come under a microscope. Fifteen years after a national election trauma in Florida that was caused in significant measure by obsolete voting equipment—including hanging chads and butterfly ballots—it may be hard for many Americans to believe that the U.S. could face such a crisis again. But unless the right precautions are taken today and in the coming months and years, there is a significant risk that the story on Election Day will be less about who won or lost, and more about how voting systems failed. The looming crisis in America’s voting technology was first brought to national attention last year by President Obama’s bipartisan Presidential Commission on Election Administration (PCEA), which offered a stern warning about the “widespread wearing out of voting machines purchased a decade ago.” Over the past 10 months, the Brennan Center, where we work, surveyed more than 100 specialists familiar with voting technology, including machine vendors, independent technology experts, and election officials in all 50 states, to study how widespread this looming crisis really was.

The state House wants Circuit Judge Terry Lewis to approve the last map that House members voted out during a special redistricting session that collapsed last month, while the Senate is floating two alternative proposals for the judge to consider. After the session collapsed, the Florida Supreme Court gave Lewis the task of coming up with a map for justices to review. The Supreme Court struck down the current congressional map in July for violating the anti-gerrymandering “Fair Districts” standards approved by voters in 2010.

Kansas: Kobach issues 90-day time limit for voter registrations | The Kansas City Star

Kansas Secretary of State Kris Kobach issued a rule Thursday that incomplete voter registrations will be canceled after 90 days. The decision came after voting rights groups lodged vigorous objections to the time limit. The rule takes effect Oct. 2. More than 35,000 voter registrations applications are currently “in suspense,” and about 30,000 are incomplete because registrants have yet to provide a passport or birth certificate. Such proof-of-citizenship documents have been required since January 2013, but no limit had been placed on how long county election officials had to keep the incomplete registrations. “It really violates the spirit of what our nation, our Constitution, was built on — the participation of all,” Marge Ahrens, co-president of the League of Women Voters of Kansas, said about Kobach’s decision. “It feels so disrespectful of Kansans,” she said.

Virginia: New lawsuit challenges Virginia legislative districts | Richmond Times-Dispatch

A lawsuit filed Monday in Richmond Circuit Court challenges 11 of Virginia’s legislative districts, arguing that they violate the state constitution’s requirement of compactness. The suit, backed by the nonpartisan redistricting reform group OneVirginia2021, challenges six Republican-held districts and five Democrat-held districts. The plaintiffs in the districts include members of both major parties, a tea party activist and members of nonpartisan organizations such as the League of Women Voters. The defendants are the Virginia State Board of Elections; chairman James B. Alcorn; vice chair Clara Belle Wheeler; board secretary Singleton B. McAllister; the state Department of Elections; and Edgardo Cortes, commissioner of the state Department of Elections.

Greece: Campaigning in Greece draws to close, election results in balance | Reuters

Former prime minister Alexis Tsipras on Friday brushed off election polls suggesting his leftist Syriza party might lose to its conservative rival in Greece’s election, saying he had a large group of supporters not reflected by pollsters. He was speaking on the last day of formal campaigning for Sunday’s general election with polls showing a cliffhanger vote expected and some pointing to a win by the conservative New Democracy party. Neither party, however, is expected to get the proportion of the vote needed – roughly 38 percent – to gain a majority in the 300-seat parliament, meaning a coalition is a near certainty. “There is a voting body that is below the radar, it is not being traced,” Tsipras, who was to stage a final rally later in the day, told Greece’s ANT 1 television.
