Many large newspapers in California are bemoaning the very low turnout in special U.S. House and legislative elections recently. Some newspapers are editorializing in favor of eliminating special elections for the legislature, and advocating that the Constitution be changed to let the Governor appoint legislators to fill vacant seats. See this Los Angeles Times editorial, and this Santa Rosa Press Democrat editorial. The newspapers are correct that voter turnout in recent special elections has been low. Ever since the top-two rules were in force, starting in 2011, the median voter turnout in California special legislative and U.S. House elections has been 13.84%. The average has been 15.80%. There have been 19 special elections under top-two rules.

Now a retired California lawmaker is proposing an alternative: empty seats would be filled by the governor, not voters. The state legislature could take up the issue next month. Here’s a refresher on San Diego’s recent musical chair elections: Congressman Bob Filner was elected mayor, leaving his congressional seat open. Juan Vargas won that spot, leaving his state senate seat free, which was filled by Ben Hueso in a special election. But that left Hueso’s state assembly seat vacant, so another special election was called to fill it, which labor council leader Lorena Gonzalez won. The special elections for Vargas and Hueso’s seats cost San Diego County $1.5 million and $1.05 million respectively (the assembly seat election was consolidated with a special election to fill San Diego City Council’s District 4), according to Registrar of Voters Michael Vu. The turnout for both state elections hovered around 14.5 percent.

There was a special election in Los Angeles County last week. Didn’t know? Didn’t vote? Didn’t care? Well, you’re in the majority. Less than 9% of registered voters in the 54th Assembly District bothered to show up at the polls or mail in ballots. Angelenos, a generally disunited bunch, coalesced around apathy. But what does it say about us that the one thing we can agree on is indifference? The appalling turnout last week is a symptom of a much larger problem. Why did we even have a special election Dec. 3 in this district that includes Westwood, Ladera Heights, Culver City, Mar Vista and other neighborhoods in west and southwest Los Angeles? It was held to replace former Assemblywoman and current state Sen. Holly Mitchell. Thanks to term limits, which were enacted as a political “reform,” politicians in Los Angeles and California play an endless game of musical chairs, hopping from one elected office to another, sometimes in the middle of their terms.

California: Palmdale ordered to hold by-district election for City Council posts | Los Angeles Times

A Los Angeles County Superior Court judge, who earlier this year found the city of Palmdale to be in violation of the California Voting Rights Act, has ordered the city to hold a new by-district election for its four City Council posts. In a ruling dated last week and received by the involved parties over the weekend, Judge Mark V. Mooney ordered that the special election, to replace the balloting for council seats held last month, is to be conducted June 3, the same day as the California primary. Future elections are to be held in November of even-numbered years, to dovetail with state and federal balloting, in the expectation that such coordination will increase voter turnout. The judge allowed Palmdale to continue to elect its mayor by voters throughout the city. That means Mayor James Ledford’s recent reelection will not be affected by the ruling.

Under California law, the governor is allowed to choose a replacement for a statewide-elected official who vacates her post midterm. He chooses a replacement for county supervisor when one of those positions is unexpectedly vacated as well. It’s an easy and painless process that doesn’t attract much controversy or concern from voters. So why can’t the governor do the same thing with state legislators? This isn’t an idle question – in fact, it’s an expensive one. There have been 10 legislative desertions in the past year alone. In accordance with state law, each of these vacancies requires a special election at an average cost of $1 million. Can’t California always use a spare $10 million?

Bruce M. Peterson, the Democratic Party nominee for a six-year term on the Wayne Township Board of Supervisors whose name was omitted from the November ballot, will have to wait a bit longer for word on the next step. A hearing on Peterson’s request for a special election to decide the winner of the race took place Wednesday morning in Crawford County Court of Common Pleas before President Judge Anthony J. Vardaro. While Vardaro expressed optimism during the hearing that his decision-making would be complete before the close of business Wednesday, in the end, his ruling was not handed down before the courthouse closed. Peterson won the Democratic nod in the May 21 primary while incumbent Lee Singleton won the Republican Party nomination for the same seat. Both names qualified to appear on the township ballot for the Nov. 5 election, but the only name to appear was Singleton’s. Diane Putney Adsit, chairwoman of the Crawford County Democratic Committee and Peterson’s attorney, described the omission of Peterson’s name as “an error.”

But the apparent election of Sen. Mark Herring, D-Loudoun, as attorney general — and the time involved in a recount challenging his razor-thin victory over Sen. Mark Obenshain, R-Harrisonburg — raises the distinct possibility that winning the statewide offices could put Senate Democrats at a numerical disadvantage when the General Assembly convenes on Jan. 8. Currently the Virginia Senate has 20 Democrats and 20 Republicans. Ties on most issues are broken by the vote of the lieutenant governor, who presides over the chamber. For the past eight years, that has been the prerogative of Lt. Gov. Bill Bolling, a Republican.

Just days after Utah Attorney General John Swallow announced his retirement the Utah Democratic Party is taking issue with the governor’s office. The Democrats are calling the process of finding a new attorney general unconstitutional. As it stands right now, the governor will appoint a new attorney general once Swallow is done next week, but the democrats instead want Swallow’s election thrown out and are calling for a special election.  Can an elected official resign from an office that they never legally held?  That is the question that the Utah state Democratic Party takes issue with in the case of Utah Attorney General John Swallow.

Senate leader Darrell Steinberg says he has seen enough. He wants to rid California of incessant special elections to fill vacancies in the Legislature. The elections interrupt the legislative process, he asserts, and they bleed local taxpayers — roughly $1 million each time some lawmaker jumps ship, which has been increasingly often. Let the governor fill vacant seats and be done with it, the Sacramento Democrat contends. If it were possible, I’d order lawmakers to stop the music, grab a seat and stay put. This musical chairs game is too expensive for the adults, the taxpayers. No more switching offices in midterm. But forbidding politicians to run for another office is probably unconstitutional. So if they do bail in midterm, just let the governor choose their replacement.

Crawford County Court of Common Pleas is being asked to order a special election in the race for a six-year term on the Wayne Township Board of Supervisors. Bruce M. Peterson, a Wayne resident who was the Democratic Party nominee for the supervisor’s post, is petitioning the court because his name was left off the township’s ballot in the Nov. 5 general election. Peterson won the Democratic Party nomination for the supervisor’s post in the May 21 primary while Lee Singleton, another Wayne resident, won the Republican Party nomination for the same position in May 21 primary. Both names were to appear on the township ballot for the Nov. 5 election, but only Singleton’s did, according to the petition filed with county court.

Utah will have a new Attorney General by next month. Gov. Gary Herbert said he has the power to hand pick John Swallow’s successor, but the minority party in the state says not so fast. Senator Jim Dabakis, D- District 2, is the chair of the State Democratic Party, and he said Democrats plan on suing. They want last year’s election to be invalidated and think a state judge will ultimately side with them. “We will be going to court,” Dabakis said. He is taking the fight to the top, a judge. He believes the Lt. Governor’s report proves the election is invalid.

U.S. Rep. Trey Radel, R-Fla., caused a commotion after word got out that he had been arrested in Washington, D.C., at the end of October for possession of cocaine. Radel was charged with misdemeanor possession of cocaine in D.C. Superior Court on Tuesday. He pleaded guilty on Wednesday and was sentenced to one year of probation. Radel could have faced a maximum of 180 days in jail and a fine of up to $1,000.  Shortly after news of his arrest hit, Radel issued a statement apologizing for his actions. … Although Radel said he needed help, he did not mention resigning from the House in his statement. But his arrest could ultimately prove problematic for Radel, who has been in office for less than a year.

With Mark Herring considered Virginia’s attorney general-elect, pending a recount, Democrats in Loudoun and Fairfax counties have announced they will hold a Firehouse Primary Saturday to choose the party’s nominee to fill the 33rd District Senate seat. Two candidates have filed to run for the nomination, Leesburg attorney Jennifer T. Wexton and Herndon Town Councilmember Sheila A. Olem. With all the votes reported from the local registrar’s offices throughout the state, Herring, a Loudoun Democrat, pulled ahead of Republican Mark Obenshain last week in the attorney general’s race by a narrow margin of 164 votes out of the more than 2.2 million cast.

Ontario’s Liberal government made it clear Monday it was not open to a request from embattled Toronto Mayor Rob Ford for a snap municipal election so voters can decide if he should be booted out of office after admitting he smoked crack cocaine. “It’s not something we’re considering at the moment,” Municipal Affairs Minister Linda Jeffrey told reporters. “We’re not considering changing the electoral period that members sit. It’s not something we’re contemplating.” The province probably wouldn’t be open to changing the election date even if the request comes from the entire Toronto city council, added Jeffrey. Mayor Ford himself has spoken out against the cost of special elections, noted Finance Minister Charles Sousa. “The antics that are occurring in Toronto are distressing and concerning, but the last thing we want is for more disruption,” said Sousa. “Council has a job to do, let them do it, and we’ll wait to see when the next general election occurs in October.” Premier Kathleen Wynne has repeatedly said she wants city council to deal with Ford, and would step in only if there is a specific request from the city, and only if all three parties in the legislature approved any provincial action.

The mystery “duplicate ballot” was photographed, tweeted about and then shredded. In its internet afterlife, it was held up as evidence that recent electoral reforms centered around universal mail ballots were opening the state to fraud. In fact, the mystery ballot demonstrated that the system is working as well as it ever has done, and maybe better. It took a few days and some digging, but now it’s clear that the ballot was a Delta County special election ballot. It was mailed to Republican state House candidate Jon Keyser, an attorney at major Colorado law firm Hogan Lovells and a former Air Force intelligence officer. Keyser lives in Morrison, in Jefferson County, but he owns a Delta County parcel of land. He is eligible to vote in two elections. Keyser received two ballots in the mail because that’s how it works. They’re different ballots. He is being asked to vote in Jefferson County as a resident and on a long-term financing deal for Delta County’s Grand Mesa Water Conservancy District.

San Diego’s political parties are getting into the thick of the fundraising battle in the mayor’s race, spending tens of thousands of dollars on their favored candidates. But most of that money hasn’t come in the form of cash or in-kind contributions to councilmen David Alvarez and Kevin Faulconer. And none of it has come in the form of independent expenditures disbursed to support the candidates. Instead, the Republican Party of San Diego County is spending tens of thousands of dollars in a push to educate its party members and persuade them to vote. According to reports on file with the California Secretary of State, the county Republican committee has spent more than $61,000 on “member communications expenditures” on Faulconer’s behalf. Those communications can include pamphlets and direct mailers to party members.

The state’s online application allowing residents to search for the location of their polling place returned error messages for many users today, prompting the state to replace it with another service. Today is the day New Jersey voters will choose a new U.S. senator in a special election. Bill Quinn, a spokesman for the Treasury Department, which oversees the state’s network of websites, said the application slowed down this morning and many people received error messages or may have had to try multiple times to get the site to load.

The next day, NJ Governor Chris Christie issued a Writ of Election setting the date for primaries for the vacant seat on August 13, 2013, and a general election for the seat on October 16, 2013. For political pundits in New Jersey, Christmas comes twice this year. But state Democrats—as well as some Republicanscounty governmentsminority and public interest groups, and coastal communities – aren’t seeing it that way. On October 16th – a Wednesday, no less – New Jersey voters are being asked to go to the polls to select a new U.S Senator to replace Jeffrey Chiesa, Gov. Chris Christie’s stand-in for the long-time Democratic Senator Frank Lautenberg, who died earlier this year. Bizarrely, this oh-so-special election takes place just 20 days before these same voters will be asked to return to the polls for the regularly scheduled election for governor and state legislature. The cost to New Jersey taxpayers? Some $12 million. The adverse impact on voter turnout for having two separate elections in 20 days? Significant. The partisan calculation behind the election date? Blatant. It’s hard to know when we’ll hit bottom in shameless manipulation of our electoral laws by leaders of both major parties, but let’s hope it doesn’t get much lower than Gov. Christie’s “datemander.” When announcing his election schedule last spring, Christie justified the October 16th date with his professed belief that New Jersey voters needed as many days as possible with an elected Senator – then proceeded to appoint a Republican who for four months opposed most of the positions held by the man originally elected by those voters.

As the government shutdown continues to prevent all “non-essential” federal employees from doing their jobs, the Federal Election Commission’s operations have been particularly hard hit. With all but four of the agency’s employees furloughed until the shutdown’s end, voters in Alabama, Louisiana, Massachusetts, and New Jersey may not have any opportunity to see who is contributing to and running ads in support of the candidates. According to a Center for Public Integrity report, only the four currently-serving FEC Commissioners are considered essential. While parts of the agency’s electronic campaign finance disclosure system are automated, FEC Chairwoman Ellen Weintraub noted that no one will be around to resolve any glitches, computer crashes, or other parts of the disclosure process that require human action. “I don’t know how to personally post the reports — I’m a little out of my league there,” she noted, adding, “The public will have to go without disclosures until we open back up.”

After more than three hours of debate and public comment at a special meeting Wednesday night, Columbia City Council voted 4-3 not to put a strong mayor referendum on the November ballot. Instead, they’ll hold a special election Dec. 3 — but only if and when they receive a certified petition from the Richland County Election Commission. Petition gatherers presented a petition calling for a referendum to the election commission last Tuesday, but the commission hasn’t yet certified it. Councilman Sam Davis was the swing vote last week to give initial approval to a November vote, but said he’d only give it final approval if the petition was certified.

After Madison county voters took to the polls in a special election, two county jobs will not be merging into one job. County commissioners said the election cost taxpayers more than $300,000. “Special elections are always a big production,” said Probate Judge Tommy Ragland. On the ballot for the special election held Tuesday was a proposal to combine the county tax assessor and tax collector jobs into one.  Voters ultimately decided to keep the two jobs separate. “Everybody is needed in both offices,” said tax collector Lynda Hall. “There are over 175,000 parcels in this county that are supposed to be appraised annually, mapped and valued – and this is just in the assessor office.” After county commissioners said the election would cost taxpayers around $300,000, we started asking questions.

Two Colorado Democrats who provided crucial support for a package of state gun laws were voted out of office on Tuesday in special elections seen as a test of whether swing-state voters would accept gun restrictions after mass shootings at a Colorado movie theater and a Connecticut elementary school. The vote, which came five months after the United States Senate defeated several gun restrictions, handed another loss to gun-control supporters and gave moderate lawmakers across the country a warning about the political risks of voting for tougher gun laws. The immediate effect of the recalls — the first of their kind in Colorado — was to remove two state senators, Angela Giron of Pueblo and John Morse of Colorado Springs, and replace them with Republicans. Although the election was confined to two small districts in Southern Colorado and does not repeal Colorado’s gun laws or change partisan control of the General Assembly, both sides spent heavily and campaigned fiercely, fighting to prevail in what analysts called a proxy battle between gun-control advocates and the National Rifle Association.

Chris Christie today vetoed a measure that would had New Jersey voters casting ballots on just one election day this fall: Oct. 16. “Moving the date of the general election has the potential to cause unnecessary voter confusion, as the general election takes place at the same time each year,” Christie said in his veto message of the bill to move the election (A4237). “While the bill would require the Secretary of State to provide appropriate notice regarding the date change, there is no guarantee that every voter would know that the general election had been moved to October.” After U.S. Sen. Frank Lautenberg (D-N.J.) died on June 3, Democrats wanted Christie to call the special election to fill his seat for Nov. 5 — the same day Christie and candidates for all 120 seats in the Legislature are on the ballot. Christie, however, called the Senate special election for Wednesday, Oct. 16. The special election is estimated to cost an extra $12 million. Democrats charged it was because he did not want to share the ballot with a high profile Senate race.

We’re just a week away from Madison County’s special election to decide on combining the tax collector and tax assessor offices into a revenue commissioner position.Proponents say it will save money, but the price tag for the special election alone is pretty steep. Madison County Probate Judge Tommy Ragland says this special election should cost around $300,000. Getting all those voting machines out there costs money.  For one, Ragland notes the county doesn’t own them.  The machines have to be rented from a private company, the ballots purchased from them as well.

The price tag to fix the foul-up in the May municipal primary election is $17,332.98, Elections Director Marisa Crispell said after the Luzerne County Board of Elections meeting Wednesday. The problem erupted when a candidate for the Hazleton Area School Board – which encompasses parts of Luzerne, Carbon and Schuylkill counties – withdrew from the race. The Luzerne County Bureau of Elections did not notify the other two counties of the withdrawal, which led to the candidate receiving votes despite bowing out. After a pair of Luzerne County judges ruled the election needed a do-over, county officials initially estimated it would cost $2,300 if conducted by mail. Instead, the counties decided to conduct a complete and more expensive re-do by opening polling places.

California: San Diego Mayoral Special Election Date Determined | NBC

The San Diego City Council unanimously voted to hold the special mayoral election on Tuesday, Nov. 19. Mayor Bob Filner recently resigned amid sexual harassment allegations and his last day will be Friday. City Council President Todd Gloria will fulfill duties of the mayor and Council President Pro Tem Sherri Lightner will lead council meetings in place of Gloria until a new mayor is elected. At least seven people have filed paperwork for candidacy, including former mayoral candidate Nathan Fletcher. Other San Diego leaders, including Gloria and Councilmember Kevin Faulconer, have also considered running. The estimated cost is roughly $6 million for a polls election, which was voted for in favor of a mail election.
