Terri Sewell is angry that Alabama wants registered voters such as her wheelchair-bound father to show a photo ID before casting a ballot. The Birmingham Democrat, Alabama’s only black member of Congress, said her 77-year-old father doesn’t have photo ID since he let his driver’s license expire years ago. If the state’s law takes effect as scheduled in 2014, thousands of elderly, disabled and minority Alabama voters will either stay home each election day or will have to make “extraordinary efforts” to get a driver’s license, passport or other form of identification, Sewell said.

In 2012, new restrictions on voting enacted by state legislatures around the country have the potential to sway the presidential race by making it harder for citizens to vote, election experts say. “Here in Ohio, as in many other parts of the country, we have seen rules adopted in the past decade — and especially in the past year — that make it more difficult for eligible citizens to vote and have their votes counted,” Ohio State University election law expert Daniel P. Tokaji told a Senate Judiciary Subcommittee hearing earlier this year in Cleveland. The restrictions include curbs on organizations that register new voters, requirements that voters present photo IDs to vote and proof of citizenship to register, cutbacks in early voting periods and limits on voting by felons who have been freed from prison.

Conflicting estimates of how many Pennsylvania voters lack the required voter photo identification under a new state law are spurring debate about whether enough money is budgeted to implement it. The law requires voters to provide one of a half-dozen legally specified forms of photo ID when they go to the polls Nov. 6. The state budget for fiscal 2012-13 enacted June 30 provides $1 million to help the state Department of Transportation provide free nondriver photo ID cards to those requesting them. The Department of State has $5 million in federal funds through the Help America Vote Act for media advertising, mailings and phone calls for voter education and outreach, said agency spokesman Ron Ruman. State officials don’t see a need for budgeting more money at this stage while the League of Women Voters of Pennsylvania and Democratic lawmakers who uniformly voted against the law think the amounts are inadequate. The $1 million sum reflects analyses of the law’s fiscal impact by the House and Senate Appropriations Committees when it was enacted in March. The analyses cite assumptions that fewer than 1 percent of registered voters didn’t have a PennDOT ID card. The cost of producing a card is estimated at $13.50. “We pretty well knew from the beginning that the fiscal note lowballed what it was going to cost to provide free ID to people,” said Bonita Hoke, League executive director. “There is just not enough funding allocated for this.”

The same state voter ID laws that have drawn criticisms from Latino groups and immigrants are now taking heat from young voters. Gone are the days when young voters weren’t taken seriously. In 2008, they helped propel Barack Obama into the Oval Office, supporting him by a 2-1 margin. But that higher profile also has landed them in the middle of the debate over some state laws that regulate voter registration and how people identify themselves at the polls. Since the last election, Pennsylvania, Kansas, Wisconsin and Texas and other states have tried to limit or ban the use of student IDs as voter identification. In Florida, lawmakers tried to limit “third party” organizations, including student groups, from registering new voters.

At a recent meeting of the Pennsylvania GOP State Committee, the top Republican in the state House of Representatives, Mike Turzai, declared that a new requirement for voters to show identification with a photograph on it “is going to allow Gov. [Mitt] Romney to win the state of Pennsylvania.” He drew wild applause from Republicans in the crowd. The new law being referred to won approval under the state’s Republican Governor Tom Corbett and the GOP majority in the state legislature. The result is that 9.2 percent of the state’s 8.2 million voters are suddenly at risk of losing their right to vote. Eighteen percent of the registered voters in Philadelphia do not have government issued photographic identification. That means they won’t be able to vote.

A group opposed to the state law that requires Kansans to show a government-issued photo ID to vote will have volunteers at some polls Tuesday to see whether any voters are being deprived of their right to vote. “This law was pushed forward without thinking things through,” said Louis Goseland, coordinator for the KanVote campaign. On Tuesday, voters across the state will participate in Republican and Democratic party primaries. Kansas Secretary of State Kris Kobach pushed the photo ID requirement through the Legislature, saying it was needed to protect against voter fraud. Critics say that incidents of voter fraud are almost nonexistent in Kansas and that the ID requirement will disenfranchise some elderly and minority voters who don’t have a photo ID. There have been several local elections in Kansas since the photo requirement took effect at the start of the year. But this is the first statewide test.

Tim Solobay this week called Pennsylvania’s implementation of new voter ID requirements “embarrassing.” Solobay’s comments come in the wake of five days of Commonwealth Court testimony that revealed a “stunning lack of preparation and knowledge on the part of Pennsylvania officials only 12 weeks before national elections.” “This was a bad idea and now we’re seeing a bad idea badly implemented,” Solobay, D-Canonsburg, said. “It’s embarrassing. Reports from the court testimony this week are being broadcast across the country and have made Pennsylvania a laughingstock.” In an hour of testimony “marked by sarcasm and humor,” Solobay said, Secretary of State Carol Aichele insisted that 99 percent of Pennsylvanians have a valid photo ID, in clear contradiction with news releases by her department and the sworn testimony of staffers.  On further questioning, Aichele said she didn’t agree with the analysis of her staff before admitting, “We don’t know.”

Republicans should not be surprised if voter laws becomes a major topic of debate this election season—they will be the ones responsible for making it so. Over the past two years, the GOP has made a concerted attempt in a number of states to tighten voter registration procedures, cut back on alternatives such as early voting, and—most controversially—require would-be voters to show state-issued photo IDs as proof of identity. Because there’s such little evidence that these changes are needed to eliminate widespread voter fraud, it’s hard to avoid the conclusion that many Republican legislators want to discourage voting among groups—especially minorities and the poor—that cast their ballots mainly for Democrats.  But it’s worth remarking that beneath these crass political motives are some deeper moral issues. Proponents and opponents of these changes agree on one thing: Voting will be harder, and turnout will be lower. But is that necessarily a bad thing? Proponents think not. Speaking for many others, Florida State Senator Mike Bennett said, “I don’t have a problem making [voting] harder. I want people in Florida to want to vote as bad as that person in Africa who walks 200 miles across the desert. This should be something you do with a passion.”

Frank Dermody leads the House Democratic Caucus, having been re-elected every two years since he first won a House seat in 1990. But he might not be able to vote in the Nov. 6 general election. The Oakmont lawmaker on Wednesday said he received a letter from Secretary of the Commonwealth Carol Aichele suggesting he might not have adequate voter identification to cast a ballot under the state’s new voter-identification law. The department recently compared voter lists with databases from PennDOT, which issues the primary form of acceptable photo ID — a driver’s license. On his driver’s license, the lawmaker is Frank J. Dermody. His given name, however, is Francis J. Dermody. He said he has been trying to shed “Francis” since he was 16.

Broach was explaining his decision not to enforce the state’s controversial new law requiring voters to present one of a few forms of identification at the polls starting this November. The law could disenfranchise many voters in Colwyn, a small, 80-percent-black borough in Delaware County. (Statewide, 20 percent of voters may not have valid PennDOT-issued ID, according to data obtained by CP. In Philly, 43 percent of voters may not possess valid PennDOT ID.)  It would be a simple but vexing act of civil disobedience: When voters go to the polls this November, the neighborhood people who staff polling places throughout Pennsylvania could just plain not ask voters for the identification the law requires.

In his closing argument, Witold Walczak, legal director for the American Civil Liberties Union of Pennsylvania, said the state has shown no interest justifying a law that he said could disenfranchise hundreds of thousands of people.

Twelve years after a too-close-to-call presidential contest imploded in a hail of Florida punch card ballots and a bitter 5-to-4 Supreme Court ruling for George W. Bush, the country’s voting systems remain as deeply flawed as ever with any prospect of fixing them mired in increasing levels of partisanship. The most recent high-profile fights have been about voter identification requirements and whether they are aimed at stopping fraud or keeping minority group members and the poor from voting. But there are worse problems with voter registration, ballot design, absentee voting and electoral administration. In Ohio, the recommendations of a bipartisan commission on ways to reduce the large number of provisional ballots and long lines at polling stations in 2008 have come to naught after a Republican takeover of both houses of the legislature in 2010. In New York, a redesign of ballots that had been widely considered hard to read and understand was passed by the State Assembly this year. But a partisan dispute in the Senate on other related steps led to paralysis. And states have consistently failed to fix a wide range of electoral flaws identified by a bipartisan commission led by former President Jimmy Carter and former Secretary of State James A. Baker III in 2005. In Florida, for example, the commission found 140,000 voters who had also registered in four other states — some 46,000 of them in New York City alone. When 1,700 of them registered for absentee ballots in the other state, no one investigated. Some 60,000 voters were also simultaneously registered in North and South Carolina.

When Laila Stones sent a letter to the Commonwealth of Virginia requesting a copy of her birth certificate, the response was jarring: “They say I don’t exist,” she recounts under oath. Stones needs her birth certificate so that she can obtain a photo identification card and thereby vote in November. She’s a witness against the Commonwealth of Pennsylvania, where she now lives, in a lawsuit filed by civil rights groups to block the state’s voter ID law. Stones is one of at least ten witnesses called to testify about the burdens she’s suffered to obtain the ID now mandated for voting. Her testimony is mostly about why she doesn’t have the resources to comply. But how can this be? How hard is it to get a driver’s license? You need one for everything these days: to cash a check, to board a plane, to open a bank account, to buy allergy medicine, to buy liquor. How can one function in society without a picture of themselves on a government-issued piece of plastic? As I’ve covered the voting rights battles of 2012, these are questions I’ve heard repeatedly not just from Republicans and conservatives, but also from some Democrats, liberals and progressives. How can one exist without this card?

Does any journalist who is not an overt shill for the right actually believe that Republicans are pushing voter ID laws because they’re concerned about voter fraud? No, of course not. And for good reason. Voter fraud simply isn’t a problem in this country. Studies have definitively debunked the voter fraud myth time and again. In Pennsyvlania, which just adopted a tremendously restrictive photo-ID law that could disenfranchise 1 in 10 votersstate officials conceded they have no evidence of voter fraud, nor any reason to believe it could become a problem. By contrast, there is ample evidence that voter ID laws inhibit voting, particularly among minorities and the poor — two major demographic segments that tend to vote Democratic. And that’s hardly a coincidence. Consider the recent bragging by the Pennsylvania House Republican leader that his state’s voter ID bill “is gonna allow Governor Romney to win the state of Pennsylvania.”

PennDot offices throughout the state seem ill-equipped to handle the expected demands of voters seeking state-issued identification cards, according to witnesses testifying Tuesday in Commonwealth Court. In recent visits to the Department of Transportation’s offices, the witnesses said, they found long lines, short hours, and misinformed clerks, which made obtaining voter identification cumbersome, and in some cases impossible, for those who don’t have supporting documentation. Lisa Gray of Chadds Ford said she was caught in a Catch-22 situation. She does not drive because of a psychological disability and therefore has no license – and she was born in Germany. To get her birth certificate from the U.S. government, she needs a photo ID. Gray said she had exercised her right to vote for 35 years. “I vote because it’s important to me to make my voice heard,” Gray testified. “I may now be prevented by clerical stumbling blocks.”

Pennsylvania’s Secretary of the Commonwealth was on the witness stand today, during day five of the court hearing on Pennsylvania’s new voter ID law. And her testimony just added to the confusion over exactly how many voters need ID. Secretary of the Commonwealth Carole Aichele is the top state official in charge of implementing the voter ID.  But when she took the stand she was cagey, even making jokes in some instances in her response to plaintiffs’ attorneys. At one point, when lawyers asked her about the details of the voter ID law, Aichele responded, “I don’t know what the law says.”

A Nashville judge ruled that voters in Memphis cannot use newly issued library cards to vote in Thursday’s primary, but she also urged lawmakers to revisit the state’s new voter identification law to clear up aspects of it that she said made no sense. U.S. District Court Judge Aleta Trauger said Tuesday that she was not convinced the state legislature meant for election officials to accept cards issued by local governments when they passed a law last year requiring voters to show picture IDs. But she said at the conclusion of the two-hour hearing in the Estes Kefauver Federal Building in Nashville that it made no sense that voters could get their ballots by showing any state or federal ID, even one that is expired.

Day four of the court hearing on the state’s new photo identification requirement at the polls brought more testimony on the implementation of the new law, and a rare question for a witness from the judge presiding over the case.  Jonathan Marks, a Department of State employee who oversees elections programs, testified that his office has worked out how to deal with exceptional cases for those people who have difficulty even obtaining the yet-to-be-released Department of State voting ID. “We’re ready to go,” said Marks on the stand.  “It’s just a matter of training help desk staff [on] how to deal with these oddball exceptions.” Within the past month, the state revised its estimate of the number of people who may lack PennDOT-issued ID (driver’s or non-) to roughly 759,000.  Commonwealth Secretary Carol Aichele has said her office is confident many of those people actually do have PennDOT ID but were flagged because of discrepancies between the state’s voter registration database and PennDOT database.

A 63-year-old Air Force veteran testified today that Pennsylvania’s new voter identification law could prevent him from voting in upcoming elections because he has been unable to get a state-issued photo ID card. Taking the stand in Commonwealth Court in a hearing over the law’s validity, Danny Rosa of West Chester said poor health and eyesight have prevented him from getting a Pennsylvania driver’s license. And when a friend gave him an hour-long ride to the PennDOT center nearest his house, the clerk refused to issue the photo ID because the name on his New York birth certificate is Daniel Guerra — changed later to Daniel Rosa after his mother married his stepfather. Rosa is the name on his discharge papers and his Veterans Administration ID card. “I banged on the desk real hard and stomped out” of the PennDOT office when the clerk refused to give him a photo ID, he said. He said he is proud of his military service in the 1970s and his honorable discharge and thinks he should be allowed to vote.

Curious whether new restrictive state voting laws requiring photo ID will damage the credibility of this year’s election outcome, I sent email queries over the past week to several conservative analysts. I found their responses illuminating. Amy Kaufman, director of congressional relations at the Hudson Institute, wrote that “while there are changes to many states’ registration programs, these will not be an impediment to the victor.” She argued that Florida is “attempting to reduce voter fraud by purging possible noncitizens. Those people have the right to be readmitted by proving citizenship. It appears that over 500 of the roughly 2500 on that list have come forward to show documentation.” A colleague of Kaufman’s at the Hudson Institute, Michael Horowitz, was more outspoken, declaring that “requiring some form of identification of voters seems to me not merely reasonable but long overdue.” In Horowitz’s view, the “accusatory rhetoric” of Attorney General Eric Holder “about the alleged racism of those who support the I.D. reforms — unspeakable because he’s the Attorney General of the United States, not someone running for mayor of the District of Columbia  — merits condemnation from progressives, not a threat that Republicans will lack political legitimacy.”

The U.S. District Court is soon to rule on Texas’s new voter ID law. Ostensibly to combat voter fraud — the existence of which has yet to be demonstrated — the law would require every voter to present a government-issued photo ID at the poll. After a week of arguments this month, the question before the panel of federal judges is whether this law — one of many to emerge in the wake of 2010’s Republican legislative resurgence — places an undue burden on minorities. Under the Voting Rights Act of 1965, jurisdictions such as Texas with a history of suppressing minority voting must prove that any new requirements don’t “have the effect of denying or abridging the right to vote on account of race or color.” In March, the Justice Department denied the Lone Star State the necessary clearance for this new law, arguing that it would disproportionately affect Hispanic voters. Texas officials appealed. To preserve the access of all citizens to the right to vote — certainly among the most sacrosanct in our democracy — the District Court should follow the Justice Department’s lead and strike down this highly suspect and unnecessary law.

The summer of Minnesota’s discontent over voting rules has spun off a related fight: whether disabled people who cannot handle their own affairs should retain the right to vote. The debate has set off alarms among disabled people and their advocates, adding another layer of controversy to the legal and political battle over whether Minnesota needs a photo ID requirement for voters, changes in Election Day registration and a new provisional balloting system. “I want to vote,” said Dave McMahan, a 61-year-old military veteran with mental illness who lives in a Minneapolis group home and has his affairs controlled by a legal guardian. “I’ve been through sweat and blood to vote. I don’t want my rights taken away, because I fought for my rights here in the United States and expect to keep them that way.” Equally passionate is Ron Kaus of Duluth, an activist and plaintiff in a federal lawsuit that has raised the issue. Citing allegations in Crow Wing County in 2010, Kaus worries that disabled people have been hauled to the polls and told whom to vote for, which would be a crime. “It’s one of the sickest form of exploitation, political abuse,” he said.

The letters also do not tell voters where to go to obtain ID, but direct them to a website and phone number they can use to obtain more information.

Three hours with her daughter in the car. That is what it took for Olean Blount to get the right identification card to cast her ballot. “I don’t know why I needed it,” she said. “Everybody around here knows me.” The 92-year-old woman from Westport, a crossroads 11 miles southeast of Huntingdon in Carroll County, says she spent the better part of two days trying to get a picture ID in time for the March presidential primary. In the end, she could be counted among the more than 21,000 people who have received picture IDs from the state of Tennessee over the past year, a card that will allow her to vote. But as her experience illustrates, even when the cards are issued for free, they are anything but costless.

House Republicans on Thursday criticized the Justice Department’s decision to challenge new voter ID laws in several states, saying it shows the Obama Administration is more concerned with Democrats winning in November than protecting against election fraud.

Trent Franks, R-Ariz. “The partisan bias is obvious.” Thomas Perez, the department’s chief civil rights enforcer, denied any partisan bias or motivation in bringing federal court challenges under the Voting Rights Act to recently passed voter ID laws in Texas and South Carolina. In both states, Republican-controlled legislatures passed laws requiring voters to show government-issued photo identification in order to vote. The Justice Department indicated this week it also is looking at whether Pennsylvania’s new voter ID law violates the Voting Rights Act, a 1965 law for ensuring minorities’ right to vote. “Our philosophy has been very straight forward,” Perez told a House Judiciary subcommittee that Franks chairs. “We want to enforce laws. There’s a robust debate in this country, and we think we need to continue to have that debate and we do our level best to ensure that every eligible voter casts their vote and has access to the ballot.”
