North Carolina’s election oversight board has been vacant for more than a month, but the N.C. Supreme Court is poised to decide if Gov. Roy Cooper must make appointments to the new board designed by Republicans. Cooper last week asked the Supreme Court to block the law creating the State Board of Elections and Ethics Enforcement, which would be split equally among Republicans and Democrats – a change from the previous elections board, which was controlled by the governor’s party. Attorneys for House Speaker Tim Moore and Senate leader Phil Berger called on the court Monday to deny the request, and both the GOP legislative leaders and the N.C. Republican Party say Cooper needs to make appointments immediately.

North Carolina: Legislative leaders urge court to avoid special election | Associated Press

North Carolina Republican legislative leaders are re-affirming opposition to a special election this fall or winter for General Assembly seats, but say they’re prepared to redraw districts for the scheduled November 2018 election. The lawmakers’ attorneys responded Thursday to a Greensboro federal court seeking input about what to do after last month’s U.S. Supreme Court ruling. Justices agreed nearly 30 districts are racial gerrymanders and should be thrown out. But the high court rejected the Greensboro court’s order for a special election and wrote more work was needed evaluating whether it’s necessary. The GOP leaders say they’ve already laid out a schedule to draw new maps by this November. They say accelerating the timetable could short-circuit public and legislative feedback on maps and could prevent orderly elections.

Pennsylvania: Snyder seeks to broaden absentee voting | Observer-Reporter

State Rep. Pam Snyder, whose district includes Greene County and parts of Fayette and Washington counties, would like to see Pennsylvania allow early voting and no-excuse absentee balloting. “We’re busy people, on the go constantly to jobs, family responsibilities (and) civic duties,” Snyder said at a Harrisburg news conference last month, noting 37 states and the District of Columbia offer some sort of early voting. Twenty-seven states and the nation’s capital offer no-excuse absentee voting. “Not all of us work 9-to-5 shifts. We can do better. We should do better,” she continued.

Voting is a right in a democracy and the secrecy of the ballot protects citizens from reprisal. President Donald Trump may not appreciate this core American principle, but we’re pleased that most state election officials do. At least 43 states, including Texas, have pushed back against all or parts of the Presidential Advisory Commission on Election Integrity’s sweeping and unprecedented request to hand over names, addresses, dates of birth, political party and voting histories, criminal records, military status and the last four digits of Social Security numbers of voters dating back to 2006. Texas will turn over information already publicly available but rightly refuses to release full or partial Social Security numbers. We find it disturbing that Trump continues to deny Russian meddling in the 2016 elections, but remains preoccupied with using this commission to pursue his own unproven allegations that millions voted illegally, costing him the popular vote.

Utah: Group Plans Neutral Redistricting Board Ballot Item | Associated Press

Utah residents might have the chance to vote to form an independent redistricting commission that would redraw congressional and legislative district boundaries after the 2020 Census. A group called Utahns for Responsive Government is working to collect the more than 100,000 signatures required to put the initiative on the state’s 2018 ballot. “I strongly believe that the redistricting process (the determination of political boundaries), badly needs to be improved, and that politicians should not be choosing their voters,” said Ralph Becker, a former Salt Lake City mayor who is a member of the group.

Wyoming: Secretary of State rejects White House request for voter data, citing federal overreach | Casper Star-Tribune

Wyoming is joining more than 20 states in refusing to turn over public voter data to a federal commission investigating the integrity of elections. “I’m going to decline to provide any Wyoming voter information,” Secretary of State Ed Murray told the Star-Tribune on Monday. “It’s not sitting well with me.” The Presidential Advisory Commission on Voter Integrity sent a request to all 50 states last week, asking them to turn over any publicly available personal voter data. Many state officials, from across the political spectrum, have declined to do so.

Australia: Labor challenges election of Nationals MP David Gillespie in high court | The Guardian

Labor has launched a high court challenge to the right of a National party MP to sit in the parliament, which could remove the Coalition government’s one-seat majority. Labor’s national executive confirmed the decision on Friday morning to challenge the assistant health minister and National MP for Lyne, David Gillespie, over a potential commercial interest with the commonwealth. If the case were successful, a byelection would be triggered in the safe National party seat on the New South Wales mid-north coast. If the Coalition candidate lost, the Turnbull government would lose its one-seat majority. Gillespie won the seat after the former independent Rob Oakeshott retired at the 2013 election. Oakeshott ran at the 2016 election in the nearby safe National seat of Cowper but failed to unseat MP Luke Hartsuyker after a three-week campaign.

Canada: Online voting still too risky, cybersecurity expert says | The Record

Online voting is not a secure way for electors to choose a new government, says the chief technology officer of a Cambridge-based cybersecurity firm eSentire. “As a technologist and someone who is very concerned about the integrity of our elections, I would not be a fan or supportive of any electronic voting system,” said Mark McArdle. Online voting is expected to be used by 150 to 200 Ontario municipalities in the next round of municipal elections in October 2018. One of those cities will be Cambridge, which allowed online voting and telephone voting for a two-week advance voting period in 2014. In the next election in 2018, Cambridge will expand early voting to three weeks, and allow internet and telephone voting on election day.

Germany: De Maiziere expects Russian leaking to start in ‘weeks’ | EUObserver

Germany expects Russia to start publishing compromising material on German MPs in the summer in order to destabilise elections in September. Its interior minister, Thomas de Maiziere, and spy chief, Hans-Georg Maassen, issued the warning in Berlin on Tuesday (4 July) after unveiling a yearly intelligence report. De Maiziere said the material “could be published in the coming weeks,” the Reuters news agency reported. Maassen said Russia’s intention was “to damage trust in and the functioning of our democracy so our government should have domestic political difficulties and not be as free to act in its foreign policy as it is today.”

In Lae, students set fire to ballot papers in protest, while others at Unitech missed out on voting as only 1100 ballot papers arrived for a voting population of 5000. Similar stories were echoed across Papua New Guinea as 4000 to 5000 students in Goroka were denied the chance to cast a ballot.

Russia: Russian investigators raid election offices of Putin critic Navalny | Reuters

Russian investigators raided the Moscow election headquarters of Kremlin critic Alexei Navalny on Thursday and police entered a warehouse, where activists said they confiscated pre-election pamphlets. Navalny, who has organized two big anti-government street protests in recent months, is currently serving out a 25-day jail term for repeatedly violating the law on organizing public meetings. He is due out on Friday. Navalny says he wants to run for the presidency in March next year, but the Central Election Commission has said he is ineligible due to an embezzlement conviction which Navalny says was politically-motivated.

Rwanda: Climate of Fear Engulfs Rwanda’s Upcoming Vote, Amnesty Says | Associated Press

Rwanda’s presidential election next month will be held under “a climate of fear” following two decades of often deadly attacks on political opponents, journalists and rights activists, Amnesty International charged Friday, calling for serious political reforms in the East African country. “Since the ruling Rwandan Patriotic Front took power 23 years ago, Rwandans have faced huge, and often deadly, obstacles to participating in public life and voicing criticism of government policy,” said Muthoni Wanyeki, an Amnesty official in East Africa. “The climate in which the upcoming elections take place is the culmination of years of repression.” Many killings and disappearances, including some recent ones, have been blamed on the government of President Paul Kagame, who has been his country’s de facto leader or elected president since the end of the 1994 genocide.

Recently, the newly created Presidential Advisory Commission on Election Integrity sent a letter to all fifty states asking them to submit extensive information about registered voters. The letter has created an uproar among state officials, and many have announced their intention to refuse the request. President Donald Trump has tweeted his disapproval of these state refusals. Overlooked in the controversy has been the rather obvious conclusion that, because the Commission on Election Integrity appears to have ignored the requirements of the Paperwork Reduction Act (PRA), its request is simply illegal.

The commission’s request for a massive amount of state-level data last week included asking for all publicly available information about voter rolls in the states, such as names of all registrants, addresses, dates of birth, partial Social Security numbers and other data. It immediately encountered criticism and opposition, with some saying it could lead to an invasion of privacy and others worrying about voter suppression. The states that won’t provide all of their voter data grew to a group of at least 44 by Wednesday, including some, such as California and Virginia, that said they would provide nothing to the commission. Others said they are hindered by state laws governing what voter information can be made public but will provide what they can.

National: Justice Department Request For State Voter Information Follows Similar Kobach Query | KCUR

Officials with the U.S. Department of Justice are asking states including Kansas for information related to the National Voter Registration Act — a move made the same day that the president’s commission on voter fraud sent a request for “publicly available voter roll data.” In a letter sent June 28, Justice Department officials requested data on how states purge registrations of people who have died or moved. The letter seeks information to confirm that states are complying with federal law and keeping voting lists updated. Kansas Secretary of State Kris Kobach on the same day sent requests for voter registration information to all states in his role as vice chairman of President Donald Trump’s commission on voter fraud. Numerous states have said they will not provide some or all of the information that Kobach requested.

Former Department of Justice officials and voting advocates are seriously alarmed over a DOJ letter sent to states last week that they say could signal a forthcoming effort to kick people off voter rolls. This comes as national attention focuses on several states blocking a request for voter information from President Donald Trump’s commission to investigate voting fraud, which does occur, but is not a widespread problem. The DOJ sent the letter to 44 states last Wednesday, the same day the Presidential Advisory Commission on Election Integrity sent a letter controversially requesting personal voter information. The DOJ letter requests that election officials respond by detailing their compliance with a section of the National Voter Registration Act of 1993 (NVRA), which covers 44 states and was enacted to help people register to vote, but also specifies when voters may be kicked off the rolls. Several experts said it’s difficult not to see the DOJ letter in connection with the commission’s letter as part of a multipronged effort to restrict voting rights.

National: Investigators explore if Russia colluded with pro-Trump sites during US election | The Guardian

The spread of Russian-made fake news stories aimed at discrediting Hillary Clinton on social media is emerging as an important line of inquiry in multiple investigations into possible collusion between the Trump campaign and Moscow. Investigators are looking into whether Trump supporters and far-right websites coordinated with Moscow over the release of fake news, including stories implicating Clinton in murder or paedophilia, or paid to boost those stories on Facebook. The head of the Trump digital camp, Brad Parscale, has reportedly been summoned to appear before the House intelligence committee looking into Moscow’s interference in the 2016 US election. Mark Warner, the top Democrat on the Senate intelligence committee carrying out a parallel inquiry, has said that at least 1,000 “paid internet trolls working out of a facility in Russia” were pumping anti-Clinton fake news into social media sites during the campaign.

It’s an understatement to say the Presidential Advisory Commission on Election Integrity’s request to every state for highly-sensitive personal information on every U.S. voter is raising major concerns among leaders in almost every state. … Dozens of states, from deeply blue to deeply red to everything in between, either refused to provide any personal data on voters, or agreed only to provide the minimum of what the law in their state required (usually just name, address and political party information). Incredibly, even secretaries of state that serve on this commission, including Secretaries Lawson of Indiana, Dunlap of Maine, and Gardner of New Hampshire, and Secretary Kobach himself, have refused to turn over all the information requested. And for good reason. … [A]ll these taxpayer resources are being spent to research a question to which we already know the answer – the extent to which voter fraud exists. On this point, every piece of research conducted by states both red and blue, academics, and even the Bush Department of Justice, agrees – voter fraud exists but only barely. It is extremely rare, comprising only thousandths of a percent of the total ballots cast.

Last week, the commission sent letters to secretaries of state of all 50 states requesting all “publicly available” information of voters including names, addresses, birth dates, party affiliation, and last four digits of Social Security numbers. … Reagan said after she received the request letter on Monday she conferred with her attorneys and decided that releasing any information to the commission would not be “in the best interests of the state.”

When a commission created by President Donald Trump to investigate voter fraud asked all 50 states last week to share the name, party affiliation, last four digits of social security number, voting history and other personal information for each of the country’s 200 million registered voters, the outcry was swift, widespread and bipartisan. The commission was established in May, following Trump’s complaints that he only lost the popular vote in the November election because there were millions of illegal voters.

Maine: Secretary of state now says Maine will not provide voter information to fraud panel | Portland Press Herald

Maine Secretary of State Matthew Dunlap has changed course and decided against releasing detailed information about every registered voter in the state to the Presidential Advisory Commission on Election Integrity. Dunlap said he met Monday with Attorney General Janet Mills and she advised him that releasing Maine’s Central Voter Registration files to the commission would violate state laws that protect personal voter-registration data from being made public. On Friday, Dunlap had said he would provide the commission with some information that was identified as publicly available. The request, dated June 28, was made to all 50 states by Kansas Secretary of State Kris Kobach, the commission’s vice chair.

Attorney General Brian E. Frosh asked a federal court Friday to dismiss a lawsuit that claims state lawmakers violated Republicans’ constitutional rights when they redrew Maryland’s congressional boundaries six years ago. The state’s response in the redistricting case — the first since the litigation forced several state Democrats to explain under oath the motivation behind Maryland’s contorted congressional districts — asserts the plaintiffs have offered no evidence voters were targeted simply because they are registered Republicans. Brought by a group of GOP voters in the 6th Congressional District, the case is one of several pending in federal courts that rely on new legal arguments to challenge the constitutionality of political gerrymandering. The Supreme Court recently agreed to hear one of those lawsuits this fall — and that litigation, which comes out of Wisconsin, could play into the Maryland suit.

Nebraska: Senators urge Gale to decline Trump’s voter information request | Lincoln Journal Star

Six state senators on Wednesday urged Secretary of State John Gale to decline to turn over personal data about registered Nebraska voters to the Trump administration. Nebraska needs to “protect the integrity of our elections and the security of our lawfully registered citizens,” they wrote Gale. “Public access to identifying information and partial Social Security numbers can lead to identity theft,” they said. “Protecting the personal and financial security of Nebraskans is important.”

The New South Wales Electoral Commission (NSWEC) is eyeing potential changes to its iVote platform ahead of the NSW’s 2019 election. iVote offers both browser-based Internet voting and telephone voting. It was used in the 2011 and 2015 NSW state elections, and as well as in the 2017 Western Australia election and a number of by-elections. … In 2015, cyber security researchers uncovered a vulnerability in iVote that could potentially be exploited to stage man-in-the-middle attacks to subvert votes. “We found a serious security hole that exposed the browsing session both to an attack called the FREAK attack and another attack called the Logjam attack,” one of the researchers, Dr Vanessa Teague from the University of Melbourne, last year told the hearing of a NSW parliamentary inquiry.

Germany: Interior Minister is expecting Russian effort to influence election | Reuters

Germany is expecting Russia to try to influence its general election on Sept. 24, but there are no indications of which party it would seek to back, officials said on Tuesday. Interior Minister Thomas de Maiziere said at a news conference that data stolen in 2015 in a hack of the lower house of parliament could surface in the coming weeks. Hans-Georg Maassen, the head of Germany’s domestic intelligence agency, said that while it was not known what Russia would do he suspected that Russian President Vladimir Putin would prefer a different German chancellor than Angela Merkel. It was likely that Russia had sought to influence the U.S. election and everything points to Moscow’s involvement in efforts to influence the election in France, de Maiziere said. “As a result, it cannot be excluded – and we are preparing internally – that there will be a similar effort to influence the election in Germany,” he said. Russia has denied trying to influence foreign elections.

National: Mueller investigation into U.S. election meddling could draw focus to Russian organized crime | Associated Press

The U.S. government has long warned that Russian organized crime posed a threat to democratic institutions, including “criminally linked oligarchs” who might collude with the Russian government to undermine business competition. Those concerns, ever-present if not necessarily top priorities, are front and centre once more. An ongoing special counsel investigation is drawing attention to Russian efforts to meddle in democratic processes, the type of skulduggery that in the past has relied on hired hackers and outside criminals. It’s not clear how much the probe by former FBI Director Robert Mueller will centre on the criminal underbelly of Moscow, but he’s already picked some lawyers with experience fighting organized crime. And as the team looks for any financial entanglements of Trump associates and relationships with Russian officials, its focus could land again on the intertwining of Russia’s criminal operatives and its intelligence services.

National: Democrats: Did Americans help Russia hack the election? | Politico

The cascade of investigations into Russian interference in the 2016 election includes a darker undercurrent from some senior Democrats: What if Moscow had American help? Hillary Clinton, Virginia Gov. Terry McAuliffe and Mark Warner, the top Democrat on the Senate Intelligence Committee, have all stoked speculation that American insiders may have helped the Russians orchestrate their wide-ranging hacking and disinformation campaign — including with guidance on which political targets to exploit and what kinds of leaked information would most resonate with swing voters. The Democrats got backup from former FBI Director James Comey, who told lawmakers in June he was sure law enforcement would work to determine “if any Americans were part of helping the Russians.” But so far, no public evidence has surfaced that any Americans coordinated with Moscow’s digital army in selecting targets for hacking, strategically deploying the purloined documents for maximum political impact — a point echoed by research firms investigating the election-year hacks.

As Americans celebrate Independence Day, it’s worth remembering that the right to vote in free and fair elections stands at the heart of that independence — and that this cherished right is under attack by a hostile foreign power. New revelations of Russian interference in the 2016 presidential election arrive regularly. Last month came news that Russian hackers had probed the voting networks in 21 states and had executed a cyberattack on a contractor that supplies voting software to states. “They will be back,” former FBI director James Comey warned in congressional testimony. In the face of this threat, the nation’s leaders, at the federal and state levels, have done little to harden defenses against future attacks. For the most part, President Trump has been in denial about Russian meddling, as if acknowledging the problem threatens the legitimacy of his election, and has focused instead on unproven allegations of extensive voter fraud.
