A bill to make voting easier for members of the military passed the Senate unanimously Tuesday with many Democrats saying they hope a provision allowing voting by email is restored to the bill. Senate President Robert Stivers, a Manchester Republican, sponsored the bill as a show of bipartisanship with Democratic Secretary of State Alison Lundergan Grimes, who first proposed the idea. But last week Stivers stripped from the bill a provision that Grimes considers important — wording that would let overseas voters transmit their votes electronically by email or over the Internet. During floor debate Tuesday, Stivers said he deleted the provision because several county clerks had told him “they did not feel they could maintain the integrity of the ballot nor the anonymity of the voters.” He also said Richard Beliles, chairman of Common Cause of Kentucky, had expressed strong concerns about electronic voting.

Maryland: Proposed online ballot system called vulnerable to cyberattack | The Washington Post

A controversial change in Maryland Gov. Martin O’Malley’s otherwise popular bill to expand early voting could lead to voter fraud and expose the state’s elections to cybersecurity threats, according to a voting group and election technology experts. The provision, sought for more than a year by Maryland’s State Board of Elections, would allow any Marylander to receive a password by e-mail to download and mark a ballot at home before mailing it back to elections officials. But the problem, critics warn, is that the e-mail system lacks basic protections and there would be no signature verification or other means to ensure that the person for whom the ballot is intended is actually the person who casts it. Experts have also warned that the proposed online ballot delivery system could be hacked on a massive scale because of a second and related vulnerability that still exists with the state’s new online voter registration system. Maryland residents can register to vote online with a driver’s license number. But in Maryland, that number is a formula of a resident’s name and birth date that can be found online.

Ohio: Husted pushing for online voter registration | The Chillicothe Gazette

While in town to honor a longtime Ross County Board of Elections worker for his service, Ohio Secretary of State Jon Husted told the Gazette he plans to ask the General Assembly for the authority to create a process for online voter registration. Voters can change their addresses online at the Secretary of State’s website, but Husted said he hopes to have online registration available in the near future. “It is more inexpensive — more cost-effective, I should say — and more secure if we can register people electronically rather than with the old paper-based system,” Husted said. “We can save between 50 cents and $1 per voter for registration and when you can electronically validate them, you can ensure that only the people that should be legally registered are actually voting.” Husted said he plans to ask the General Assembly for the authority to create the system and, if approved, he anticipates it could be turned around in six months. Husted also said other election-related innovations such as allowing everyone the opportunity to vote early via absentee ballot by mail or in local board of elections offices have proven popular with voters.

A sense of humour in adversity can be attractive, but it is not always useful. Confronted by the worst recession in their country since the 1930s and the possible implosion of Europe’s single currency, the people of Italy have decided to avoid reality. In this week’s election a quarter of the electorate—a post-war record—did not even bother to show up. Of those who did, almost 30% endorsed Silvio Berlusconi, whose ruinous policies as a clownish prime minister are a main cause of Italy’s economic woes. And a further 25% voted for the Five Star Movement, which is led by a genuine comedian, Beppe Grillo. By contrast, Mario Monti, the reform-minded technocrat who has led Italy for the past 15 months and restored much of its battered credibility, got a measly 10%. This result is a disaster for Italy and for Europe. In Rome the centre-left coalition headed by Pier Luigi Bersani, the pre-election favourite who ended up getting only a whisker more of the vote than Mr Berlusconi, is now struggling to form a government: it is unlikely to be stable or durable (see article). Meanwhile, financial markets across Europe swooned on the news. Share prices fell sharply almost everywhere. Sovereign-bond yields jumped across the Mediterranean countries, to levels touched three months ago, even as they fell in Germany, bringing the euro crisis back to centre-stage.

“Welcome to Valley View photographic site,” says the weathered wooden sign, boasting that you are 8,000 feet above east Africa’s Rift Valley, the birthplace of mankind. A row of corrugated iron shops hawk traditional Masai cloths, soapstone chess sets and handcarved elephant, lion and zebra bookends. But today there are not many tourists to barter. Down in the valley there’s a clue as to why. Sunshine gleams off the metal roofs of housing built for families displaced by ethnic violence that followed Kenya’s general election five years ago. More than 1,100 people were killed and 600,000 fled their homes. On Monday, the nation goes to the polls again in possibly the most important vote in its 50-year history. Many fear a repeat. To outside eyes it is hard to believe that the most powerful country in the region, with its vibrant middle class, boutique malls and thriving tech sector, could be on the brink of catastrophe. But every five years, its foundations are shaken by the democratic cycle. Already in recent months more than 200 people have been killed in politically charged violence in the Tana river region and in the north. The fact that one of the front runners for the presidency has been indicted by the international criminal court is another portent of trouble ahead.

National: Voting Rights Act faces key test in Supreme Court | Los Angeles Times

The Supreme Court will take up a case from Alabama next week to decide whether to strike down a key part of the Voting Rights Act of 1965, a landmark measure that made voting a reality for blacks in the South and won extension by a near-unanimous vote from Congress in 2006. Critics on the right agree the law was a success, but they contend it is now outdated and unfair to the South. They also say it is used mostly as a way to force states to draw electoral districts that favor black or Latino candidates. But liberal legal scholars have urged the justices to step back and pay attention to the history of the Reconstruction era. They are pointedly addressing the conservatives, led by Justice Antonin Scalia, who say the court should follow the actual words and original understanding of the Constitution. The 15th Amendment, added in 1870, says the right to vote “shall not be abridged or denied … on account of race” and “Congress shall have the power to enforce this article by appropriate legislation.”

At 10 a.m. next Wednesday, the justices of the United States Supreme Court will hear oral argument in a case styled Shelby County v. Holder, one of the most anticipated of the current Term. Agreeing to review an argument made by an Alabama county that it ought finally to be free from one of the key requirements of the Voting Rights Act of 1965, the justices will have an opportunity both to lead and to follow the nation as it roils anew in political and legal battle over the rights of the poor, the ill, the young, the car-less, the black, the Hispanic, and the Native American to vote. Nearing its 50th birthday, the act has become a part of our national lore. One of the crowning achievements of the civil rights movement (and of the Johnson Administration), it was designed by its creators to finally give meaningful legal remedies to minority citizens — blacks, mostly, but not exclusively — who for generations had been precluded from voting (or from having their votes fairly counted) by a dizzying flurry of discriminatory state practices. The act didn’t just expand the scope of existing federal civil rights laws. It completely changed the dynamic between voters and state and local governments. And the results are indisputable: There is far less discrimination in voting today than there was half a century ago — and many millions more minority voters.

McCutcheon could be the new Citizens United. The Supreme Court’s decision Tuesday to hear a campaign finance case, McCutcheon v. Federal Election Commission, in its next term gives the justices a chance to continue their dismantling of restrictions on money in politics, most notably with the landmark Citizens United v. FEC decision of early 2010. With the new case, the court could strike a blow against fundraising limits for federal candidates and political parties. The case does not challenge the $2,600 cap on donations to a single candidate’s campaign but rather the overall limit — $123,000 — that one person can give over a two-year election cycle. Removing that ceiling would allow a single donor to give the maximum amount to more candidates and, crucially, to political parties such as the Republican National Committee, which brought the lawsuit along with Shaun McCutcheon, an Alabama businessman and conservative activist. The court decided decades ago that the government is constitutionally permitted to limit donations to candidates with the goal of fighting corruption. But the RNC argues that there’s no constitutional rationale for limiting how much one donor can give to many candidates. The thinking goes that because each candidate receives only $2,600, none of them ends up corrupted.

The announcement of this year’s Best Picture winner on Sunday will culminate an experiment unprecedented in the 85-year history of the Academy of Motion Picture Arts and Sciences. For the first time, Oscar winners will be determined largely by votes cast online. At a time when New Jersey and other states are considering holding more consequential elections over the internet, we should ask: How did the Oscar experiment go? Unfortunately, it went poorly, for reasons that shed light on the inherent difficulty of conducting secure, accessible, credible elections online. Problems for Oscar voters began at the beginning: logging in. Voters were required to create special, complex passwords, but when they tried to log in to the Oscar website, many found their passwords rejected. After re-entering passwords several times, voters were locked out of the site entirely and forced to call a help line. Many then had to wait for new passwords, delivered by snail-mail. Even relatively young and tech-savvy voters weren’t immune. As 42-year-old documentarian Morgan Spurloch told the Hollywood Reporter, “There’s even some young farts like myself that are having problems.”

A Senate committee applied the brakes Thursday to a proposal by Secretary of State Alison Lundergan Grimes to let overseas military members vote electronically, citing concerns about the potential for hackers to alter ballots. At the urging of Senate President Robert Stivers, R-Manchester, the committee voted along party lines to amend the bill to require ballots to be returned by mail, instead of fax or electronic transmission. The amendment also set up a study of electronic voting, to be completed by Nov. 27. After the committee unanimously approved the amended version of Senate Bill 1, Stivers acknowledged that he had consulted with U.S. Sen. Mitch McConnell about the measure. McConnell, a Republican, is seeking re-election next year. Many Democrats are urging Grimes to run against him. “We asked Sen. McConnell’s office to look at it because he has been involved in it,” said Stivers, adding that McConnell’s office is aware of voting procedures prescribed by the U.S. Department of Defense. Stivers said McConnell did not recommend changes to the bill. “No, these were from the county clerks association,” he told a reporter after the meeting.

Virginia: Lawmakers Pass Photo-ID Voting Requirement | NYTimes.com

Virginia lawmakers on Wednesday adopted a strict photo identification requirement for voters, a contentious issue nationally in last year’s presidential election. The Republican-dominated House of Delegates approved a bill passed earlier by the State Senate to require voters to show a government-issued document like a driver’s license, passport or special voter-identification card with a photograph at the polls. If signed into law by Gov. Bob McDonnell, a Republican, Virginia would join four other states with equally strict voter-ID requirements. A similar law in Pennsylvania was temporarily suspended by a state court before the November election. Attempts by Texas and South Carolina to adopt such strict requirements have been turned back by the federal government as violations of the Voting Rights Act. Supporters of voter photo-ID requirements say they prevent fraud. Opponents argue that the laws are meant to suppress turnout by poor and minority voters.

I was negotiating one of Nairobi’s terrifying traffic circles — a maneuver that requires jumping over a lattice of open sewers while playing chicken with a line of trucks snorting their way toward Uganda and Congo — when I was confronted with a vision to chill the heart and drop the jaw. Twenty young Kenyan volunteers in T-shirts and caps printed with the candidate’s face were jiving and chanting on the back of a campaign truck as it trundled toward the Sarit Center shopping mall in Westlands: “Vote for Brother Paul!” It was my first day back in the city that was once my home, and I’d just caught a glimpse of what must surely be the overriding characteristic of this East African country’s forthcoming general elections: shamelessness. For Brother Paul, as he is known since he found God, was once plain Kamlesh Pattni, the smirking, mustachioed brains behind Goldenberg, the biggest financial scandal in Kenyan history. The scam, in which top officials looted public coffers by claiming compensation for phantom gold exports, sent the economy into a nose dive that cost Kenya at least 10 percent of G.D.P. in the 1990s. Yet Pattni clearly sees no reason why that awkward fact should bar him from office.

As the College of Cardinals prepares to elect a new pope, security people like me wonder about the process. How does it work, and just how hard would it be to hack the vote? The rules for papal elections are steeped in tradition. John Paul II last codified them in 1996, and Benedict XVI left the rules largely untouched. The “Universi Dominici Gregis on the Vacancy of the Apostolic See and the Election of the Roman Pontiff” is surprisingly detailed. Every cardinal younger than 80 is eligible to vote. We expect 117 to be voting. The election takes place in the Sistine Chapel, directed by the church chamberlain. The ballot is entirely paper-based, and all ballot counting is done by hand. Votes are secret, but everything else is open. First, there’s the “pre-scrutiny” phase. “At least two or three” paper ballots are given to each cardinal, presumably so that a cardinal has extras in case he makes a mistake. Then nine election officials are randomly selected from the cardinals: three “scrutineers,” who count the votes; three “revisers,” who verify the results of the scrutineers; and three “infirmarii,” who collect the votes from those too sick to be in the chapel. Different sets of officials are chosen randomly for each ballot. Each cardinal, including the nine officials, writes his selection for pope on a rectangular ballot paper “as far as possible in handwriting that cannot be identified as his.” He then folds the paper lengthwise and holds it aloft for everyone to see. When everyone has written his vote, the “scrutiny” phase of the election begins.

Just because online voting is possible, doesn’t mean the U.S. government should try it for national elections any time soon. That’s the message computer security experts and advocates for voting rights are trying to get across to American voters. David Jefferson, a Lawrence Livermore computer scientist, said Thursday that hosting a national election online poses a national security threat. Jefferson was part of a press conference hosted by Common Cause, a transparency advocacy organization. He pointed out three fundamental areas of attack by hackers or viruses, with no immediate solutions for online voting. “Client side” attacks would trigger malicious software in a voter’s computer or smartphone itself. “Server side” attacks could bring down the servers that would collect and count the votes and the “denial of service” attacks could actually prevent people from voting and take the server down. “There is no fundamental solution to any of these categories of problems, and at least for the client or server side, anyone in the world can initiate such an attack. It can be completely undetectable so the outcome would be wrong and no one would know about it,” said Jefferson, who serves on the board of the Verified Voting Foundation and California Voter Foundation. Even if a faulty outcome is discovered, he added, there would be no way to correct it as there would be no audit trail to “recount.”

Barack Obama has ordered the creation of a non-partisan commission on voting rights in the US in an attempt to remove the hurdles to democratic participation that dogged the 2012 presidential election. The announcement of the commission on voting puts flesh on the promise Obama made in his second inaugural speech last month to fix America’s broken voting system. Last November, voters in main urban centres were inconvenienced by long lines at polling stations that in some areas forced citizens to wait for hours before casting their ballot. Florida, in particular, witnessed chaotic scenes with more than 200,000 voters estimated to have given up having waiting because the queues were so long. Obama said that the impediments to voting needed to be corrected, as voting was “our most fundamental right as citizens. When Americans – no matter where they live or what their party – are denied that right simply because they can’t wait for five, six, seven hours just to cast their ballot, we are betraying our ideals.” The president added: “We can fix this, and we will. The American people demand it. And so does our democracy.”

President Obama’s proposed commission on electoral reform, which seeks to improve voting efficiency and reduce long wait times for voters, is producing heated criticism from advocates on both the right and the left. Some conservatives view the initiative as federal overreaching on an issue that is rightly the province of states, while some voting rights advocates say that the president’s proposed commission is a too-timid response to what they see as a huge problem. “Setting up a commission is not a bold step; it is business as usual,” said Elisabeth Mac­Namara, president of the League of Women Voters. Critics of the commission say it doesn’t match the severity of the problem. “The president could have done much better by pointing to real solutions, like that in legislation already introduced on Capitol Hill to require early voting, set limits on waiting times, provide for portable voter registration and set up secure online voter registration.” Conservatives said the commission infringes on local control of the voting process. “I do not support the president’s proposal to appoint yet another national commission to study solutions to the problem of long lines at polling places that seems to be confined to very few states,” Rep. Candice S. Miller (R-Mich.) said in a statement, adding that she is opposed to national mandates.

The announcement last night of a new Presidential Commission on Election Administration brings to an end the speculation about President Obama’s plans to act on his observation that “we need to fix” problems with the nation’s election system. In one way, the decision to appoint a new Commission is a little puzzling, given the existence of the U.S. Election Assistance Commission; however, given the political limbo facing the EAC, the Administration may have decided that bypassing the appointment process via executive order was a way to get started on the process sooner than later. The choices to co-chair the Commission are very encouraging. Ben Ginsberg and Bob Bauer, while fierce advocates for their parties’ interests, have a long history of cooperation with one another on projects in this field, including attempts to help the nation’s judges bring some order to the often-messy process of election litigation. Hopefully, this will encourage policymakers on both sides of the aisle to look past what Election Law Blog’s Rick Hasen calls “the voting wars” and identify some solutions that can garner bipartisan support.

For these eligible and qualified voters—who show up at the polls on Election Day to make their voices heard only to be turned away because they inexplicably do not appear on the voter rolls or encounter a poorly trained poll worker not following voting rules—our democracy is broken.

President Obama has a long agenda for his State of the Union address, but it is important that he not forget the most fundamental democratic reform of all: repairing a broken election system that caused hundreds of thousands of people to stand in line for hours to vote last year. It is time to make good on his election-night promise. Those seeking political power by making voting more inconvenient will resist reforms, but a better system would actually be good for both parties and, more important, the country.Long lines are not the inevitable result of big turnouts in elections. They are the result of neglect, often deliberate, of an antiquated patchwork of registration systems that make it far too hard to get on the rolls. They are the result of states that won’t spend enough money for an adequate supply of voting machines, particularly in crowded cities and minority precincts. And they are the result of refusals to expand early voting programs, one of the best and easiest ways to increase participation.

Voting problems are nothing new. But as President Barack Obama showed Tuesday night, so are proposed solutions. In announcing his plan to create a new commission to “fix” long voting lines, Obama was mirroring similar efforts that followed the razor-thin — and infamously controversial — 2000 election. But unlike that response – Congress created the Election Assistance Commission that over the next decade doled out more than $3.2 billion to help states buy voting equipment, recruit poll workers and improve record keeping – the Obama White House has yet to say much about who’ll be named to the new commission or what they’ll be asked to do. Meanwhile, the 2002 commission is foundering, virtually inactive and unfunded. “There is nothing they are doing that is sufficient enough to justify their existence,” said U.S. Rep. Gregg Harper, R-Miss., a longtime critic. “It’s the perfect example of what [former president] Ronald Reagan said — that the closest thing to eternal life on this Earth was a government program.” That may leave Florida voters, tens of thousands of whom waited up to seven hours to vote on Nov. 6, waiting to see if the lines they faced will become a serious federal issue or just more political fodder. At this point, it seems far more likely that the first response will come from the Florida Legislature.

Pennsylvania: Voting machine questions explored – Unused ballot design software has cost county up to $45,500 | Times-Leader

Luzerne County has been paying $6,500 a year for ballot design software that was not used, the new election director said, a decision that might have cost the county as much as $45,500. Marisa Crispell-Barber informed the county election board of the expenditure at Wednesday’s board meeting. She believes the software was purchased annually since the county started using the electronic voting machines in the 2006 primary. The board gave her permission to seek county funding to obtain training to fully implement the software and prepare ballots in-house. The training would cost $15,000 but would pay for itself because the county would no longer have to pay the voting-machine vendor to prepare ballots, she said. The county paid the vendor, Election Systems & Software, $33,563 to prepare the ballot in the 2012 primary alone, she said. She wants to secure training to design the ballot for the May 21 primary. Another employee also would be trained, and in-house preparation would gradually build a ballot database that can be used by her successors, she said.

Armenian President Serzh Sargsyan is poised for victory in elections next week after rivals withdrew from a campaign that’s been dominated by one candidate’s attempted assassination and another’s hunger strike. Sargsyan, 59, has 69 percent support before the Feb. 18 vote, compared with 11 percent for his nearest challenger, Raffi Hovhannisyan, a former foreign minister, according to a Gallup poll published Feb. 9. Paruyr Hayrikyan, a former dissident who was shot and wounded in a Jan. 31 incident, has 5 percent backing, while Andrias Ghukasyan, who hasn’t eaten in 26 days and calls the ballot “fake,” has 1 percent, the survey showed.

Iran appears to be taking measures to tighten online censorship ahead of its presidential vote. In recent days, a long list of online activities has been designated as criminal, including calling for an election boycott, organizing sit-ins or protests, and insulting presidential candidates. Simultaneously, reports by Iran’s Fars and ISNA news agencies say that linking to Facebook, Twitter, and other websites that are blocked in Iran, or even promoting blocked websites, has also become a crime. Iran is already one of the world’s harshest online censors. The regime bans tens of thousands of websites it considers immoral or a threat to national security, including news websites and social-media sites. The new measures, if enforced, would put increased pressure on people who use the web or social media as platforms for online activism.

National: The GOP’s electoral vote gambit: Reasonably popular, but doomed | Washington Post

Many Americans support the way that Republicans want to adjust how some states award their electoral votes. But that doesn’t mean there’s going to be any new life breathed into the dying effort. A new poll from Quinnipiac University shows that neither awarding electoral votes on a winner-take-all basis to the winner of the statewide vote nor awarding them by congressional district gains majority support. Forty-six percent prefer the winner-take-all method, while 41 percent prefer to do it by congressional district, as Republicans in some key states are proposing. The rest are unsure. But that probably says more about people’s openness to Electoral College reform than it does about how much they like the GOP’s proposal.

The flaws in the American election system are deep and widespread, extending beyond isolated voting issues in a few locations and flaring up in states rich and poor, according to a major new study from the Pew Charitable Trusts. The group ranked 50 states based on more than 15 criteria, including wait times, lost votes and problems with absentee and provisional ballots, and the order often confounds the conventional wisdom. In 2010, for instance, Mississippi ranked last overall. But it was preceded by two surprises: New York and California. “Poor Southern states perform well, and they perform badly,” said Heather K. Gerken, a law professor at Yale and a Pew adviser. “Rich New England states perform well and badly — mostly badly.”

In 2006, Congress voted overwhelmingly to reauthorize key provisions of the Voting Rights Act of 1965 for another twenty-five years. The legislation passed 390–33 in the House and 98–0 in the Senate. Every top Republican supported the bill. “The Voting Rights Act must continue to exist,” said House Judiciary chair James Sensenbrenner, a conservative Republican, “and exist in its current form.” Civil rights leaders flanked George W. Bush at the signing ceremony. Seven years later, the bipartisan consensus that supported the VRA for nearly fifty years has collapsed, and conservatives are challenging the law as never before. Last November, three days after a presidential election in which voter suppression played a starring role, the Supreme Court agreed to hear a challenge to Section 5 of the VRA, which compels parts or all of sixteen states with a history of racial discrimination in voting to clear election-related changes with the federal government. The case will be heard on February 27. The lawsuit, originating in Shelby County, Alabama, is backed by leading operatives and funders in the conservative movement, along with Republican attorneys general in Alabama, Alaska, Arizona, Georgia, South Carolina, South Dakota and Texas. Shelby County’s brief claims that “Section 5’s federalism cost is too great” and that the statute has “accomplished [its] mission.”

Yesterday, the U.S. Postal Service announced that beginning in August, it will stop home collection and delivery of mail on Saturdays in an effort to keep itself afloat despite mounting financial losses. The story is notable in itself – as I’ve already seen in numerous pieces, the USPS has the potential to touch every home in America six days a week – but the impact is especially keen in the elections field, where growing reliance on vote-by-mail and absentee ballots has made election officials and the Post Office partners in the delivery and receipt of ballots. In the Pacific Northwest, where voters in Oregon and Washington now vote completely by mail, state officials are already making plans to cope if the USPS goes through with the plan to end Saturday service.

A possibly longer early voting period, more kinds of early voting sites and limiting the length of constitutional questions placed on the ballot by the Legislature are among Secretary of State Ken Detzner’s recommendations to lawmakers released today. Detzner’s suggestions, based on conversations with supervisors of elections in what he called “under-performing” counties including Palm Beach, dovetail with what the supervisors are requesting.

In 1998, Armenian presidential candidate Paruyr Hayrikian ran for office with the slogan “Let’s not lose an historic moment.” Fifteen years later, he has a similar one: “The historic moment has come.” But many Armenian observers believe that, by not requesting an election delay after suffering from gunshot wounds, 63-year-old Hayrikian has lost his chance for “an historic moment.” Hayrikian, who was shot twice and wounded on January 31 by an unknown gunman in Yerevan, earlier had indicated that he would probably apply to the Constitutional Court for a two-week postponement in the vote; his right under Armenia’s constitution. But, when push came to shove, it was not to be. “[N]o act of terrorism should hold the power of disrupting the natural flow of political realities,” he commented, in a surprise appearance at a February 5 press-conference in Yerevan. “I have come simply to show my presence,” he said to explain his hospital exit.
