Lord Mayor Erias Lukwago clashed with the Electoral Commission lawyer, Enos Tumusiime, in court yesterday over claims that there was bribery during the Rubaga North vote recount. Lukwago, who is a witness for Moses Kasibante, the former Rubaga North parliamentary candidate, was being cross-examined on his affidavit by Tumusiime before High Court judge, Vincent Kibuuka-Musoke.
Tumusiime asked Lukwago to substantiate a claim he allegedly made under cross-examination by MP Singh Katongole’s lawyers last week that the NRM deputy treasurer and Kampala district returning officer, Molly Mutazindwa, received a bribe before the vote recount.
Lukwago denied the allegation, saying he only said money changed hands before the vote recount, but did not name the officials who were involved.
He asked court to produce the notes taken when he was cross examined by Dr. James Akampumuza.
Tumisiime insisted that Lukwago had named Mutazindwa as the person who received the money, forcing the judge to interject. The judge then read to court the notes he took down when Lukwago was being cross-examined but did not come across Mutazindwa and Katongole’s names.
“This is what the witness (Lukwago) said. You are free to look at my file any time,” Musoke said.
Lukwago, however, maintained that money changed hands before the vote recount, adding that he was denied the opportunity to adduce evidence to this effect when Philip Odoki, the then Mengo Chief Magistrate, allowed the exercise to continue despite his objection.
