Martin O’Malley was assured of victory so they needn’t get out to vote. Schurick could have been sentenced to up to 12 years in prison, the Baltimore Sun said, for violating a 2006 law prohibiting the use of deception to influence voter decisions.

That’s the text of a flier distributed in African-American and Hispanic communities the weekend before Election Day in 2002 when Robert L. Ehrlich Jr. ran for governor against Kathleen Kennedy Townsend. November 6 would be too late to vote; it was a Wednesday. Failure to pay the rent or parking or motor vehicle tickets is not a barrier to voting; neither is an outstanding warrant.

The Maryland General Assembly first outlawed voter suppression efforts in 1896, making it illegal to use “force, threat, menace, intimidation, bribery, or reward, or offer…[to] otherwise unlawfully, either directly or indirectly, influence or attempt to influence any voter in giving his vote.”

Paul E. Schurick, the 2010 campaign manager for former Maryland governor Robert L. Ehrlich Jr., was convicted Tuesday by a Baltimore jury of four counts stemming from a robocall that prosecutors said was intended to suppress the black vote.

The call, which Schurick acknowledged authorizing, was placed on Election Day to 112,000 voters in Baltimore and Prince George’s County, the state’s two largest majority-African American jurisdictions. Recipients were told by an unidentified woman that they could “relax” because Gov. Martin O’Malley (D) had been successful. The guilty verdict not only sullied the three-decade career of one of Maryland’s best-known political operatives, it also served as a major embarrassment for Ehrlich, the state’s only Republican governor in a generation.

Although prosecutors have never suggested that Ehrlich approved the calls, he is pushing a new book that draws anecdotes from his four years in Annapolis and contends his failed comeback bid last year was “swamped” by the black vote.

After the verdict was read, Schurick clutched his wife, who burst into tears.

Prosecutors said the call, which was made as Democratic Gov. Martin O’Malley swept to a re-election victory, was designed to suppress black votes. Schurick maintained a solemn face after the hearing, comforted distraught family members and friends and declined to comment on the verdict. His attorney, A. Dwight Pettit, called himself “disappointed” and vowed to appeal on First Amendment grounds that the call was protected, political speech. “The attempt for the state to regulate political speech is unconstitutional,” he said.

A little-noticed trial in Maryland could affect how many dirty tricks voters will see in the upcoming elections — things like anonymous fliers or phone calls telling people to vote on the wrong day, or in the wrong precinct, or that they can’t vote at all if they have an outstanding parking ticket. The tactics are often illegal, but it’s rare for anyone to get caught, let alone end up in court.

The case in Maryland involves the 2010 rematch between former Republican Gov. Bob Ehrlich and incumbent Democrat Martin O’Malley. On Election Day, the Ehrlich campaign knew that things weren’t going well. It was losing African-American voters in droves.

At around 3 p.m., Ehrlich’s political director, Bernie Marczyk, sent campaign manager Paul Schurick an email asking, “What does Julius need to make the city turnout stay low?”

Davitt argued that Paul Schurick’s contention that the robocalls would prompt Ehrlich voters to go to the polls was “ridiculous” and that Schurick committed crimes when he authorized the call.

Schurick’s lawyer, A. Dwight Pettit, said Schurick relied on the advice of consultant Julius Henson, who he said made a judgment that might have been questionable politically but did not amount to a crime by Schurick.

Maryland prosecutors in an election fraud case have introduced campaign documents suggesting a plan to suppress African-American votes. The documents were introduced as prosecutors rested their case Wednesday against Paul Schurick, campaign manager for former Republican Maryland Gov. Robert L. Ehrlich Jr. on two counts of conspiracy and one count each of election fraud and obstruction of justice, The Baltimore Sun reported.

Similar charges have been filed against political consultant Julius Henson, whose company, Universal Elections Inc., was involved in the November 2010 gubernatorial election.

“What does Julius need to make city turnout stay low?” campaign political director Bernie Marczyk wrote in a 2:53 p.m. email to Schurick, proposing additional bonuses for Henson if he could keep residents from the polls.

An interesting political trial got under way Tuesday in Baltimore. It involves robocalls made during the 2010 rematch between former Maryland Gov. Robert Ehrlich, a Republican, and the Democratic incumbent Gov. Martin O’Malley.

The calls were made Election Day afternoon by consultants working for the Ehrlich campaign and went to about 110,000 Democratic voters. The voters were told to “relax,” that “O’Malley and President Obama have been successful. Our goals have been met. The polls were correct, and we took it back.” The caller, never identified, went on to say that “the only thing left is to watch it on TV tonight.”

Montgomery County voters would be able to cast their votes in special elections through a mail-in ballot under legislation proposed by a state lawmaker. Mail-in ballots would save the county money and encourage more voter participation in typically low-interest special elections, said Sen. Jennie M. Forehand (D-Dist. 17) of Rockville, who has prefiled the bill.

Voter turnout in the county for five special elections between April 2008 and May 2009 — made necessary after the deaths of two County Council members and the resignation of former U.S. Rep. Albert R. Wynn — ranged from 6.8 percent to 11.5 percent. Combined, those five elections cost $5.4 million. “I’m always on the lookout to save money,” said Forehand, who introduced similar vote-by-mail legislation in 2010 and 2011. Forehand also expects to introduce another bill during the General Assembly’s 90-day legislative session that would allow jurisdictions statewide to adopt voting by mail in special elections, Forehand said.

A volunteer for 13th District city council write-in candidate Shannon Sneed says problems with voting machines – and the unwillingness of staff to help voters – caused eight to 10 people who came to a polling place in East Baltimore to leave without voting this morning. “There was some technician they needed to get to fix the problem, but they couldn’t find him,” said Renold B. Smith, a retired U.S. Postal Service manager who was volunteering for Sneed.

Smith, who said he had been at Tench Tilghman Elementary/Middle School since before the polls opened, said he tried helping one woman who was particularly concerned about the problem. He said she told him the machine “just wouldn’t let her do a write-in.”

Takoma Park voters who use an absentee ballot this November will have to mail or deliver their paper ballot because the Board of Elections (BoE) decided not to accept online voting as an alternative to for filing a paper absentee ballot. However, the BoE opted to maintain the online system to confirm a paper absentee ballot has been recorded.

At its meeting Wednesday evening, the BoE passed a resolution directing paper absentee ballots have to be cast in order for the vote to be counted. That resolution is: “That the ballot of record for absentee ballots is the paper ballot, and we will not accept only the electronic record as a ballot vote.”

The need for the resolution was the result of the language for the Internet Confirmation Guidelines for absentee voters produced by Scantegrity, a security system for optical scan voting systems that uses confirmation codes to allow a voter to ensure their ballot has not been changed and is included in the final tally, and presented to the BoE by Filip Zagorski. The confirmation guidelines for the absentee ballot are listed under the heading “Internet Confirmation.”

Baltimore mayoral candidate and state Sen. Catherine Pugh called Thursday for city officials to launch a media campaign to educate residents about the correct date for the Democratic primary after sample ballots mailed to voters listed the wrong one. Pugh said that the city should have the correct date — Tuesday, Sept. 13 — on a banner running on every show broadcast by its cable station and resend the entire corrected sample ballot.

“Please engage in corrective action that will inform the public of what this date is and, more importantly, the mistake that has been made,” she said during a news conference.

The error on one part of the 2011 Official Primary Sample Ballot incorrectly stated that the primary is on Saturday, Sept. 3 — an early voting date. The date was printed correctly in other places on the ballot.

On Election Day 2010, with the polls still open, computers placed calls to 112,000 voters in predominately African-American precincts in Baltimore City and Prince George’s County with an unusual message: “Relax” and stay home. The recorded message did not identify the calls’ sponsor; essentially, it told voters that Gov. Martin O’Malley had won and they did not need to vote.

Such campaign “dirty tricks” have been part of Maryland elections for years, pursued by both parties largely because the perpetrators judged they would neither be caught nor prosecuted.

In any case, there now are hopeful signs that such hijinks may soon be a thing of the past. A Baltimore grand jury recently returned criminal indictments against two aides to former Gov. Robert L. Ehrlich Jr., charging them with arranging the robocalls in a scheme to suppress voter turnout in heavily Democratic areas. One of the defendants, Julius Henson, also is among the targets of a multimillion-dollar civil suit filed by Maryland and U.S. officials.

Takoma Park has never been a city to shy away from trying something new. The small Maryland city is a nuclear-free zone. Non-citizen legal immigrants are allowed to vote in local elections and the city operates its own compost recycling program and silo for corn-burning stoves.

It’s ready to take the plunge into voting technology as well. Takoma Park is experimenting with online voting, hoping to pave the way for use in elections.  A small group of students, led by George Washington University computer science professor Poorvi Vora, spearheaded a test for online absentee voting in Takoma Park in partnership with Scantegrity and Remotegrity.

On a blistering hot day in this suburb of Washington, D.C,, 16 people participated in the trial of the system, using computers within the cool confines of the city’s Community Center.

A Maryland political operative behind misleading election day robocalls has a long and colorful history of political tricks so dirty that even in Baltimore political consultants “don’t want to even breathe the same air as him.” But a lawyer representing Julius Henson (who has admitted he was responsible for robocalls telling mostly Democratic voters not to bother going to the polls on Election Day) is arguing that his client’s right to free speech protects such tactics.

Henson, a Democrat, was working for former Gov. Robert L. Ehrlich (R) in his campaign against Maryland Gov. Martin O’Malley (D). The political operative has a long history in election shenanigans, much of it in the underbelly of campaigns in Baltimore and Prince George’s County.

In a room last summer, the brain trust behind the only Republican governor to lead Maryland since Spiro Agnew sat thumbing through a campaign strategy to suppress turnout among the state’s black voters.

It was a document that could have seemed like a relic, more likely to be found in a campaign office during the time of Agnew and the 1960s civil rights movement than during a campaign in 2010 to reelect former governor Robert L. Ehrlich Jr.

Now, the document in the hands of the Office of the Maryland State Prosecutor. It constitutes the centerpiece of indictments issued this week that that accuse one of Ehrlich’s most trusted aides, as well as a campaign consultant, of conspiring to suppress the black vote last year.

Paul E. Schurick, top aide to Mr. Ehrlich, and political consultant Julius Henson were charged with multiple counts of conspiracy to violate Maryland election law. Mr. Schurick, a fixture in Maryland politics, was also indicted on a count of obstruction of justice for allegedly withholding documentation that had been subpoenaed. An indictment is an allegation of facts, not proof, and lawyers for both men proclaimed the innocence of their clients. An attorney for Mr. Schurick said the charges were based upon “a fundamental misunderstanding of the facts” and said they would be vigorously challenged.

The city Board of Elections is working with Scantegrity, a research group that ran the citys 2009 elections, to develop a system in which absentee voters could vote online. The city will still be conducting traditional voting at polling places, regardless of whether an online absentee system is implemented, City Clerk Jessie Carpenter said.

The state of Maryland will be making a foolish choice if it decides to renege on its promise to replace our risky paperless touchscreen voting machines with a paper ballot, optical-scan voting system. The new voting system, with just one-fifth the equipment of the old one, would be much cheaper to operate and maintain. It would reinstill voter confidence by finally putting in place a safe, reliable voting system that records the votes as voters intended, and allows recounts to be conducted in close races. Maryland voters overwhelmingly favor a paper record of their votes and the transition to the new system is mandated by a law that passed the General Assembly unanimously in 2007. After years of debate and reams of data from computer security experts exposing a vast number of security vulnerabilities in touchscreen voting, as well as information from other states about the cost benefits of transitioning to optical scan voting, it appears that a well orchestrated effort has resurfaced at the 11th hour to mislead the Board of Public Works and others about the true costs of purchasing the new system versus the cost of trying to keep the old system on life support.
